Protecting a newly discovered deep-sea species takes more than naming it. Scientists and authorities need to document the animal and its habitat, establish what lives there before disturbance, determine which legal regime applies, assess human pressures and their combined effects, and put enforceable safeguards and monitoring in place. Discovery begins that process; it does not automatically confer legal protection.
Why discovery is only the beginning
A species described for the first time by science may already be living in a place affected by human activity. Its discovery does not, by itself, show that it is rare, threatened, or legally protected. Those judgments require evidence about the species, the size and condition of its habitat, its ecological relationships, and the pressures that reach it.

That evidence is especially important in the deep sea, where a lack of baseline knowledge can make it difficult to tell whether a later change reflects natural variation or damage. The International Union for Conservation of Nature (IUCN) calls for rigorous, transparent environmental impact assessments based on comprehensive baseline studies. Its 1981 resolution on deep-sea mining also recommended ecological surveys and baseline reference areas before commercial mining. IUCN’s deep-sea mining brief and the resolution describe the role of that early evidence.

A useful way to think about protection is as a chain: identify the species and place, understand the risks, select rules that address those risks, and check whether the rules are working. If any link is missing, the name of a species or a protected-area designation alone may offer little practical assurance.

What scientists need to establish first
Describe the species and its habitat
Researchers need to record more than a specimen’s appearance. A conservation baseline should connect the species to its location and the conditions of the habitat it uses. Depending on the discovery, that may include documenting the boundaries and physical setting of the habitat, ecological relationships, and other organisms found there. The purpose is to describe what exists before a proposed activity or other pressure changes it.
Site information matters alongside species information. A record with precise location data can help determine whether the discovery lies in a national maritime zone, on a continental shelf, or in the international seabed Area beyond national jurisdiction. It can also help assessors identify which activities could reach the habitat. The applicable seabed rules and those for the water above it are not necessarily the same; seabed jurisdiction should not be mistaken for jurisdiction over the overlying water column.
Create a reference point for later comparisons
Baseline surveys give later monitoring something meaningful to compare against. Without a picture of conditions before disturbance, it is much harder to detect change, attribute it to a particular activity, or assess the effectiveness of safeguards. A baseline does not have to mean that every organism or ecological relationship is already understood. It should make clear what was surveyed, what was observed, where and when observations were made, and what remains uncertain.
That uncertainty should affect decisions rather than be hidden by them. Where knowledge is incomplete and harm could be serious or difficult to reverse, IUCN’s brief supports applying the precautionary principle as part of responsible decision-making. The brief also sets out IUCN’s policy recommendations—including transparent governance, public consultation, polluter-pays, and effective protection. These are IUCN’s recommendations, not a claim that each is already a universally binding legal requirement.

Which activities could harm a deep-sea species?
Risks depend on the location, species, habitat, and activity. For proposed deep-sea mining, the machinery is not the only potential source of harm. IUCN identifies suspended sediment plumes as a concern: sediment can smother animals or harm filter feeders. Noise, vibration, light, and pollution are additional potential pressures. These risks make it important to assess the area affected by an activity, not only the point where equipment operates. IUCN’s 2022 issue brief discusses these concerns and the need for impact assessment.
Other pressures may also matter at a particular site, including fishing, shipping, and climate-related pressures. They should be considered when relevant, rather than assumed to affect every discovery in the same way. An assessment that examines one proposed activity in isolation may miss combined or cumulative effects from multiple pressures.
For that reason, an environmental impact assessment should be transparent about its evidence and uncertainty, consider alternatives, examine cumulative pressures, and provide for monitoring and public consultation. Those elements help decision-makers judge not only whether an activity could cause harm, but whether proposed avoidance or mitigation measures are credible and can be checked.
Where the species is found determines who can act
The first legal question is where the seabed discovery lies. National maritime zones, continental shelves, and the international seabed Area are governed through different arrangements. NOAA’s overview of seabed activities explains that distinction. It describes the International Seabed Authority (ISA) as facilitating international cooperation in mineral development in the Area for parties to the UN Convention on the Law of the Sea. NOAA also notes that U.S. citizens’ deep-seabed mining beyond national jurisdiction is addressed by the U.S. Deep Seabed Hard Mineral Resources Act; its deep-seabed mining page includes a January 2026 regulatory update.

These examples illustrate why a conservation plan cannot begin and end with a species name. Authorities need to know which jurisdiction and rules apply at the site, which agencies or international bodies have relevant roles, and which states’ obligations matter. A species’ habitat may also cross boundaries or be affected by activities beyond the immediate discovery point, so coordination may be important.
The UN Agreement on Marine Biological Diversity of Areas Beyond National Jurisdiction—the BBNJ Agreement—entered into force on 17 January 2026. Its subjects include marine genetic resources and benefit-sharing, area-based management tools such as marine protected areas (MPAs), environmental impact assessments, and capacity-building and technology transfer. The UN schedules the agreement’s first Conference of the Parties for 11–22 January 2027. The UN’s BBNJ Agreement portal provides the agreement information and institutional timing; the Secretary-General announced the entry into force on 17 January 2026 in his statement.
Entry into force is a significant legal milestone, but it does not mean that every state is a party, that every site already has an MPA, or that a newly described species automatically receives site-specific protection. The measure available in a particular place depends on applicable rules, implementation, and the authorities with power to adopt and enforce it. Country-specific conclusions require checking the relevant state’s status and the rules applicable at the site.

An MPA or another area-based management tool can protect a geographically defined place or feature. But “protected area” is not a single, uniform level of restriction. NOAA describes MPAs ranging from relatively simple declarations protecting a resource to places with extensive regulation, with different objectives and legal bases. The designation alone does not tell a reader which activities are permitted or prohibited. NOAA’s MPA overview explains this range.

IUCN’s guidance on governing areas beyond national jurisdiction says fully and highly protected areas offer the most certain benefits, while broader area-based measures may be needed as species, ecosystems, and human uses shift. The appropriate design depends on what needs protection and what pressures are present. A useful assessment asks:
- Protected feature: Is the goal to safeguard the newly discovered species, its habitat, ecological relationships, or a larger ecosystem?
- Spatial coverage: Does the boundary include the habitat and the area likely to be affected by relevant activities?
- Permitted activities: What does the measure actually prohibit, limit, or allow? Does it address the risks identified in the assessment?
- Connectivity: Could the species or relevant ecological processes depend on areas beyond the proposed boundary?
- Monitoring and enforcement: Who checks compliance and ecological outcomes, and what happens if the measure is breached or fails?
Restrictions should fit the threats. For example, if a mining assessment identifies potential plume effects beyond the immediate work area, a boundary or rule focused only on the equipment footprint may not address the stated risk. Conversely, the evidence should support the scope of a restriction; a label cannot substitute for showing how a measure protects its intended feature.

Impact assessment and area-based protection answer related but different questions. An assessment evaluates proposed activities, alternatives, and risks; an area-based measure sets rules for a defined place. Either may be inadequate if it is detached from the other. Assessment findings should inform the boundaries and permitted activities of protective measures, while monitoring should test whether those measures reduce harm in practice.

Good governance makes that system inspectable. Assessors and decision-makers should be clear about the baseline evidence, methods, uncertainties, cumulative pressures, consultation, and reasons for their choices. Monitoring plans need to identify what will be observed and how results will be compared with baseline conditions. If monitoring detects unexpected damage or a measure proves ineffective, the response may need to change as knowledge and conditions change.

Enforceability is equally important. A protection measure needs an authority responsible for adopting it, a way to monitor relevant activity and environmental outcomes, and a mechanism to respond to violations. Where more than one legal regime or authority is involved, the division of responsibilities should be explicit. A policy recommendation, treaty obligation, domestic rule, and designated area are not interchangeable: each has a different legal status and should be described accurately.
Why restoration or offsets cannot be treated as a substitute
Damage to a habitat with poorly understood species may be impossible to repair in a way that restores what was lost. In a 2017 statement, IUCN senior advisor Kristina Gjerde said, “The new rules governing deep sea mining must take its full costs to society and the environment into account.” The statement was made on 7 June 2017, not issued as a current legal rule. IUCN also warns that out-of-kind restoration or preservation cannot compensate for the loss of unknown deep-sea species. The dated IUCN statement sets out that position.
This is a practical reason to emphasize avoiding harm and assessing risk before an activity begins. A different habitat or species cannot be assumed to replace an unknown organism and its ecological role. If a proposal relies on restoration or an offset, decision-makers should ask what specific feature it would restore, whether that outcome has been demonstrated for the relevant deep-sea setting, and whether it is being used to excuse avoidable damage.
A practical sequence from discovery to protection
- Document the find: Record the species, location, habitat boundaries and conditions, ecological relationships, survey methods, and remaining uncertainties.
- Establish a baseline: Identify pre-impact conditions and reference areas that can support later comparison; make the survey coverage and limitations transparent.
- Map jurisdiction: Determine whether the relevant seabed is within a state’s jurisdiction, on a continental shelf, or in the international Area, and distinguish seabed rules from those for the water column.
- Identify pressures: Examine the activities that could affect the species or habitat, including indirect and cumulative effects where relevant.
- Assess alternatives and risk: Use baseline evidence in a transparent impact assessment; consider avoidance, mitigation, uncertainty, consultation, and monitoring.
- Select enforceable measures: Choose an MPA or other area-based tool only after specifying its protected feature, coverage, restrictions, authority, and enforcement arrangements.
- Monitor and adapt: Compare observations with baseline conditions, publish or otherwise make results accountable, and revise rules when outcomes or knowledge warrant it.
This sequence is not a guarantee that every newly discovered species will receive a particular legal designation. It is a way to connect scientific evidence to decisions that can actually reduce risk, while keeping the limits of the evidence visible.
