What Forced Arbitration Means in Video Game Addiction Lawsuits

Forced arbitration may shift covered video game addiction claims from court to a private arbitrator. Recent rulings show why the result depends on the terms, evidence, and applicable law.

Forced arbitration can move a covered video game addiction lawsuit out of court and into a private arbitration proceeding—but it does not automatically apply to every player or every claim. Courts look at the specific terms, proof of acceptance, delegation language, applicable state law, and the circumstances of the person who used the game. Recent cases have reached different results.

What forced arbitration means

An arbitration clause is a contract term that may require covered disputes to be decided by a private arbitrator rather than a judge or jury in court. Under Section 2 of the Federal Arbitration Act, covered arbitration agreements are generally enforceable, subject to the statute’s exception and generally applicable contract defenses.

Some terms also contain a delegation clause. This assigns threshold questions—such as whether a dispute falls within the arbitration clause—to the arbitrator. The Supreme Court explained in Rent-A-Center, West, Inc. v. Jackson that a specific challenge to the delegation agreement may be for a court to decide, while a challenge to the contract as a whole may be left to the arbitrator when a valid delegation provision applies.

What the video game addiction cases show

Federal trial courts have not reached one universal result. Their rulings turn on the agreement and evidence before them, as well as applicable law.

Johnson v. Activision Blizzard, E.D. Ark., Feb. 18, 2025 The court found a valid agreement, ordered arbitration, and stayed the claims against the Activision defendants. Arbitration was compelled on the record in that case.
Sayers v. Microsoft, S.D. Ga., Sept. 4, 2025 The court found sufficient evidence the plaintiff accepted the current EULA and terms of use. The terms delegated scope and enforceability questions to the arbitrator, so the court compelled arbitration and stayed the proceeding. Both evidence of acceptance and delegation language were consequential.
Mercado v. Roblox, E.D. Pa., Sept. 25, 2026 The court denied Roblox’s motion to compel. It found that the minor had assented to the terms but had disaffirmed the contract under Pennsylvania law. Assent did not end the inquiry; the minor’s disaffirmance mattered under the state law applied.

Evidence of parental agreement and the minor’s legal position were relevant to this motion.

These are case-specific district court rulings, not a nationwide rule about every game agreement or minor. The Ninth Circuit’s Keebaugh v. Warner Bros. Entertainment Inc., which was not an addiction lawsuit, illustrates other relevant issues: the court upheld arbitration for non-minor plaintiffs, did not decide the minor’s disaffirmance arguments, and addressed a California public-injunction issue.

How a court evaluates whether arbitration applies

1. Was an agreement formed?

A court may examine how the terms appeared, whether the user had to accept them, account and usage records, and declarations describing the acceptance process. In Sayers, the court accepted evidence of a scrollwrap agreement and proof of acceptance. Simply showing that a person used a game or had an account does not, by itself, resolve whether that person agreed to the relevant terms.

2. What do the arbitration and delegation terms say?

The arbitration clause defines which disputes it covers. A separate delegation clause may assign the initial decision about scope or enforceability to the arbitrator. Those provisions should be read separately: a challenge to the arbitration agreement generally is not necessarily the same as a specific challenge to the delegation agreement.

3. Do contract defenses or state law affect enforcement?

Issues such as a user’s age, disaffirmance, assent, and unconscionability may matter, but their treatment varies with state law and the record. The Pennsylvania rulings in Mercado and the Georgia ruling in Sayers demonstrate why one case cannot determine every player’s rights.

4. What did the court’s order actually do?

An order granting a motion to compel arbitration sends covered matters to arbitration. If the court also stays the case, the court proceeding is paused while arbitration goes forward. A denial means that motion failed on the record before that court; it does not decide whether the underlying video game addiction allegations are true.

How to compare rulings without overgeneralizing

When reading a report about a particular video-game addiction dispute, check these details before drawing a conclusion:

  • Court and governing law: Identify the state law and court involved; the decisions discussed here are not all from the same jurisdiction.
  • Age and disaffirmance: Determine whether the user was a minor and whether the agreement was disaffirmed under the applicable law.
  • Notice and acceptance: Look for evidence about how the terms were presented and how, when, and by whom they were accepted.
  • Clause wording: Check the scope of the arbitration term and whether a delegation provision appears.
  • Specific challenge: Note whether a party challenges the arbitration agreement, the delegation clause specifically, or both.
  • Procedural result: Distinguish a grant from a denial of a motion to compel, and identify which defendants and claims the order covers.

What an arbitration ruling does not establish

A ruling about the forum is not a decision on the merits of allegations that a game caused addiction or injury. Those allegations should be described as allegations unless a court has determined them. Nor does an agreement found enforceable in one case establish that every user accepted the same version of terms or that the same clause applies to another player.

The cases cited here were decided between February 2025 and September 2026. Game terms can change, and later rulings may affect how a particular dispute is handled. The relevant agreement, acceptance evidence, governing law, and court order are specific to each matter.
