Yes, a game can use AI-generated character voices, but there is no blanket permission that makes every voice or use safe. Before production, identify whether the voice is synthetic or based on a recognizable person, establish rights to the source recordings and voice identity, and put the permitted uses, compensation, data handling, and disclosure terms in writing. A model’s output being copyrightable is a separate question from whether you may use a person’s voice.
First, identify what kind of voice you are making
“AI voice” can describe materially different workflows. Classify the voice before choosing a vendor or recording talent, because the source material and identity being used affect the permissions you need to investigate.
- Novel synthetic voice: generated without intentionally imitating an identifiable performer. Check the model’s source and license terms, and test whether the result nevertheless resembles a real person or established character.
- Voice replica: a model intended to reproduce a particular performer’s recognizable voice. Treat permission to use the underlying recordings and permission to reproduce the voice as separate issues.
- Modified actor recording: a human performance is altered or extended with AI. Check the original recording and performance agreement, and whether the changes or additional generated lines fall within the authorized use.
- Licensed digital replica: a performer or rights holder has authorized a specific replica. Confirm the actual scope and conditions of that authorization rather than assuming the label “licensed” covers every game use.
Inventory the recordings, scripts, training material, prompts, and third-party voice models involved. Record where each came from and what rights or restrictions apply.
What rules apply to your performer and production?
For covered performers and productions, SAG-AFTRA’s 2025 Interactive Media Agreement includes consent and disclosure requirements for AI digital-replica use. It also lets performers suspend consent for the generation of new material during a strike. Check whether the agreement covers the performer, production, and work; do not assume its terms apply identically to every game engagement. SAG-AFTRA reported that members approved the agreement by a 95.04% to 4.96% vote. That is a ratification result, not a measure of AI-voice use or impact.

The U.S. Copyright Office treats digital replicas, copyrightability of AI outputs, and AI training as distinct subjects. Its Part 1 report on digital replicas, published July 31, 2024, says existing laws do not provide fully adequate protection and recommends a federal response. That is the Office’s analysis and recommendation—not a new law or a complete account of applicable law in every jurisdiction. The Office’s AI report index lists Part 2 on copyrightability of AI outputs, published January 29, 2025, and Part 3 on AI training, whose pre-publication version is dated May 9, 2025. The index described a final Part 3 as forthcoming; check the index for later status.
Union contract provisions are not a universal legal rule. SAG-AFTRA’s discussion of its animation agreements describes character-voice protections, including consent and notice or bargaining provisions, but those provisions belong to the agreements discussed. They do not automatically govern every game or performer. The available sources do not provide a complete state, international, or storefront-specific rules survey, so assess the jurisdictions and platforms relevant to your release separately.

What should a developer check before using an AI voice?
1. Get permission for the actual voice and planned uses
Obtain clear written authorization for any identifiable performer replica or altered performance. Define the project and character, platforms, territory, languages, duration, updates and downloadable content, marketing use, and whether new lines may be generated after the original session. Check performer representation and applicable collective bargaining agreements before relying on an individual contract.
2. Set compensation, disclosure, and control terms
Specify how the performer is paid, how uses will be reported, whether the performer can review or restrict generated material, and how consent may be suspended or end. Decide what must be disclosed to the performer, players, storefronts, or other parties under the applicable agreement, market, and platform rules. The sources here do not establish one disclosure rule for every game or jurisdiction.

Do not treat a past vendor-union deal as proof of current terms. SAG-AFTRA announced a standalone agreement with Replica Studios in 2024 that addressed consent, compensation, and licensed performer voices for interactive projects. Its FAQ, updated September 24, 2025, says that specific agreement is no longer in effect. The 2024 announcement is available here; it is historical context, not evidence of a current vendor program.
3. Govern recordings and derived voice data
Ask what recordings and derived voice data the vendor retains, who can access or reuse them, whether they can be used to train or improve models, how subcontractors are handled, and how data will be returned or deleted. Put retention, access, reuse, and deletion expectations in the agreement, and verify vendor-specific terms rather than relying on an older agreement’s safeguards.

4. Review generated lines and keep a rights trail
Test output for recognizable likeness, unauthorized imitation, performance quality, context, and unintended lines. Maintain a log connecting source recordings, permissions, vendor and model, prompts or generation process, approvals, and shipped content. Escalate recognizable real-person voices, deceased performers, legacy characters, or contract conflicts for qualified legal and labor review.

What to have settled before recording or shipping
- Voice type, source material, identity, and rights are inventoried.
- Written permissions cover the specific project, uses, platforms, territory, duration, updates, and marketing scope.
- Performer coverage and applicable collective bargaining agreements have been checked.
- Compensation, disclosure, review, restriction, suspension, and exit terms are documented.
- Vendor retention, access, training, subcontracting, reuse, and deletion practices are understood and agreed.
- Generated lines have been reviewed, and provenance and approvals are recorded for shipped content.
