You usually do not lose a game automatically when its developer files for bankruptcy. Bankruptcy changes who controls the game’s code, copyright, trademarks, contracts and revenue. A publisher, insolvency trustee or buyer may keep selling and supporting it; the game may be licensed to another company, delisted from stores, or left dormant. For players, the decisive practical issue is whether the game works without the developer’s servers. An offline game can remain playable for years after a studio closes, while an online-only game can become unusable when authentication, matchmaking or hosting stops.
Refunds are not triggered by bankruptcy alone. They normally depend on the platform’s refund policy and on consumer law in the player’s jurisdiction.

Bankruptcy changes control, not necessarily the game
When a company becomes insolvent, its property and obligations are gathered into an insolvency estate. A completed game can be one of those assets. The UK Insolvency Service’s technical guidance for Official Receivers, published in 2021 and updated in 2026, states: “Yes, copyright is an asset, therefore existing copyright relating to any work created by an insolvent prior to the making of an insolvency order vests in the estate.”

The estate must establish which entity owns the source code, art, music, trademarks, sequel rights, distribution rights and customer data. Receivers are advised to examine software contracts for copyright ownership, other intellectual-property rights and restrictions on assignment. A game may therefore be sold, licensed, held for a potential buyer or abandoned if its liabilities exceed its value.

The estate can sell or license rights
A trustee or administrator can seek a buyer for the game’s intellectual property, a catalogue of several titles, or specific assets such as source code and trademarks. A buyer might relaunch the title, port it to another platform, continue server operations or use the technology in a different product. If no buyer is interested, the rights can remain dormant even though the game still exists in players’ libraries.
Different entities may own different pieces
The studio that made a game may not own all of its commercial rights. A publisher could own the trademark, hold an exclusive distribution licence or have a perpetual licence to the underlying intellectual property. Music, voice performances, branded content, middleware and platform agreements can impose separate territorial, term or assignment limits. As a result, a bankruptcy court’s treatment of one asset does not answer every question about the game.
Why the publisher’s contract often matters more than the bankruptcy filing
Publishing agreements commonly allocate ownership, source-code access, marketing duties, platform distribution, support obligations, termination rights and what happens if either party becomes insolvent. The agreement may let a publisher take over distribution, recover materials from escrow, end the relationship, or require a sell-off period for existing inventory and downloads.

The World Intellectual Property Organization’s Business and Legal Issues for Video Game Developers guide warns that “a bankruptcy filing or an assignment for creditors may not entitle the publisher or developer to a cure period.” In other words, insolvency can activate termination or enforcement rights without giving the other party unlimited time to fix a breach. The same guide discusses possible injunctive relief, sell-off periods and continuing customer-support duties for online features after an agreement ends.
A court example: TimeGate Studios v. Southpeak
The Fifth Circuit record in TimeGate Studios, Inc. v. Southpeak Interactive involved a publisher receiving a perpetual licence in the intellectual property for Section 8. The example is useful because it shows why “the developer owns the game” is not a safe assumption. The enforceable contract, not the studio’s role in creating the title, determined an important commercial right.
What a buyer will examine
- Whether the code, art and documentation are owned outright or licensed from contractors.
- Whether a publisher can distribute the game after insolvency and in which territories.
- Whether platform, music, brand, middleware and payment agreements can be assigned.
- Whether server accounts, player databases and moderation tools can legally and technically be transferred.
- How much support, hosting and patching the contracts require after termination.
These details explain why two games made by studios that enter bankruptcy can have completely different outcomes.

What happens to the game in each release state

Delisting is not the same as removing your library copy
A store can stop selling a title without revoking every existing player’s access. Valve’s Steamworks documentation says: “Retired games will remain in players’ Steam libraries. Those players will continue to be able to download, install, and launch the game.” Thus a delisting normally prevents or limits new purchases while leaving an existing library entitlement intact under that platform’s rules.

Three events should be kept separate:
- Delisting: the game no longer appears for new customers or cannot be purchased in a region.
- Library removal: the platform removes or disables an existing entitlement, which is a separate platform decision.
- Server shutdown: the files remain available but a required online service no longer operates.
A game can be delisted yet downloadable, or remain listed while its servers are failing. A platform’s documentation and notice for the specific title control the result; there is no universal rule that bankruptcy erases a purchase.
Why online games face the greatest risk
Server-dependent games require more than a copy of the client. The operator may need to maintain authentication, matchmaking, databases, payment systems, anti-cheat services, moderation and customer-support channels. Bankruptcy can lead to unpaid hosting bills, loss of engineers with operational knowledge, expired certificates, disconnected payment accounts or an inability to respond to security incidents.

Offline-capable games
If the game launches and saves locally without contacting the developer, bankruptcy’s visible effects may be limited to delisting, missing patches and the end of support. Keep a lawful local installer or backup where the platform permits it, and record any activation steps before support disappears. Compatibility with future operating systems is not guaranteed, but the title does not depend on a company continuing to pay for servers.
Games with optional online features
The single-player campaign may continue after leaderboards, cloud saves or multiplayer are disabled. Check whether the game requires an online sign-in at startup, rather than assuming that an “offline” label covers every mode. If the platform offers an offline mode, test it before the service is scheduled to end.
Online-only games
If the operator stops authentication or core gameplay servers, reinstalling the client cannot restore access. A buyer could keep the service alive, migrate it, or release a server-authoritative update, but none of those outcomes is automatic. Community-hosted servers are possible only when the code, protocol and licence permit them; players should not assume that a fan project is legal or technically sufficient.

Ending development and shutting down servers are also separate decisions. In a current example, Riot announced that active development of 2XKO would end in December 2026 while servers would remain online and the game would remain downloadable during the stated plan. A bankruptcy may compress or disrupt a transition, but a company can stop adding features while continuing to operate a service.

Usually, you apply the platform’s normal refund process. Steam states that purchases follow its standard refund policy and that it may extend refunds when a game is cancelled or promised features are not delivered. That is a discretionary or policy-based response, not an automatic bankruptcy entitlement.
Potential remedies depend on several facts:
- Platform policy: deadlines, playtime limits and exceptions differ between stores.
- What was promised: cancellation, non-delivery of advertised features or a service that never became available may support an exception.
- Jurisdiction: consumer-protection and digital-content laws can provide rights beyond a store’s voluntary policy.
- Payment route: a platform, console manufacturer, mobile store or direct seller may be the legally relevant merchant.
- Timing: a claim made soon after a shutdown announcement is easier to document than one made years later.
Keep the receipt, order number, store notice, advertised feature list and evidence of the service failure. Do not assume a chargeback is consequence-free; payment disputes can affect an account and should be considered only after checking the merchant’s process and applicable law.

- Identify the rights and service operators. Check the game’s store page, credits, privacy policy and official notices. The developer, publisher, platform and server operator may be different companies.
- Read the shutdown notice carefully. Look for dates for new sales, downloads, authentication, matchmaking, refunds and customer support. “Delisted” does not by itself mean “removed from your library.”
- Test offline access. Disconnect the network after a successful sign-in and launch the game. Test saves and the modes you actually use.
- Preserve permitted files and account information. Download installers, patches or save data where the platform allows it, and keep proof of purchase. Do not bypass technical protection or redistribute copyrighted files.
- Submit a timely refund request if appropriate. Explain the specific failure—cancellation, inaccessible online service or undelivered feature—and attach the relevant notice.
- Follow the insolvency process for a larger claim. Developers, esports organisers, licensors and other businesses may need to file a creditor claim or consult counsel in the relevant jurisdiction.
How to assess a particular game
For a title-specific answer, work through these questions in order:
- Who owns the intellectual property? Review the publisher and developer credits, trademark records and any rights-holder announcement.
- Who can distribute it? A publisher may retain a perpetual or exclusive licence even if the studio is gone.
- What must run online? Separate launch authentication, matchmaking, cloud saves, payments and optional features.
- What does the platform promise? Read the current store agreement and any game-specific retirement notice.
- Which contracts could block a transfer? Music, branded content, middleware, territories and privacy obligations can prevent a straightforward sale.
- What does the bankruptcy docket show? Asset-sale motions, licences, assignments and notices identify the legal status more reliably than rumours.
Until those questions are answered, statements such as “the game is gone” or “the publisher owns everything” are guesses. Bankruptcy law is jurisdiction-specific, and the result can change as an asset sale or contract ruling proceeds.
