Before paying for a branded game, digital collectible, or bundle with merchandise, check what the digital purchase actually grants, what accounts or services it depends on, who handles refunds, and exactly what physical item ships. “Buy” does not always mean permanent access or ownership of the software, and a token does not automatically give you rights to its associated artwork.
Start by identifying what you are buying
A product page may combine several things that have different terms: access to a game or downloadable content, a digital token, artwork linked to that token, and a physical collectible or other merchandise. Treat each as a separate item when reading the listing and agreement. Look for the seller, issuer, included contents, and the terms that apply to each part.
- Digital game or add-on: Check whether the transaction grants a license to access or use content, and whether it can be transferred.
- Digital collectible: Check what the token represents and whether it conveys any rights to display, use, or commercially exploit associated artwork.
- Physical merchandise: Confirm the exact item, quantity, condition, seller, shipping charge, and return terms.
Does buying a digital game mean you own it?
Not necessarily. The FTC explains that access to a digital item may depend on keeping an active account, the platform continuing to operate, DRM, or the seller retaining the rights needed to provide the content. Its guidance warns: “You may have access to it only while you have an active account with the platform or website that sold it, or only for as long as that platform or website stays in business.” FTC: Do you really own the digital items you paid for?
Read the applicable terms for the storefront and region rather than relying on the word “buy.” For example, PlayStation’s U.S. Terms of Service say: “When you order or purchase a product from PlayStation Store, you buy a personal license to use that product for private, non-commercial use.” The terms also say the license is not transferable unless local law requires otherwise, and distinguish digital Store content from physical goods. Check what a digital collectible actually includes
A token, the artwork associated with it, and the rights to use that artwork can be separate. Read the issuer’s collectible agreement to see what rights are granted, what uses are restricted, and whether the token depends on a particular service or redemption process. Do not assume that owning a token means owning copyright in its image or that the image, game feature, website, or redemption service will remain available indefinitely.
Mattel’s Digital Collectible License Agreement is one issuer-specific example: it describes an NFT linked to digital art and distinguishes the intangible artwork from items with physical dimensions. Map the dependencies before you pay
Ask what must remain available for you to use or redeem each digital component. Check the product terms and listing for dependencies such as:
- A particular account, console, storefront, game, or app.
- An online server, wallet, image host, or redemption website.
- Continued access to the account that made the purchase.
- Any deadline or eligibility requirement for redeeming a bonus or physical item.
The FTC’s guidance identifies account access, platform operation, DRM, and the seller’s licensing position as potential factors in continued access. If a listing does not explain what happens when a service closes or an account is lost, do not treat continued access as guaranteed.

Find the refund policy for the actual point of sale
Refund eligibility depends on what you bought, where you bought it, and whether you have started downloading, streaming, or using it. A bundle may contain digital and physical items with different rules. Find the policy for the checkout you will use, and check whether local consumer rights add protections.
Third-party storefronts
Epic says purchases made through third-party stores are transactions with those stores and are governed by their refund rules. Its policy also says real-money purchases through third-party mobile or console stores, or a developer’s own payment provider, are subject to the policy at the purchase point. PlayStation Store in the United States
PlayStation’s U.S. cancellation policy says games and add-ons may be canceled within 14 days if downloading or streaming has not started. Once it has started, they are generally not eligible for a refund unless faulty. The policy separates games and add-ons from pre-orders, bundles, subscriptions, wallet funds, and physical goods, and preserves rights that may apply under local law. Do not infer that merchandise is official just because a listing uses a game’s name, characters, or artwork. Check whether the rights holder or an authorized seller substantiates the licensing claim, and compare the listing’s contents with what the bundle promises. Ubisoft’s U.S. Store Terms of Sale, last updated September 2024, cover physical collectibles such as figurines, toys, books, T-shirts, and accessories as well as games and digital content. Those terms establish a category of goods sold through that store; they do not verify any unrelated marketplace listing or current stock.

For marketplace purchases, review the seller’s terms, delivery and shipping costs, return process, dispute procedure, and the specific protections that cover both that seller and item. The FTC advises: “Make sure the protection applies to the thing you’re buying or the seller you’re buying from.” It also recommends using safer payment methods. - Confirm the seller’s identity and evidence for any “official” or licensed claim.
- Check the exact item, quantity, condition, and whether shipping is included.
- Read return and cancellation terms before checkout.
- Use a payment method with protections, and verify that those protections apply to this transaction.
For a child’s account, check spending controls
Games may offer children in-game currency, weapons, outfits, loot boxes, or bonus levels, sometimes through a payment card linked to the account. Before approving a game or bundle, check the account’s payment settings and whether any included or promoted purchase is random, consumable, or an additional spend beyond the listed price. A practical pre-purchase checklist
- Separate the components. Write down the game, add-ons, token, artwork rights, and physical items included.
- Read the controlling terms. Identify the storefront or seller, issuer, region, and agreement for each component.
- Check access and transfer limits. Find out what account, platform, server, wallet, or app is required, and whether the purchase can be transferred.
- Confirm the refund route. Use the policy for the actual checkout and product category; check whether downloading, streaming, or redemption changes eligibility.
- Verify the physical goods. Confirm official licensing, seller identity, included contents, condition, shipping, and returns.
- Review the total commitment. Include shipping and any recurring, in-game, or post-purchase costs, and set spending controls where appropriate.
Rules vary by country and by the terms attached to the specific product. The examples above are U.S.-specific where noted; they do not determine statutory rights in every territory. Recheck the seller’s and issuer’s current terms at checkout.
