That is Ubisoft’s contract language—not a court ruling that players never own games or that every shutdown is lawful. In the dispute over The Crew, purchasers alleged they were misled about what they were buying after Ubisoft shut down the game’s servers. Ubisoft denies the claims, and as of October 8, 2026, no court had ruled on their merits.
What did Ubisoft say about owning a game?
Ubisoft’s current US End User Licence Agreement (EULA), section 2, says Ubisoft or its licensors own the product’s title and intellectual-property rights, including in copies of the product. It states: “This License confers no title or ownership in the Product and should not be construed as a sale of any rights in the Product.”

That wording describes the rights Ubisoft says its agreement grants. It does not by itself resolve how the terms apply to a particular transaction, whether a consumer-protection law limits them, or what rights a buyer has in a physical disc. Nor does a clause in Ubisoft’s EULA establish a universal rule for games sold by other publishers or storefronts.
What happened with The Crew?
The Crew is an online racing game whose servers Ubisoft shut down. Two California purchasers sued after buying physical copies. Their complaint says they understood they were buying the game and expected to be able to play it in the future. Those statements are the plaintiffs’ allegations, not facts a court has found.

The court-authorized settlement notice in Cassell, et al. v. Ubisoft, Inc. (Case No. 25CV014305) describes the central claim as consumers being led to believe they were paying for ownership rights when they received only a limited license to access the game. The notice also describes a claim that purchased Crew Credits expired when the servers shut down. Ubisoft denies the allegations. The notice says the court has not ruled in favor of either side.
Did a court rule that players do not own the games they buy?
No. As of October 8, 2026, there had been no merits ruling resolving the ownership dispute in the The Crew case. The parties had proposed a settlement, but the court-authorized notice scheduled a fairness hearing for November 13, 2026—after that status date. A proposed settlement is not a court finding that Ubisoft’s account of the law is correct, and the scheduled hearing does not mean the settlement had already been approved.

Can Ubisoft shut down a game someone paid for?
The EULA’s license language and the The Crew dispute do not establish a blanket answer for every game. Whether a purchaser can keep using a title after a service ends depends on the product’s design and disclosures, the terms that apply to the purchase, and the consumer laws in the relevant jurisdiction. A game that depends on publisher-operated servers may become inaccessible when those servers close; whether that outcome violates a particular contract or law is a separate question.
A physical disc and a digital storefront purchase can also provide different practical things. A disc is a physical item, but it may still contain software governed by a license and may not be enough to run a game that requires online services. A digital purchase generally provides an account-based entitlement rather than a disc. For either format, relevant questions include:

- What do the EULA and the store’s terms say about access, service termination, and license revocation?
- How clearly were shutdown risks or online dependencies disclosed?
- Does local consumer law provide protections that cannot be waived?
- Is there an offline mode, preservation option, or other way to keep playing if service ends?
What was in the proposed settlement, and can players still claim?
The proposed US settlement covers individuals who purchased The Crew on any platform and/or associated virtual content, including DLC, expansions, or Crew Credits. It excludes people who obtained the game for free through a trial, game sharing, or a subscription reward. The notice set June 11, 2026, as the claim-submission deadline, which had passed by October 8, 2026.

The notice conditioned payments on final approval and resolution of any appeals. It did not establish that the settlement was approved or that payments had been made. Because the claim deadline had passed, someone who had not submitted a claim by June 11 should not assume they can still file; consult the official settlement administrator or current court notice for any later instructions.

No contract clause should be treated as a universal statement of consumer rights. Ubisoft’s US Terms of Use define “Services” broadly, covering games, downloadable content, season passes, online functions, platforms, subscription services, servers, and related software. They also describe final and binding arbitration for disputes that remain after the specified informal dispute-resolution process.

The terms themselves recognize that statutory rights vary by location. They refer, for example, to certain EU remedies when their legal conditions are met and preserve Australian statutory consumer guarantees. Which protections apply depends on jurisdiction and circumstances; a US agreement or US settlement does not answer the question for every country.
California AB 2426 took effect on January 1, 2025. Tom’s Hardware reported that it requires clear disclosure in specified transactions when a consumer receives a license to access digital goods. The report also noted that the The Crew purchases and lawsuit predated the law and that the case produced no ruling on digital ownership. The statute is context for later transactions, not a retroactive resolution of this dispute.
What has Ubisoft said about game shutdowns?
PC Gamer reported that Ubisoft CEO Yves Guillemot addressed the Stop Killing Games campaign at a shareholder meeting. The report quotes him saying services may be discontinued and, “Nothing is eternal,” while describing end-of-life support as a broader issue Ubisoft was working on. Those reported remarks are not a formal legal concession, a promise to preserve any specific game, or a court position.
