Who Owns Video Game Music? A Guide to Soundtrack Rights and Licensing

Video game music has no universal owner. This guide explains the separate rights in compositions and recordings, how composer contracts change ownership, when developers need synchronization and master-use clearances, and how to document a soundtrack’s chain of title.

There is no single owner of “video game music.” Ownership depends on which protected work you mean, who created or acquired it, and what the contracts say. A game soundtrack can involve at least two separate copyrights: the underlying musical work (the composition and any lyrics) and a particular sound recording of that work. A developer may own one, license both, or control neither.

This guide uses U.S. copyright concepts and WIPO’s game-development guidance. Contracts and ownership rules differ by country, so a commercial release with unclear rights should receive advice from a qualified lawyer in the relevant jurisdiction.

The two copyrights inside a soundtrack

The first question is whether you are discussing the music as written or a recording that someone performed and produced. The U.S. Copyright Office states: “A sound recording and the music, lyrics, words, or other content included in the recording are separate copyright-protected works.” Those layers can have different owners and different licensing requirements.

The musical work (composition)

The musical work is the underlying creative expression: melody, harmony, rhythm, arrangement elements protected as part of the composition, and lyrics where applicable. A songwriter, composer, publisher, or another assignee may own it. Several writers can share ownership, and a publisher or administrator may handle licensing without owning every interest.

The sound recording (master)

The sound recording is a particular recorded performance. It includes the captured performances, production and recording elements protected in that recording. The recording owner or another party controlling the master may be different from the composition owner. A license to use a composition does not, by itself, authorize use of an existing master.

Layer What it covers Who may control it Typical game-use question
Musical work The song or score as written, including lyrics when present Composer or songwriter, publisher, assignee, or administrator May the game synchronize this composition to gameplay or a trailer?
Sound recording A specific recorded performance and production Recording owner, label, artist, producer, or another master controller May the game reproduce and synchronize this exact recording?

If you commission a new recording specifically for the game, the composition and the recording may be created under the same project, but they remain distinct rights. Your contract should address both rather than assuming one grant covers the other.

Ownership is not the same as permission

An ownership transfer and a license solve different problems. An assignment transfers specified rights or ownership interests. A license leaves ownership with the composer, publisher, recording owner, or another rightsholder but gives the developer permission to carry out defined uses. The license may be exclusive or nonexclusive and can be limited by time, territory, media, or purpose.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That distinction matters after launch. A developer may have broad permission to place a cue in a particular game while the composer retains the right to use the music elsewhere. Conversely, an assignment may give the developer ownership while still leaving practical questions about a separately owned recording, co-writer interest, or later promotional use. Credit, delivery of audio files, and payment do not resolve those questions.

Who signs is also important. A publisher, administrator, label, or agent may negotiate a deal without owning every interest. The agreement should identify the interest being granted and confirm that the signatory can grant it. If multiple writers or owners hold shares, obtain the approvals or licenses required for all relevant interests.

How a game developer can acquire music rights

Commissioned original score

A composer can write an original score for a game under a work-for-hire arrangement, an assignment, or a license. Payment alone does not identify which arrangement applies. WIPO’s game-development guidance discusses U.S. work-for-hire requirements and emphasizes that the legal effect depends on the applicable rules and the written agreement. If the requirements are not met, the composer may retain ownership even though the developer paid for the work.

An assignment transfers specified rights or ownership interests to the developer. A license instead gives permission to use the music while the composer or another rightsholder retains ownership. A license can be exclusive or nonexclusive and can be limited by time, territory, media, or purpose. The contract must be read to determine which result applies.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Pre-existing composition and recording

Using a song that already exists usually involves two clearances. WIPO describes the composition permission as a synchronization right and the recording permission as a master-use right. The composition side is commonly obtained from the writer, publisher, owner, or administrator. The master side must be cleared with the party controlling the specific recording.

Those permissions are independent. You can have a composition license and still lack permission to use the commercial recording, or have a master deal that does not grant the composition rights needed for the game. Identify the exact song and exact recording before negotiating.

Music-library tracks

A library can simplify discovery and licensing, but it does not eliminate due diligence. Confirm what the library actually controls and whether its license covers the game itself and related uses such as trailers, advertising, downloadable content, streams, or a soundtrack release. A library’s catalog entry may not reveal every contributor or restriction, so keep the agreement and any rights documentation with the project records.

Why several people or companies may appear in the chain of title

One soundtrack cue can involve a composer, co-writers, a publisher, a musical-work administrator, a recording owner, and other participants. Ownership shares may be divided rather than held by one party. U.S. Copyright Office reporting fields distinguish songwriter, publisher, musical-work owner, and ownership shares, illustrating why a developer should request a complete rights picture instead of relying on a single contact’s assertion.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The party negotiating with you may be an administrator or agent rather than the ultimate owner. Ask what interest that party controls and whether additional approvals are required. For a recording, identify the person or company that controls the master you intend to use; a different version of the same song can have a different recording owner.

Do you need both synchronization and master-use rights?

For an existing commercial recording placed in a game, normally yes. Synchronization permission addresses combining the musical work with timed visual or interactive content. Master-use permission addresses the particular recording. The exact terminology and legal requirements can vary by jurisdiction, but the practical U.S. clearance problem remains: two separate copyrighted works are involved.

Planned use Composition clearance Recording clearance Key verification
Original score and recording commissioned for the game Check whether the contract assigns or licenses the composition Check who owns or controls the newly made recording Make sure the agreement addresses both layers
Existing song and its commercial master Usually a synchronization license from the relevant writer, publisher, owner, or administrator Usually a master-use license from the master controller Clear the exact recording, not merely the song title
Existing composition recorded anew for the game Permission for the underlying composition is still required Negotiate rights in the new recording with its creator or owner Do not assume a new recording removes composition clearance
Library track Review the library’s composition rights and license scope Review the library’s master rights and license scope Check game, promotional, platform, territory, term, and soundtrack permissions

Map every planned exploitation to the grant

A rights review should test the complete release plan, not only the final game build. For each cue, ask whether the written grant covers:

  • Playback in the base game and on every planned platform.
  • Downloadable content, expansions, ports, updates, and demos.
  • Trailers, advertisements, social posts, press materials, and other marketing.
  • Events, livestream-related materials, and promotional presentations.
  • A standalone soundtrack stream, download, physical edition, or inclusion in another product.

These are separate practical questions because a grant negotiated for in-game use may not clearly authorize a trailer or an album. If the release plan changes, obtain an amendment or additional clearance before distributing the new material. Keep the approved scope attached to the cue record so production, marketing, and publishing teams are working from the same terms.

Contract terms that determine who owns or may use the music

Ownership and permission are determined by the actual agreement and applicable law, not by informal descriptions such as “commissioned,” “bought,” or “made for the game.” When reviewing a composer, publisher, label, or library contract, locate the operative grant and identify whether it is an assignment, a work-for-hire arrangement, or a license.

Define the project and distribution

State the game covered by the grant, including the title or a clearly defined project description. List the platforms and territories, and state the duration. If a release may expand to additional platforms or regions, address that prospect instead of leaving it implicit.

Cover uses outside the base game

WIPO’s discussion of exploitation beyond the game makes this a practical issue. Specify whether the grant includes downloadable content, expansions, trailers, advertisements, social posts, demos, events, livestream-related materials, or other marketing. A permission negotiated only for in-game playback may not clearly cover every promotional use.

Address soundtrack and other releases

If you plan to issue a soundtrack album, stream music separately, sell a physical edition, or provide music in another product, say so in the grant. A game-use license should not be treated as automatic permission for a standalone soundtrack release.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Record exclusivity and retained uses

Identify whether the grant is exclusive or nonexclusive and whether the composer or other rightsholder retains specified uses. Exclusivity, retained rights, and any approval or restriction language can materially change what the developer may do after launch. Exact commercial terms are deal-specific; the important point is to make the scope unambiguous in writing.

A rights-verification workflow for developers

Use this sequence before content lock or commercial distribution. Keep copies of agreements, amendments, invoices, cue sheets, and correspondence that establish the chain of title.

  1. Inventory every cue. Record the title or internal identifier, composer or writers, whether it is original or pre-existing, and whether the build contains a particular recording.
  2. Separate the two layers. For each cue, create distinct entries for the musical work and the sound recording. Do not mark a cue “cleared” until both entries have an identified legal basis where both are involved.
  3. Identify all relevant parties. List writers, publishers, composition owners, administrators, ownership shares, and the party controlling each recording. If shares are divided, document each required approval.
  4. Read the governing agreement. Locate the ownership, assignment, license, exclusivity, and permitted-use language. Confirm that the signatory actually controls the rights being granted.
  5. Match the grant to the release plan. Check the game, platforms, territories, duration, downloadable content, promotional materials, and any soundtrack or other exploitation you intend to distribute.
  6. Resolve gaps before launch. Obtain an amendment, replacement track, or additional clearance when a planned use falls outside the written grant. Do not rely on a verbal assurance for a material release.
  7. Escalate material uncertainty. For a commercial launch, disputed ownership, or an unclear chain of title, have qualified counsel review the documents under the law that governs the transaction.

Questions to ask for every cue

Before approving music, document concise answers to the same questions for each track: What is the exact composition? Who wrote it, and are there co-writers? Which publisher, administrator, or musical-work owner handles each share? Is the build using an existing master or a newly made recording? Who controls that recording? Is the grant an assignment or a license, and is it exclusive? Which game, platforms, territories, and term are covered? Are DLC, trailers, advertising, streams, events, and a soundtrack release included? If any answer is “unclear,” the cue is not ready for final rights sign-off.

Do game composers own their soundtracks?

Sometimes, but not automatically. A composer may own an original score and license it to the developer. The developer may own it if a valid work-for-hire arrangement applies or if the composer assigned the relevant rights. A contract may also divide rights, giving the developer broad game permissions while reserving other uses to the composer.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The fact that the composer was paid, delivered files, or received a credit does not answer the ownership question. Read the agreement and apply the law governing it. If there is no clear written grant, the parties may disagree about what uses were authorized, especially for sequels, downloadable content, advertising, or a standalone soundtrack.

Choosing among a commissioned score, a commercial track, and a library

There is no universally cheapest or safest option. Compare the rights package, not only the creative or production fee. Licensing prices and other commercial terms are deal-specific, so a catalog price or composer fee should never be treated as proof that all needed rights are included.

Option Rights work to verify Advantages Typical risk if scope is unclear
Commissioned original score Composition ownership or license; ownership or control of the resulting recordings; work-for-hire or assignment requirements Music can be tailored to the game and negotiated from the start Assuming payment transfers ownership or failing to cover later uses
Pre-existing commercial track Separate composition and master clearances; exact recording identity Recognizable performance and established artistic identity One clearance is obtained while the other remains missing, or the term and territory are too narrow
Music-library track What the library controls; game and promotional permissions; term, territory, platform, and soundtrack scope Catalog access and a standardized licensing route The catalog license excludes a planned use or does not cover every contributor’s rights

Common mistakes and how to correct them

“We paid for it, so we own it.”

Corrective action: find the written ownership or license clause and verify that it satisfies the governing law. If it does not grant the needed rights, negotiate a written assignment or expanded license.

“The song is cleared, so the recording is cleared.”

Corrective action: create separate composition and master entries and obtain permission from each relevant controller.

Geography and legal limits

The framework above is grounded in U.S. copyright guidance and WIPO’s developer-oriented discussion. Copyright ownership, moral rights, collecting practices, and licensing terminology can differ elsewhere. A contract may also select a governing law that is different from the country where the game is developed or sold.

For that reason, treat this article as a rights-identification guide rather than a legal opinion on a particular soundtrack. The decisive documents are the agreements, the chain of title, and the law that applies to them.

Frequently Asked Questions

Who owns music written specifically for a video game?

The contract and applicable law decide. The composer may retain ownership and license the score, or the developer may receive ownership through a valid work-for-hire arrangement or assignment. Payment alone is not decisive.

Do I need both synchronization and master-use rights?

Usually, when an existing commercial recording is placed in a game. Synchronization permission covers the musical work; master-use permission covers that particular recording. Clear each layer separately.

Can I use a song if I obtained permission from its publisher?

Not necessarily. Publisher permission may address the composition, while the recording is controlled by a label, artist, producer, or another master owner. Confirm whether the exact recording also has a clearance.

Does commissioning a new recording eliminate music licensing?

No. Permission for the underlying composition is still needed if the composition is pre-existing, and the new recording has its own ownership or license terms.

Does a game-use license cover trailers and a soundtrack album?

Only if the written grant covers those uses. Review DLC, advertising, social posts, events, streams, and standalone soundtrack distribution separately rather than assuming they are included.

How much does video-game music licensing cost?

There is no universal price established here. Fees and other commercial terms are deal-specific; compare the complete rights package and scope, not just a quoted production or catalog fee.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What should a music library license prove?

It should identify what the library controls and authorize the planned game, platform, territory, term, promotional, DLC, and soundtrack uses. Keep the agreement and supporting rights documentation.

What if several writers or owners share a cue?

Document each writer, publisher, administrator, musical-work owner, ownership share, and recording controller. Obtain every approval or license required by the applicable agreements and law.

Does a credit prove that the developer owns the music?

No. Credit, delivery of files, and payment do not establish ownership. Read the operative assignment, work-for-hire, or license language.

Can the same song title represent different rights?

Yes. Different live, remastered, cover, or alternate recordings can have different master owners. Identify the precise recording in the game build.

The Bottom Line

There is no universal owner of video game music. Separate the composition from the sound recording, trace every writer, publisher, owner, administrator, and master controller, and read the actual assignment, work-for-hire, or license. Before launch, match the written grant to the game, platforms, territories, term, DLC, marketing, and soundtrack plans. If ownership or scope remains unclear, replace the track or obtain qualified legal review.
