Borderlands players were shown Take-Two’s unified Terms of Service in 2025 after Gearbox moved away from its existing terms. 2K says the agreement was published on February 28, and that players returning after a March 28 update could be asked to review and accept it. The “already existed” part is harder to establish: an older Borderlands 2 manual says the license could be updated, but it does not show whether each clause criticized in 2025 was already in the earlier agreement.
What changed for Borderlands players in 2025?
2K Support said Gearbox was migrating from its existing Terms of Service and EULA to Take-Two’s single Terms of Service because Gearbox had become part of 2K, a Take-Two company. The unified terms were published on February 28, 2025. According to the same FAQ, players who had not opened a game since its March 28, 2025 update could be prompted to review and accept them. 2K Support’s partnership FAQ and the Borderlands 2 Steam EULA page document the rollout.
That establishes a change in the agreement presented to players. It does not, by itself, establish that every disputed clause was newly added in 2025.
Did the disputed terms already exist?
The Borderlands 2 PC manual says the license may be updated from time to time and points players to Take-Two’s EULA site for the current version. That is evidence that the license was updateable; it is not a copy of the old Gearbox agreement or a clause-by-clause comparison with the February 2025 Take-Two terms.

So the available historical document cannot settle whether a particular privacy, data-use, or other clause was already present or was added later. PC Gamer also cautioned against treating the clauses discussed during the controversy as evidence that Gearbox or Take-Two had newly targeted harmless mods. PC Gamer’s 2025 report is contemporaneous coverage, not a substitute for comparing complete versions of the agreements.
Why did Borderlands games receive negative Steam reviews?
Reports tied the review activity to players’ objections to the new terms and related concerns about privacy and modding. PC Gamer reported that negative reviews mentioning EULA changes clustered around the release of a video and later subsided. GamesRadar reported that the series-wide activity began May 19, 2025, and covered Gearbox’s response 19 days later. Gearbox’s response to spyware claims
In a statement reported by GamesRadar, Gearbox said: “Take-Two does not use spyware.” That is the company’s assertion, not an independent technical audit. GamesRadar summarized Gearbox’s explanation that a privacy policy can list possible data activities without every activity being used in every game or service. It also reported the company’s position that it does not seek action against single-player, non-commercial mods that respect its intellectual property. GamesRadar+’s account of the response.

Steam distinguishes criticism of a game from review activity it considers unrelated to the product or service. Valve defines a review bomb as a large number of players using reviews to express unhappiness, lower a score, and provoke a response. Its guidance says Steam may remove an abnormal period from the overall score when that activity is unrelated to the product or service. At the same time, Steam’s FAQ recognizes that reviews can address business practices and the community experience, so criticism of a publisher’s terms is not automatically invalid. Steam’s Borderlands 2 store page currently carries a notice that the product has experienced one or more periods of off-topic review activity. That is a platform label about past activity, not a finding that every complaint was illegitimate. Steam’s Borderlands 2 listing. Review counts and ratings change over time, so a current score should be checked on the page rather than inferred from coverage of the 2025 event.

What can be concluded—and what cannot?
- Confirmed: Gearbox moved from its existing terms to Take-Two’s unified agreement, published February 28, 2025; some returning players could be prompted to accept it after the March 28 update.
- Not established by the cited historical record: Whether each clause criticized in 2025 was new or had appeared in the earlier Gearbox terms. The old manual’s update language does not answer that question.
- Reported, not universal: News coverage associated the review surge with terms-related objections, but it does not establish every reviewer’s reason.
- Attributed company position: Gearbox denied using spyware; that statement should not be presented as an independent technical finding.
