Why Do You Have to Be 18 to Trade GameStop Stock?

The usual age limit for opening a brokerage account is about account agreements and legal capacity—not a special GameStop rule. A custodial account may offer a route for a minor, with an adult in control.

You generally need to be 18 to open and control your own brokerage account because doing so involves signing an account agreement. That age threshold is not a GameStop rule: it relates to brokerage eligibility and legal capacity to enter a contract, which is generally governed by state law. A minor may be able to invest through an adult-managed custodial account, but the adult—not the minor—controls it until the applicable transfer age.

Why is 18 the usual threshold?

Buying GameStop shares means buying a security through a brokerage account or another applicable shareholding route. Opening an ordinary brokerage account requires an agreement that sets out the account holder’s legal rights and responsibilities. The SEC says investors must sign a new account agreement when they open an account and advises them to read it carefully: SEC: Opening a Brokerage Account.

Federal securities law does not set one blanket rule that says every person under 18 is prohibited from owning shares. A Federal Register publication explains that capacity to enter contracts, including brokerage-account contracts, is generally a matter of state law: Federal Register, September 1, 2021. Brokerage firms also set their own account eligibility terms, so the exact requirements depend on the firm and account type.

Can a minor buy GameStop stock?

Possibly, through an account designed for a minor and administered by an adult. A common route is a UGMA or UTMA custodial account, if available through the chosen brokerage. The adult custodian manages the account; the property belongs to the minor and must be used for the minor’s benefit. FINRA explains that custodial assets transfer to the child at the age of majority applicable under state law: FINRA: Ways to Invest for Children.

This arrangement does not give the minor independent control of an ordinary brokerage account. The custodian makes account decisions and controls withdrawals until the transfer age. FINRA says UGMA/UTMA custodial accounts have no contribution limits or withdrawal penalties, but funds must be used solely for the minor’s benefit. Tax and investment implications can vary with account type and residency, so families should check the details before opening one.

What are the practical options?

Wait and open an individual brokerage account The eligible individual opens and controls the account under the brokerage’s terms. Minimum age, account agreement, and whether the account is cash or margin.
Ask about a UGMA/UTMA custodial account The minor is the beneficiary of the property; an adult custodian manages it until the state-specific transfer age. Whether the brokerage offers the account, the applicable state rules, and tax and investment implications.
An adult invests through an account in the adult’s own name The account and its assets belong to the adult, who makes the decisions. Do not treat this as the minor independently trading; clarify ownership and expectations within the family.

Why not just use a parent’s brokerage login?

An adult’s personal account is not the same as a custodial account. Giving a minor access to an adult’s login does not change who owns or controls that account, and it may conflict with the brokerage’s terms. If the goal is to invest for a child, ask the firm whether it offers a custodial account and review the account agreement instead of trying to bypass its eligibility rules.

Check the account terms before buying

  • Ask the brokerage which account types it offers for minors and who may place trades or authorize withdrawals.
  • Confirm the state-specific age when custodial assets transfer to the child.
  • Read the account agreement. Account authority and other terms determine who can make decisions.
  • Understand whether the account is cash or margin. Margin means borrowing from the brokerage and can create losses or repayment obligations; it is not required simply to buy GameStop shares.
