Those are Nintendo’s stated commercial and stewardship reasons, not proof that every takedown is legally required or that every fan use infringes a right.
Nintendo’s two-part explanation
Nintendo describes protection as both an enforcement job and a character-management job. Its Intellectual Property & Piracy FAQ says the company targets unauthorized copies of games, circumvention devices or software, and counterfeit products. Nintendo says this work protects creators’ substantial effort, preserves legitimate game sales, and sustains the industry’s ability to invest in new games.

That economic argument is only half the explanation. In its September 16, 2020 Nintendo IP Expansion Philosophy, Nintendo says a character should be expanded in a way that fits that property’s individual appeal. The company links that approach to the personal attachment players develop through interactive games. It wants more people to encounter its worlds, but not at the cost of confusing a character’s identity, weakening audience attachment, or introducing traits that could limit future game development.

In other words, Nintendo is not treating every appearance of a character as interchangeable advertising. It is trying to control where the character appears, what the character represents, and whether the surrounding experience leads people back to Nintendo games and dedicated platforms.

What Nintendo means by intellectual property
“Nintendo’s intellectual property” is not one single right. The company’s FAQ separates several legal tools, each aimed at a different part of a product or brand.
| Right | What Nintendo says it can cover | Why the distinction matters |
|---|---|---|
| Copyright | Expressive material such as game characters, visuals, music, software, packaging, manuals, and artwork | It addresses creative expression rather than every idea or commercial identifier |
| Trademark | Names, symbols, and designs that identify the source of products | It helps prevent consumers from mistaking an unofficial product for an official one |
| Patent | Inventions | It protects the qualifying technical invention, not automatically every artistic element around it |
| Design right | Product appearance, including accessory shapes | It concerns visual design features of a product |
That is why calling every dispute a “copyright issue” can mislead. A copied game soundtrack, a confusingly similar logo, a console accessory’s shape, and software that bypasses a security measure can involve different rights or legal theories. The applicable rules also vary by country. Nintendo says it operates IP Enforcement programs in more than 40 countries, using legal enforcement, consumer awareness, technology, and efforts to improve IP legislation; its undated FAQ does not provide a country-by-country list or a publication year for that figure.
Why unauthorized copies and circumvention matter to Nintendo
Protecting the work behind a game
Nintendo’s FAQ presents a game as the result of substantial creative and technical work. Unauthorized copies let someone distribute or use that work without the permission that normally supports its sale. Circumvention devices or software can remove technical controls and make unauthorized copying or use easier. Counterfeit products create a similar problem in physical form by presenting an imitation as if it came through Nintendo’s legitimate channels.

Nintendo says the immediate objective is to protect creators and legitimate sales. It also connects those sales to future investment: the company says game development can take several years and cost substantial amounts, although the FAQ gives no numerical development-cost estimate. The stated logic is therefore about maintaining a revenue system for continued development, not a claim that Nintendo has measured a specific amount of piracy loss in the FAQ.
Why enforcement can look broad online
A single unauthorized upload can be copied, mirrored, or embedded elsewhere quickly. Nintendo’s stated program combines legal action with consumer education and technology, so a notice or removal request may be one part of a broader effort to stop distribution and reduce confusion about what is official. The existence of an enforcement action does not, by itself, establish that every disputed use is unlawful; the FAQ explains Nintendo’s policy and rationale rather than adjudicating individual cases.
Why character identity is treated as an asset
Nintendo’s 2020 presentation describes characters as the part of an interactive game experience to which people form personal attachment. That attachment has commercial value, but Nintendo also describes it as something that can be damaged by careless expansion. The company says it will expand properties in ways that fit each character’s appeal, take care not to harm the image or attachment consumers have for them, and prioritize quality over exposure for its own sake.

This policy explains why Nintendo may prefer a smaller number of controlled appearances to unlimited licensing. A character’s voice, behavior, visual design, story role, and audience can influence how players understand the entire series. Nintendo says expansion should also avoid unintended character traits that could constrain future game development. A short-term appearance that changes how audiences read a character could make later creative decisions harder.
Exposure is a means, not the goal
Nintendo does want its properties to reach people beyond a single game. Its presentation says the larger aim is to lead people toward the games and Nintendo’s dedicated platforms. That makes external media, products, and other appearances useful when they reinforce the property and create interest in the interactive experiences at its center. Nintendo’s stated standard is not maximum visibility; it is suitable visibility that preserves the property and supports the games.

What Nintendo’s online video policy actually permits
Nintendo’s Game Content Guidelines for Online Video & Image Sharing Platforms, updated September 2, 2024, are a conditional permission for qualifying individual consumers. They are not a general license to use Nintendo characters in any project.
Uses covered by the guidelines
- Individual consumers may post gameplay footage and screenshots from games Nintendo owns, subject to the guidelines.
- Eligible material is limited to officially released game content or official promotional material.
- Nintendo encourages creative input and commentary rather than purely redistributing its material.
- Monetization is allowed only through the methods Nintendo separately specifies in the guidelines.
Nintendo’s opening statement recognizes fans’ desire to express themselves with game content: “We are humbled every day by your loyalty and passion for Nintendo’s games, characters and worlds, and respect that you want to be able to express yourself creatively by sharing your own original videos and images using content from our games.” That invitation is framed by the conditions on the page, so it should not be read as unrestricted permission.
Limits that are easy to miss
- Other commercial monetization of Nintendo’s IP is not permitted under these guidelines.
- The policy is written for individual consumers; corporate entities are outside its scope.
- The guidelines do not grant general permission for fan art, character merchandise, fangames, advertisements, or other uses not covered by gameplay and image sharing.
- For uses outside the policy, Nintendo directs people to applicable law and their own legal counsel.
Consequently, a creator who uploads a commentary video using footage from an officially released game is dealing with a different question from a studio selling a fangame, a clothing company printing a character, or an artist using a character in a commercial commission. The video policy cannot answer those other questions.

Why fan games and fan art can draw attention
Readers often ask why Nintendo “takes down fan games.” Nintendo’s published FAQ identifies unauthorized copies, circumvention tools, and counterfeit products as enforcement targets, while its expansion philosophy emphasizes control over character identity and quality. Those statements explain why an unlicensed project can attract scrutiny, especially when it distributes Nintendo game content, uses Nintendo branding in a way that could confuse buyers, bypasses technical controls, or commercially exploits a character. They do not establish that every noncommercial fan project is automatically unlawful or that every takedown has the same legal basis.
Fan art is likewise outside the specific online gameplay-sharing permission. A drawing made from scratch is not the same use as uploading Nintendo’s game assets, but the absence of coverage in the guidelines is not a blanket authorization. The rights involved, the project’s commercial nature, the jurisdiction, and the way Nintendo’s names and designs are used can all affect the analysis. When a project matters commercially, its creator needs advice based on the applicable law rather than assuming that a fan label supplies permission.
How the policy affects common creator situations
| Situation | What Nintendo’s published material establishes | Practical reading |
|---|---|---|
| Gameplay video with commentary | Potentially covered for an individual consumer when it uses officially released game content and follows the guidelines | Check the current permitted monetization methods and add original commentary or creative input |
| Screenshot post | Potentially covered under the same individual-consumer policy | Stay within officially released or official promotional material and the policy’s other conditions |
| Corporate channel or brand campaign | Corporate entities are outside the individual-consumer guidelines | Do not assume the consumer policy grants permission; obtain separate advice or authorization |
| Fangame | Not granted permission by the gameplay-sharing guidelines | Assess copied assets, branding, distribution, monetization, and local law separately |
| Fan art or character merchandise | Not covered by the gameplay-sharing guidelines | Do not treat the video policy as a character-use license |
Licensed merchandise and the official seal
Nintendo’s consumer support page on Licensed and Unlicensed Nintendo Products gives shoppers a practical verification step. Nintendo says licensed gaming accessories, peripherals, toys, apparel, and other merchandise display its Official Nintendo Licensed Product Seal.
The seal is not merely decorative. Nintendo says licensed products have gone through its testing and evaluation process, while unlicensed products may not work or may have compatibility problems. A listing that uses a Nintendo character image is not automatically authorized. For official Nintendo character merchandise, inspect the product and packaging for the seal and treat a missing seal as a reason to verify the seller and product details rather than as evidence of approval.
A careful way to evaluate a Nintendo-character use
- Identify the material. Is it gameplay footage, a screenshot, original artwork, a copied game asset, a logo, a product shape, or a physical item? Different rights can apply.
- Identify who is publishing it. The 2024 online guidelines address individual consumers, not corporate entities.
- Check whether the material is officially released. The gameplay policy limits eligible content to officially released game content or official promotional material.
- Check the purpose. Commentary and creative input fit the policy’s stated direction; commercial merchandise, advertising, and a sold fangame are different uses.
- Check monetization. Only the methods Nintendo specifies are allowed under the online guidelines; other commercial monetization is not permitted there.
- Check branding and consumer confusion. Names, symbols, and designs can function as trademarks, so avoid presenting an unofficial product as Nintendo-approved.
- Check the jurisdiction and get advice when necessary. Nintendo operates enforcement programs in more than 40 countries, and exceptions or defenses can differ by location. The guidelines themselves direct users to applicable law and their own legal counsel for questions outside the policy.
What Nintendo’s approach means for players and creators
For players, close control is intended to make the source of a product clearer and to reduce the chance of buying a counterfeit accessory or game. For creators, it means Nintendo’s permission is highly use-specific: a policy that accommodates an individual’s gameplay commentary does not automatically cover a commercial video, a fan-made game, a character illustration, or merchandise.
For Nintendo, the approach ties present decisions to the future of a character. The company says it wants quality-controlled expansion that builds interest in games and platforms without eroding the attachment players already have. That is why its public explanation combines anti-piracy enforcement, distinct forms of IP protection, conditional content-sharing rules, and licensed-product verification rather than relying on a single blanket rule.
