Yes, Nintendo’s North American Switch 2 User Agreement says the company may render the console and/or its software “permanently unusable in whole or in part” if users fail to comply with specified restrictions. It also warns that unauthorized modifications or devices may cause that result after software updates or changes. The agreement describes possible consequences; it does not say every detected modification automatically bricks a console.
What the Switch 2 agreement says
Nintendo of America’s North American Nintendo Switch 2 User Agreement has an effective date of September 2026. It covers the console and accessories, as well as software and content supplied with or compatible with it. The agreement grants a non-exclusive, revocable license to use the software on the console for personal, non-commercial use.
Restrictions in Section 1
The agreement restricts copying or modifying software, bypassing console or software protections, and using hardware or software to enable unauthorized, illegal, or pirated software or hardware. It also bars installing software Nintendo identifies as an unauthorized copy or using software outside its documented intended use. Nintendo says content obtained using an unauthorized device or modification may be removed.
Section 1 then states: “You acknowledge that if you fail to comply with the foregoing restrictions Nintendo may render the Console and/or the Software permanently unusable in whole or in part.” The clause refers to failure to comply with the listed restrictions; it does not say that every instance of detecting a modification triggers the same result.

Warnings tied to updates
Section 2 says updates may happen automatically and warns that, after software is updated or changed, existing or future unauthorized modifications or devices may render the console and/or software permanently unusable in whole or in part. The agreement identifies a possible consequence, but does not explain a specific detection process or how often Nintendo applies this measure.
Does detection automatically brick a Switch 2?
No automatic rule is established by the agreement. Section 5 says that if Nintendo, in its sole discretion, determines or reasonably suspects that a user violated the agreement or Community Guidelines, it may implement technical measures designed to disable access to or use of some or all software or the console. That is distinct from the clauses describing permanent unusability: the agreement reserves possible measures, but does not establish that every suspected or detected violation results in a permanent hardware brick.

The agreement also provides no statistic for how frequently Nintendo disables consoles or renders them permanently unusable. Its wording establishes contractual terms, not enforcement frequency.
How this compares with the original Switch agreement
The update-related warning is not entirely new. Nintendo’s North American agreement for Switch, Switch Lite, and Switch OLED already warned that an unauthorized modification or device could render the console and/or software permanently unusable after a console update.

The Switch 2 agreement adds more detailed restrictions in its software-license section and expressly uses the phrase “in whole or in part.” The earlier agreement supports comparison on the update warning; it does not justify saying all permanent-unusability language first appeared in 2026.

This is Nintendo’s North American agreement, which identifies Nintendo of America Inc. as the contracting company. Its language should not be treated as a universal description of Nintendo’s terms in every country. The agreement includes arbitration and class-action provisions subject to stated jurisdictional exceptions and applicable law, and notes that certain warranty or liability limitations may not apply where law restricts them. The text alone is not a jurisdiction-by-jurisdiction ruling on whether any clause is enforceable.
