Yes—but only temporarily. On March 16, 2026, Delaware’s Court of Chancery reinstated Unknown Worlds CEO Edward “Ted” Gill and restored his contractual operational authority over Subnautica 2’s Early Access launch. Krafton and the former executives settled on July 1, and reporting said Gill agreed to leave. Unknown Worlds continued leading development with Krafton’s support, so the March ruling does not describe the later leadership arrangement.
What the court ordered in March 2026
In Fortis Advisors LLC v. Krafton, Inc., the Delaware Court of Chancery concluded that Krafton breached the Equity Purchase Agreement by terminating key employees without valid Cause and improperly taking operational control of Unknown Worlds. The court reinstated Gill as CEO and restored the contractual authority he held under Section 2.7(f) over the game’s Early Access launch. It also extended his period of operational control by the time he had been wrongfully ousted.
Vice Chancellor Lori W. Will wrote: “Edward Gill is hereby reinstated as CEO of Unknown Worlds, and his period of operational control under Section 2.7(f) of the EPA will be extended by the time that elapsed between his wrongful termination and his restoration.” Read the March 16, 2026 opinion.
Operational control did not mean board control
The ruling did not restore the former executives to board seats. Krafton remained Unknown Worlds’ sole stockholder and retained the right to elect directors. The court instead found the July 1, 2025 board resolution ineffective to the extent it infringed on Gill’s contractual rights, and barred Krafton from using board or other corporate powers to circumvent Section 2.7(f) or impede his launch decisions. Krafton also had to restore access Gill needed to exercise that authority, including Steam publishing access.

The court also adjusted the earnout period
The opinion extended the base earnout Testing Period by 258 days, moving its deadline from December 31, 2025, to September 15, 2026. Fortis retained a contractual option to extend the period to March 15, 2027, by written notice under the agreement. At the time of the opinion, remaining questions about alleged earnout interference and possible damages were assigned to Phase Two.
What changed after the legal win
On July 1, 2026, Krafton and the former executives settled and withdrew all pending legal proceedings. Yonhap quoted a company official saying, “Unknown Worlds will continue leading development, with Krafton providing support for the success of the game.” That settlement, rather than the March court remedy, is the relevant guide to the later leadership arrangement. Yonhap’s July 1 report and Game Developer’s report said Gill mutually agreed to leave and that the companies planned to seek a new CEO from outside both organizations. Those reports describe the transition; they do not establish every term of a publicly reviewed settlement agreement.
Who controls Subnautica 2 now?
Following the settlement, Unknown Worlds continued to lead development while Krafton provided support. Gill’s return as CEO was a court-ordered remedy in March, not evidence that he remains CEO after the July settlement. The distinction matters: the court protected his contractual operational authority during the period covered by its ruling, but it did not transfer Krafton’s stock ownership or director-election rights to the former executives.

Yes. Unknown Worlds’ official update listings show Early Access releases and hotfixes through summer 2026, including a “Buddy System” update dated August 19, 2026. The developer also lists an Experimental branch release for Steam and Xbox dated August 12, 2026.
