Whether making or using a homemade amiibo is legal depends on the country and the facts, including what was copied and whether it is sold or shared. Nintendo’s published policies address its intellectual property, counterfeits and certain circumvention products, but they do not specifically decide the legality of every privately made NFC tag.
What counts as a homemade amiibo?
Nintendo describes amiibo figures and cards as products that interact with compatible games and systems. Its instruction booklet explains: “You can use amiibo by tapping the NFC touchpoint on a compatible Nintendo system or accessory.” That describes how amiibo are used; it does not establish that a particular blank card can copy amiibo data, that it is compatible, or that copying is authorized. The phrase “homemade amiibo” can refer to different things: a physical craft inspired by a character, an NFC tag containing copied data, or a product made for sale. Those differences matter. A handmade figure made from original materials is not the same conduct as reproducing Nintendo artwork or copying data from an official product.
What Nintendo’s published policies do—and do not—say
Nintendo identifies amiibo as a Nintendo trademark and says copyright can protect works such as software, game displays, characters, packaging, artwork, publications and manuals. Its U.S. Intellectual Property & Piracy FAQ also condemns online piracy and counterfeiting of Nintendo video-game products. Nintendo UK describes circumvention products as devices or software that bypass Nintendo security measures to enable unauthorized copying, modification or play of game files. Its page says importing, marketing, selling or distributing such products is illegal, and that using them with unauthorized copies is unlawful. The page does not specifically classify homemade amiibo tags, so it should not be treated as a definitive answer about every NFC tag. See Nintendo UK’s circumvention-products guidance.
The U.S. Copyright Office describes exclusive rights and remedies for protected designs, but its material does not determine whether a particular homemade amiibo infringes a design—or settle separate trademark or anti-circumvention questions. See Chapter 13 of Circular 92.

Why the answer depends on what you do
These distinctions help frame the issue, but none is a formula that settles legality. The answer depends on the applicable law and the specific facts.
- Private use or distribution: Making or using something privately raises different questions from selling, marketing, importing or distributing it. Commercial activity can bring additional legal and enforcement concerns.
- Original craft or copied material: An original physical creation differs from reproducing Nintendo data, characters, logos or artwork. The relevant rights and legal analysis may differ too.
- Country or region: Copyright, trademark and circumvention rules vary by jurisdiction. Nintendo’s U.S. FAQ and UK guidance describe positions and rules in their respective contexts; neither supplies a universal rule.
- Policy or legal decision: A company’s published policy explains its position and enforcement priorities. It is not the same as a statute or a court decision applying law to your exact facts.
What to do if you want to avoid uncertainty
If you want to use amiibo features without relying on copied data or a homemade tag, consider official amiibo figures or cards and check whether they work with your game and system. Nintendo’s amiibo information describes compatible use, while its licensed and unlicensed products page explains that licensed gaming accessories and peripherals display the Official Nintendo Licensed Product Seal. A seal is a way to identify licensed accessories; it is not a ruling about homemade items.
