Are Loot Boxes Gambling? What Players and Parents Should Know

Whether a loot box counts as gambling depends on the country and whether its random rewards can be cashed out or carry value beyond the game. Here’s what players and parents should check.

Are loot boxes gambling? There is no universal answer: it depends on the country and how the game’s rewards work. In the UK, an ordinary loot box with prizes usable only in the game and no cash-out is generally not treated as licensable gambling under the government’s stated position, reiterated in February 2026. That legal distinction does not establish that the mechanic is harmless, and it may not apply when rewards can be traded or turned into money’s worth.

What counts as a loot box?

A loot box is a game feature that gives a player an apparently randomized item or reward. The player may earn access through play or acquire it with in-game items, virtual currency or real money. A reward might be cosmetic, such as a character appearance, or affect gameplay. The details vary: some mechanics involve a paid purchase, while others offer randomized rewards without requiring payment.

“Loot box” is an everyday label, not the only term used for these systems. The Entertainment Software Rating Board (ESRB) uses the notice “In-Game Purchases (Includes Random Items)” for games with paid randomized goods. Its examples include loot boxes, gacha, item or card packs, and prize wheels. The notice identifies a purchase mechanic; it is not a legal ruling that the feature is gambling.

To understand a particular feature, look past its name and ask what the player gives up, what is known before the transaction, and what can be done with the reward afterward. Those facts matter both to a player deciding whether to buy and to a regulator assessing whether gambling law applies.

Why the legal answer depends on the country and the reward

Gambling laws are jurisdiction-specific. A randomized purchase is not automatically legally classified as gambling everywhere, and a ruling about one game or country should not be generalized to all games or countries. In the UK, the central question identified by the Gambling Commission is whether a chance-based prize is “money or money’s worth.” The Commission has said that items confined to a game and unavailable for cash-out are unlikely to be licensable gambling under its stated approach.

The UK government decided in July 2022 not to extend the Gambling Act to loot boxes at that time. In a parliamentary answer dated 12 February 2026, it reiterated that prizes whose value exists only within a game and cannot be cashed out are not legally classified as gambling, while distinguishing unlicensed skin betting. This is the government’s stated UK position, not a worldwide rule or a guarantee that every mechanic sold as a loot box receives the same treatment.

The practical distinction is what happens to the prize. If an item is usable only in the game, that supports the UK regulator’s in-game-only analysis. If the game operator permits cash-out, or trading and third-party markets give an item monetary value, the legal analysis may change. The mere presence of a random outcome does not settle that question. A suspected skin-betting service or another activity offering cashable prizes should not be assumed to fall under the ordinary in-game-only position.

What the examples from the Netherlands and Belgium show

A 2024–2025 answer from the Government of the Netherlands describes the Dutch Council of State’s March 2022 ruling: obtaining and opening FIFA 19 loot boxes and later versions did not constitute a standalone game of chance requiring a licence under the Dutch definition. The same answer says Dutch and Belgian gambling definitions differ. It is not evidence of a universal European rule or a blanket Dutch ban on loot boxes.

In that same government account, Belgium’s different definition can bring some paid loot boxes within gambling regulation and licensing requirements; offering those without a licence is prohibited. It also says free loot boxes are not prohibited on that basis. This is a summary of the distinction in the Dutch government’s answer, not an exhaustive account of every current Belgian requirement.

Jurisdiction and source date What the cited position says What not to infer
United Kingdom: government position reiterated 12 February 2026; Gambling Commission explanation dated 24 November 2017 Game-only rewards with no cash-out are generally outside licensable gambling under the stated approach; money’s-worth prizes may raise a different question. Do not apply this position automatically to cashable or tradable rewards, skin betting, or another country.
Netherlands: parliamentary answer published 2024–2025, discussing the March 2022 Council of State ruling The cited FIFA 19 and later-version loot boxes were not a standalone game of chance requiring a licence under the Dutch definition. Do not describe this as a universal European ruling or a blanket Dutch prohibition.
Belgium: distinction described in the same Dutch government answer Some paid loot boxes may fall under Belgian gambling regulation and licensing requirements; the answer says free loot boxes are not prohibited on that basis. The answer is not a complete guide to all current Belgian rules.

For another country, check its own current law and regulator statements. A useful comparison asks what the jurisdiction counts as gambling, how it treats prizes usable only in a game, whether tradable or cashable rewards count as monetary value, and how the rules are enforced. A familiar label such as “loot box” cannot answer those questions by itself.

Legal classification is different from consumer safety

A feature can fall outside a country’s gambling-licensing rules and still raise concerns for players or families. The UK government has reported an association between loot-box purchases and problem gambling, but says the evidence has not established that buying loot boxes causes problem gambling. The House of Commons Library repeated that qualification in its 13 August 2024 briefing. Association is not proof of cause: the reported relationship should not be presented as evidence that loot boxes themselves cause gambling problems.

That distinction matters when weighing the risks. Legal status answers a narrower question about the relevant law and the way a reward works. It does not tell a parent whether a particular purchase flow is suitable for a child, whether a player understands the odds, or whether a spending limit is appropriate. In the words of Tim Miller, Executive Director of the UK Gambling Commission: “However, many parents are not interested in whether an activity meets a legal definition of ‘gambling’.” The practical question for a family can therefore be broader than the legal one.

What the available figures do—and do not—tell us

Two figures in the UK government’s 2022 response provide context, but they describe different, dated measures rather than current prevalence across all games and players.

  • 2.5% of PEGI-rated games from August 2020 to May 2022 carried the “in-game purchases (includes random items)” descriptor, according to the Department for Digital, Culture, Media and Sport (DCMS). This is a share of PEGI-rated games in that period, not a count of all games or a present-day estimate.
  • 7% of players had paid for a loot box over the 12 months ending December 2020, according to an Ipsos Mori survey commissioned by an industry trade association, as described in the DCMS response. The government reported the survey result; it was not a government-conducted survey.

DCMS also cautioned that its own player survey was not representative of the UK gaming population. Respondent percentages from that survey should not be treated as population estimates. These figures cannot establish how common paid random-item mechanics are now, how many players currently buy them, or whether a purchase causes later harm.

How players and parents can check a game before spending

Before downloading a game, allowing a child to play, or buying a randomized item, inspect the disclosures and the purchase flow. No single label answers every question, so use the following checks together.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Read the rating and purchase notices. In an ESRB-rated game, look for “In-Game Purchases (Includes Random Items),” which flags paid randomized goods. In a PEGI-rated game, look for “in-game purchases: includes random items.” The UK government’s 2022 response notes that this PEGI purchase descriptor is not itself tied to a specific PEGI age rating. Neither notice by itself determines whether a feature is legally gambling.
  2. Find out whether payment is required. Check whether the randomized reward is bought with real money, paid-for virtual currency, an item the player already owns, or something earned through play. A virtual-currency price can make the real spending route less obvious, so check what the currency costs and whether the game also grants it through play. The legal and practical questions differ depending on whether money must be spent, but payment alone does not resolve the legal classification.
  3. Check what is revealed before purchase. Does the player know the exact item in advance, or only the category of possible rewards? Look for probability information and for an explanation of how those probabilities are determined. UK government guidance calls for clear odds disclosures and transparent information so players can make informed choices; do not assume that an understandable disclosure is present just because a purchase notice appears.
  4. Work out what the reward does. Note whether an item is cosmetic or affects gameplay. This helps families judge the consequences of a purchase and compare mechanics, even though that fact alone does not settle whether gambling law applies.
  5. Trace whether the item has value outside the game. Check whether the operator allows cash-out, whether the item can be transferred or traded, and whether a third-party market or betting service is involved. These are especially important questions where an item appears to have monetary value. The UK in-game-only position should not be treated as automatically covering cashable rewards.
  6. Review spending controls before play. Check the platform and game-account settings available for the child’s account. UK guidance calls for parental consent or knowledge before a person under 18 acquires a paid loot box, uptake of parental controls, and default £0 spending limits on child accounts as best practice. These are calls and industry commitments in the guidance, not proof that every platform or game has implemented them. Confirm the actual settings on the account being used.
  7. Know the refund route. Find the platform’s or publisher’s process for requesting a refund if an unwanted purchase occurs. UK guidance calls for fair and lenient refund policies as a backstop while acknowledging that controls may not always prevent an unauthorized purchase. The existence of a recommended policy does not guarantee a particular request will be accepted.

How to compare two games or purchase mechanics

When deciding which mechanic presents more concern or is easier to understand, compare the same features rather than relying on a game’s marketing term. A short checklist can make the differences visible:

  • Is real payment required, or can the reward be earned through play?
  • Does the buyer know the exact item before paying?
  • Are probabilities disclosed, and is their basis explained?
  • Is the reward cosmetic or does it affect gameplay?
  • Can players transfer, trade, sell, or cash out the reward?
  • What purchase controls are actually available for a child’s account?

These axes serve different purposes. The ESRB notice helps identify paid random-item purchases. The UK gambling-law sources focus on whether the prize is money or money’s worth, including whether it can be cashed out. An item’s gameplay impact may be relevant to a family’s decision without answering the legal test. Keeping those questions separate avoids treating a rating notice, a probability disclosure, or the word “cosmetic” as a complete safety or legal assessment.

If a child makes an unwanted purchase

Start with the account and transaction involved: identify which platform or publisher processed the purchase, review the available purchase history, and use that provider’s refund process. Then check the account’s parental and spending controls and adjust the settings that are available. The UK government’s guidance treats refunds as a backstop, not a substitute for controls, and recognizes that controls can fail to prevent an unauthorized transaction. Do not assume a refund is automatic or guaranteed.

If the purchase involved a service that accepts bets or offers cashable prizes, treat it as a different issue from an ordinary game-only reward. The UK Gambling Commission distinguishes skin betting and says it can act where gambling law applies. For concerns about a specific service, the relevant country’s regulator is a more appropriate source than a general statement about loot boxes.

What to remember when deciding whether a loot box is gambling

Start with the jurisdiction, then examine the actual reward and its route to value. Under the UK position reiterated in February 2026, an ordinary non-cashable item usable only in its game is generally not legally classified as gambling; cash-out or money’s-worth features can change the analysis. The Netherlands and Belgium examples show that differing national definitions can produce different treatment. Separately, the UK government reports an association with problem gambling but has not established causation. For a player or parent, check the purchase disclosure, odds, account controls, and what can be done with the item before deciding whether to spend.
