The documented case was an opposition Atari filed against Andrew N. Greenberg in 2011; the Trademark Trial and Appeal Board (TTAB) sustained it in 2016, and the proceeding is closed.
Is there a new Atari trademark hearing this week?
The available official records do not establish a new 2026 hearing. A Freedom251 article updated May 22, 2026, says the matter is expected before regulators “this week,” but it does not identify a new proceeding, opposing party, docket number, or hearing notice. The official case record located concerns a dispute that ended in 2016. That record does not rule out a separate, unindexed matter; a new official filing or hearing notice would be needed to confirm one.
What happened in the documented case?
Atari Interactive, Inc. opposed Andrew N. Greenberg’s application for the mark HAUNTED HOUSE TYCOON. The TTAB docket identifies the proceeding as Opposition No. 91202952, filed December 13, 2011. Greenberg sought to register the standard-character mark for “Computer game software” in International Class 9. Atari’s pleaded mark was HAUNTED HOUSE.
The opinion records a hearing on April 21, 2016, and a mailing date of June 2, 2016. The USPTO’s 2016 Official Gazette reports the result as “Opposition Sustained.” In practical terms, the opposition succeeded against Greenberg’s application: the docket lists that application, Serial No. 85268906, as “ABANDONED – AFTER INTER-PARTES DECISION.”

What did the ruling affect—and what did it not affect?
The outcome concerned Greenberg’s application. It should not be described as the cancellation of Atari’s registration: the docket lists Atari’s HAUNTED HOUSE registration, No. 4037222, as “REGISTERED AND RENEWED.” Nor does this single dispute establish that Atari owns every use of the words “haunted house,” or that others are free to use them for any purpose.
The TTAB opinion states, “This Opinion is not a Precedent of the TTAB.” Its result is therefore best understood as the disposition of this particular opposition, not as a universal rule about similar game titles.

What the record says about the case’s status
The TTAB docket marks Opposition No. 91202952 “Terminated,” with a status date of August 31, 2016. An official docket search current through October 6, 2026, continues to show the historical Greenberg opposition, not a new hearing in the materials located. That supports treating this case as closed; it cannot prove that no separate proceeding exists.

Atari’s official product page describes a modern Haunted House game starring Lyn Graves and developed by Orbit Studio. It lists Steam, Nintendo Switch, Xbox, PlayStation, Epic Games Store, and Atari VCS, and names Amazon among select retailers. The game’s existence is separate from the Greenberg opposition and is not evidence of a new trademark dispute.
