Not automatically. An officer saying they will call ICE does not, by itself, prove a crime or legal violation. The key questions are whether the officer used official authority to stop, detain, search, arrest, coerce, or discriminate against someone, and what federal, state, and local rules apply. A threat followed by police action is legally different from words alone.
What matters beyond the threat
Look at what happened next and the circumstances around it: Did the officer block someone from leaving, search them, arrest them, or pressure them to give up a right? Did the officer invoke official power, and was there a legitimate law-enforcement purpose—or evidence of retaliation or discrimination? Those facts can raise constitutional or statutory questions, but the cited authorities do not decide any particular encounter.

The Fourth Amendment protects people in the United States, citizens and noncitizens alike, from unreasonable searches and seizures. In a March 26, 2026 policy statement appearing in a government court filing, the Department of Justice (DOJ) stated: “All individuals, citizens and noncitizens alike, are protected by the Fourth Amendment to the United States Constitution in both their homes and in public.” Whether a particular encounter became a seizure, and whether it was unreasonable, depends on its facts. Threat, detention, and immigration detainer are different things
A verbal threat to contact ICE is not itself an immigration detainer. ICE describes a detainer as a notice to another law-enforcement agency that ICE intends to assume custody of someone already in that agency’s custody. ICE says only its immigration officers and designated 287(g) officers may issue detainers. ICE explains immigration detainers.

Actual police action can raise separate legal issues. In a 1996 opinion, DOJ’s Office of Legal Counsel said state and local police lack recognized authority to stop and detain someone solely on suspicion of civil deportability. The opinion distinguishes suspected criminal violations of immigration law and discusses possible authority in those circumstances, subject to state law. Because the opinion dates to 1996 and state rules vary, it should not be treated as a universal statement of current law. Read the 1996 DOJ opinion.
When an officer’s conduct may implicate federal civil-rights law
An officer can act “under color of law” by using government-given power even while exceeding lawful authority. DOJ explains that a federal criminal prosecution under 18 U.S.C. § 242 requires proof that the officer acted under color of law, willfully deprived someone of a constitutional or statutory right, and did so with the required mental state. DOJ describes willfulness as knowing the conduct was wrong or unlawful and choosing to do it anyway. Those are prosecution elements—not proof that a particular threat meets the standard, and not a guarantee that a private lawsuit is available. DOJ’s explanation of 18 U.S.C. § 242.

State and local rules can add specific limits
Rules are not identical everywhere. For example, New Jersey’s Immigrant Trust Directive says state and local officers may not stop, question, arrest, search, or detain someone solely because of actual or suspected immigration status. That policy is specific to New Jersey; it is not a nationwide rule. For an incident elsewhere, check the current law and department policy where it occurred. Read New Jersey’s directive.
What to do after an incident
- Write down the date, location, officer’s name or badge number, exact words used, and names of witnesses. Note whether there was a stop, detention, search, arrest, or pressure to surrender a right.
- Preserve messages, photographs, or video, and keep copies somewhere safe.
- Consider speaking with a local civil-rights or immigration attorney about the facts and applicable state law.
- For an allegation of criminal civil-rights misconduct by law enforcement, DOJ says a person may contact the FBI or the U.S. Attorney’s Office for the district. See DOJ’s reporting guidance.
