Microsoft licenses digital games under rules that restrict how they can be used, and its Services Agreement bars unauthorized use and circumvention of technological protections. The legal consequences depend on what someone does and where they are; this is not a universal legal ruling.
What Microsoft’s rules say
Microsoft’s Usage Rules for Digital Goods state: “All Digital Goods are licensed, not sold.” The rules limit use to what the applicable terms and usage rules expressly allow. For Xbox One and Xbox Series digital games, they describe user-based and device-based licenses, including home-console rules; they also set out access terms for Game Pass. Those account and device provisions explain how authorized access works—they do not authorize an unauthorized copy. Microsoft’s Usage Rules for Digital Goods
Microsoft’s Services Agreement prohibits circumventing technological protection measures and using Microsoft software or services in unauthorized ways. It also says Microsoft may update Xbox software in ways that prevent access to unauthorized games, apps, or hardware. That means continued access to online services or a modified console should not be assumed, but the agreement does not establish a guaranteed outcome for every user or device. Is downloading or playing a copied Xbox game illegal?
“Pirating” can describe different conduct, including downloading or distributing an unauthorized copy, violating a license, or bypassing access controls. Those are not interchangeable legal questions, and the answer depends on the facts and jurisdiction.

United States
The U.S. Copyright Office says that DMCA Section 1201 generally makes it unlawful to circumvent technological measures used to prevent unauthorized access to copyrighted works, including video games and software. The law also provides for limited exemptions adopted through recurring rulemaking. An exemption for a specific noninfringing use should not be treated as blanket permission to pirate games. Outside the United States
Section 1201 is U.S. law. Readers elsewhere need to check the law that applies in their country; Microsoft’s published terms are not a substitute for jurisdiction-specific legal advice.

How to play an Xbox game through authorized access
- Use an authorized physical disc. Confirm that the edition works with your specific Xbox generation and that the disc is available in your region.
- Buy a licensed digital copy. Check the game’s edition and console compatibility, and use the applicable account and device license rules.
- Use Game Pass if the title is included. Catalogue, plan names, pricing, and regional availability can change, so check the current offering for your location.
For a particular game, compare its availability, total price, disc or digital format, console-generation compatibility, offline needs, and any subscription or account restrictions before choosing an option.
