In this title, “Schedule 1” is understood to mean Schedule I controlled substances, and “mushrooms” means psilocybin mushrooms. In the United States, psilocybin is listed in Schedule I under federal law; Oregon’s regulated psilocybin-services program does not authorize people to grow mushrooms at home. The rules vary by jurisdiction, so this is a federal overview with Oregon as one example—not a guide to every state or country.
What does Schedule I mean for psilocybin mushrooms?
Psilocybin is listed in Schedule I of the federal Controlled Substances Act at 21 U.S.C. § 812. Oregon Health Authority likewise states that psilocybin remains Schedule I under federal law: “Although psilocybin services are now a health and wellness option in Oregon, psilocybin is still a Schedule I substance under the federal Controlled Substances Act (CSA).”

A state program permitting certain services does not change the federal listing. Nor does Oregon’s framework establish a national exception or determine the law in other states, localities, tribal jurisdictions, or countries.
Does Oregon let you grow psilocybin mushrooms at home?
No. Oregon’s Measure 109 created a regulated system for licensed psilocybin products and services, not personal cultivation. The Oregon Department of Revenue says directly that Measure 109 does not allow personal cultivation: Oregon Department of Revenue: Psilocybin.

Oregon law defines “manufacture” of a psilocybin product to include planting, cultivation, growing, harvesting, production, preparation, propagation, compounding, conversion, or processing. The statute regulates covered activity through a licensing system. See ORS Chapter 475A. The existence of licensed production within the program is not permission for an individual to cultivate at home.
What does Oregon’s licensed-services route allow?
Oregon’s program is a state-regulated route to services, distinct from personal growing. Oregon Health Authority says the program implements ORS Chapter 475A and began accepting license applications on January 2, 2023. Its overview is available at Oregon Psilocybin Services.

Under the statute, a client may purchase, possess, and consume a psilocybin product only at a licensed psilocybin service center and under the supervision of a licensed facilitator. That limited access pathway does not extend to taking products home to cultivate or use outside the regulated setting. See ORS Chapter 475A.
How to check the rules where you live
- Check the relevant jurisdiction. Federal status, state law, and local policy are separate questions; Oregon’s rules do not establish what applies elsewhere.
- Use current official sources. Consult the applicable statutes, regulations, and government guidance for your state, territory, tribal jurisdiction, or country.
- Distinguish services from cultivation. A law permitting or regulating a service does not by itself authorize personal growing, possession, or use.
