Maybe—but there is no nationwide rule that makes schools accept or reject AI-generated student portraits. Ask the school or district before submitting one: approval can depend on the purpose of the photo, local image and AI policies, consent and disclosure practices, and how the image was created and handled.
Why the answer depends on the school
An ID photo and a yearbook portrait may serve different purposes. An ID office may require a photo that reliably identifies the student or reflects their current appearance; a yearbook image may also be governed by publication and family-notice practices. The sources available do not establish a national rule specifically approving or banning AI-generated portraits for either use.
Check the current student handbook, ID-photo specifications, yearbook instructions, and district AI policy. If those materials do not answer the question, contact the ID office for an ID portrait or the yearbook adviser for a yearbook submission. Ask about the specific image and use rather than assuming that permission for one covers the other.
What FERPA does—and does not—settle
The U.S. Department of Education explains that a photo or video may be an education record under FERPA when it directly relates to a student and is maintained by a school or a party acting for it. Context matters; the agency lists a photo focused on a specific student, such as an ID photo, as one factor. That guidance concerns privacy classification, not whether a school must accept a synthetic portrait. What to ask before submitting an AI portrait
- Is this type of image accepted for this use? Ask whether AI-generated, retouched, or composite portraits are allowed for an ID, yearbook, or both.
- Must the image show the student’s current appearance? Confirm any likeness rules and technical specifications, such as dimensions, background, or clothing.
- Is disclosure or permission required? Ask whether the school requires disclosure that AI was used or written permission from a parent or guardian.
- Where will the photo appear or be stored? Clarify whether it is for an ID only or may also go in a yearbook, directory, website, or vendor system.
- Was a third-party AI service used? Ask whether that service is approved for student data and what happens to uploaded images, including whether they may be used for other purposes or deleted after generation.
These are questions to clarify local rules, not universal requirements. Policies can differ: for example, Independent School District 761’s AI policy includes privacy protections and restrictions concerning synthetic media, while New York City Public Schools’ guidance describes generative AI as capable of producing images and warns that output can be inaccurate or biased. Consider the vendor and image handling
If a school uses a photography or yearbook vendor, ask how the portrait will be shared and handled. The New York State Education Department says vendors working under contract may perform contracted services subject to requirements for third-party contractors. Local guidance can spell out safeguards such as limits on using student data to train models or deletion rights. School Town of Munster’s AI guidelines provide one local example, not a rule for every district. Review the district’s AI guidelines.
Yearbook publication may involve separate notice and opt-out rules
Ask whether a submitted portrait will appear only in the yearbook or also in other school-community publications. NYC Public Schools says photographs may be treated as directory information for school-community publications, with families notified and given an opportunity to opt out. If the school says no—or has not answered
Do not assume an AI portrait will be accepted just because it looks realistic or meets the image dimensions. Ask what requirement it fails and whether a conventional photo or a less extensively edited portrait would meet the rules. If the school has not clarified its policy, wait for an answer before submitting an image that may be used for identification or publication.
