Yes. Brazil can regulate esports, but the federal rules in place do not amount to a single, comprehensive esports law. The country regulates the electronic-games industry, has a general sports law that defines sport as predominantly physical activity, and has considered bills focused on electronic sport. Those bills were still proposals in the Câmara dos Deputados records reviewed, rather than enacted esports legislation. The legal distinction matters: rules for making and selling games, or for betting on virtual-game events, do not by themselves settle how esports competitions and their participants are governed.
Does Brazil have an esports law?
Brazil has federal laws that affect electronic games, sport and betting, but those are different subjects. Lei 14.852/2024 establishes a framework for the electronic-games industry; Lei 14.597/2023 is the General Sports Law; and Lei 14.790/2023 addresses fixed-odds betting, including bets on virtual-game events. What does Brazil’s electronic-games law regulate?
Lei 14.852/2024 creates a legal framework for the electronic-games industry. Its scope includes the manufacture, import, commercialization, development and commercial use of electronic games. The law says these activities are generally free, subject to the Constitution and other applicable legislation. This is an industry framework, not an esports sports code. Regulating games as products and commercial activities does not, on its own, determine the legal treatment of teams, tournaments, players or competitive organizations.
Is esports considered a sport under Brazilian law?
Lei 14.597/2023, Brazil’s General Sports Law, defines sport as an activity that is predominantly physical, whether informal or organized, and that may aim at recreation, health, high performance or entertainment. Because esports competition is centered on playing electronic games, the “predominantly physical” wording raises a classification question about how the general sports framework applies. What is Brazil’s esports bill?
PL 70/2022 is a Câmara dos Deputados bill concerning the regulation of electronic sports. PL 205/2023, introduced in 2023, is attached to it. A sports committee approved a rapporteur’s report recommending approval of both proposals with a substitute on 25 October 2023. The Câmara record reviewed listed the lead bill as awaiting further action in the Constitution and Justice Committee; PL 205/2023’s record listed the lead bill’s rapporteur assignment as its last recorded action in May 2024.
