Dutch foundation Stichting Massaschade & Consument (SMC) is pursuing refunds and compensation from Epic over alleged pressure tactics, harmful design and privacy violations affecting young Fortnite players in the Netherlands. Separately, European authorities are scrutinising consumer practices at several game companies, including companies behind Minecraft. Those actions concern compliance with consumer-protection rules, not a general ban on game purchases.
What is happening with Fortnite in the Netherlands?
On 23 September 2026, SMC announced that it had held Epic Games liable on behalf of people who played Fortnite in the Netherlands before turning 21. SMC says it wants repayment of purchases it alleges were induced by pressure, compensation for alleged harm from the game’s design, and compensation for alleged privacy violations. It has invited Epic to discuss a collective solution and says it will issue a court summons if negotiations fail.

This is a proposed collective claim, not a completed court judgment awarding refunds or damages. SMC’s announcement does not mean eligible players have already received money, or that a refund process is open.

The European Commission describes related CPC work on making in-app purchases clear, stopping direct exhortations to children to buy where prohibited, and improving parental controls. These are enforcement and compliance measures applying existing EU consumer law; they are not evidence of an EU-wide prohibition on virtual currencies or purchases in games.

What does SMC allege Epic did?
SMC says Fortnite used misleading countdown timers, direct prompts to purchase and time pressure that could lead children and young people to spend money they otherwise would not have spent. The claim also raises alleged privacy violations and the risk of problematic gaming. These are allegations being advanced by SMC; they should not be read as findings in the proposed collective case.
SMC also reports that the Dutch Authority for Consumers & Markets (ACM) fined Epic €1.125 million, and that the Rotterdam District Court upheld that fine in January 2026. SMC says Epic did not appeal further. This reported regulatory history is distinct from the new collective claim for player refunds and compensation.

Who may fall within SMC’s proposed claim?
SMC says its action covers people who lived in the Netherlands, played Fortnite after its Dutch launch on 26 September 2017, and were under 21 when they played. Those are SMC’s stated eligibility criteria, not confirmation that a particular player qualifies or will receive compensation.
SMC has not announced a completed settlement or an open, guaranteed payout route in the information available. Players who think the criteria may apply can keep account purchase records, receipts and relevant dates, and check SMC’s own updates for the status of any claim or settlement process. Keeping records does not itself establish eligibility.

Does the Minecraft action mean Minecraft purchases are banned?
No. Minecraft is included in the wider BEUC complaint and the 2026 European enforcement context, but the Dutch collective claim described by SMC targets Epic’s Fortnite. The European action is directed at companies’ suspected consumer-law practices; it is not an order banning Minecraft or all purchases made within it.
The shared policy concern is how purchases are presented and sold: whether players can understand a price in real money, whether currency bundles obscure the cost or leave unused balances, whether tactics pressure people to buy, and whether protections for children are adequate. Inclusion in a complaint or enforcement action does not, by itself, establish that a specific company has broken the law.

Why are virtual currencies and purchase prompts under scrutiny?
Premium currencies such as Fortnite’s V-Bucks can make the real-money cost of an item less immediate when players first have to buy a bundle of currency. BEUC’s 2024 report said children in Europe spend an average of €39 per month on in-game purchases. That is BEUC’s reported average, not a figure for every child or every game.
SMC’s 2026 news release cited research by Wijzer in Geldzaken among more than 1,000 Dutch 16-to-19-year-olds: nearly six in ten buyers of currencies such as V-Bucks said the spending did not feel like real money, and half said they regretted a purchase made under time pressure. Those findings describe the surveyed group and should not be generalised to all European players.

The scrutiny is about consumer information and conduct—not whether games may ever sell optional digital content. The practical questions for regulators include whether the real-money price is clear, how bundle sizes and leftover currency are handled, whether countdowns or scarcity claims create pressure, and whether children receive appropriate safeguards.

- There is no announced Europe-wide ban. Neither SMC’s stated remedy nor the described EU enforcement action is a blanket ban on Fortnite, Minecraft or in-game purchases.
