Emulation and ROMs are not the same thing. An emulator is software that imitates another system so its games can run on your device; a ROM is a copy of a game’s software. In the United States, an emulator’s legality does not automatically make a ROM legal: ownership of the original game, how a copy was made or obtained, whether it is shared, and whether access controls were bypassed are separate questions. The answer can also differ by country.
What is the difference between a ROM and an emulator?
Emulation is a software function
An emulator imitates enough of a console or other platform for software designed for that platform to run on a different device. The term describes what the software does; it does not establish that a particular game copy is authorized. Nintendo UK describes emulators in these terms, while also stating its own rights-holder position on some emulator software. Nintendo says certain unauthorized emulators circumvent security measures; that is Nintendo’s characterization, not a blanket court ruling about all emulators. Nintendo UK’s emulator software page.
A ROM is a game copy
“ROM” commonly means a digital image or copy of game software. Copyright questions therefore concern the copying, acquisition, and distribution of that game, not simply the fact that it runs in an emulator. An emulator does not authorize a ROM, and a lawful emulator does not establish that a game file was lawfully made, downloaded, or shared. Are game ROMs legal if you own the original?
Owning a cartridge or disc does not, by itself, answer whether you may download a ROM from an unauthorized source or make a new copy. The U.S. questions are distinct: whether you lawfully own or are licensed to use the game, whether a new copy was made or obtained from an authorized source, whether copies are distributed, and whether access controls were circumvented. The sources cited here do not establish a general U.S. rule allowing every owner to download a ROM or make a personal backup by any method.

Distribution is a particularly important distinction. WIPO recounts the 2021 RomUniverse litigation, in which a U.S. court found the site operator liable for uploading Nintendo ROMs and facilitating user downloads, including findings of direct, contributory, and vicarious infringement. That case concerned the operator’s uploading and distribution conduct; it did not decide every question about private emulation or a copy made from a personally owned game. What does U.S. anti-circumvention law add?
Copyright in the game and rules against bypassing access controls are separate legal layers. The U.S. Copyright Office explains that DMCA § 1201 generally prohibits circumventing technological measures that control access to copyrighted works, subject to limited exemptions. It summarizes the rulemaking authority this way: “Section 1201, however, also directs the Librarian of Congress, upon the recommendation of the Register of Copyrights following a rulemaking proceeding, to determine whether the prohibition on circumvention is having, or is likely to have, an adverse effect on users’ ability to make noninfringing uses of particular classes of copyrighted works.” U.S. Copyright Office: Section 1201 rulemaking.

An exemption from § 1201’s circumvention prohibition does not, by itself, authorize copyright infringement under other provisions. The Copyright Office’s 2024 rulemaking ended with a final rule dated October 28, 2024; its current overview says the tenth triennial proceeding is underway and describes renewals for October 2027 through October 2030. What do the video-game preservation exemptions cover?
Current 37 CFR § 201.40 exempts certain narrowly defined video-game activities from the anti-circumvention prohibition. The relevant provisions include access to a lawfully acquired complete game when a required authentication server has ceased service, for local gameplay, and qualifying preservation by eligible libraries, archives, or museums. Other provisions address eligible institutions preserving certain lawfully acquired games no longer reasonably available commercially. The regulation sets conditions for server status, institutional eligibility, and access; it is not a general personal ROM-download exception. 37 CFR § 201.40.

Federal law also provides a limited interoperability provision in 17 U.S.C. § 1201(f). Under statutory conditions, a person who lawfully obtained the right to use a computer program may circumvent a measure to identify and analyze elements needed for interoperability of an independently created program, provided the acts do not constitute infringement. This is not a general consumer license to dump game ROMs or emulate any game. 17 U.S.C. § 1201.
Why the answer depends on where you live
The U.S. discussion is not a worldwide rule. For example, Canada’s Copyright Act § 30.6 permits specified adaptations or backup copies of certain computer programs when conditions are met, including personal use and destruction of the adaptation or backup when the person stops owning or holding a licence for the copy. That provision illustrates jurisdictional variation; it is not a complete answer to every Canadian video-game or technological-protection-measure question. Canada’s Copyright Act, section 30.6.

How to assess a particular game and setup
For a practical assessment, keep the questions separate rather than relying on “I own the game” or “the emulator is legal” as a complete answer:
- Identify the jurisdiction. Copyright and anti-circumvention rules vary by country.
- Check your rights to the game. Establish whether the game copy was lawfully acquired or licensed.
- Trace the game file. Ask whether a new copy was made, where a downloaded copy came from, and whether that source was authorized.
- Check for sharing. Uploading or distributing copies raises distinct concerns from merely running software locally.
- Consider access controls. Determine whether a technological measure controlling access was bypassed.
- Verify any claimed exemption. Match the exact activity and person or institution to the current statutory or regulatory conditions; a narrow exemption does not erase other copyright rules.
A currently licensed re-release or collection may offer a straightforward way to play a particular title, but availability and terms depend on the game and region. Verify that a release is authorized and currently offered before relying on it.
