If you receive a copyright notice tied to a ROM download, first identify who sent it and what kind of document it is. In the United States, a platform takedown notice is not the same as a lawsuit: the U.S. Copyright Office says, “No, a takedown notice does not mean you are being sued. If you are being sued, you will be served with court papers.” Preserve the notice, verify it through the relevant service’s official channel, and do not send a counter-notice unless you understand its requirements and genuinely believe removal resulted from mistake or misidentification. The guidance here concerns U.S. DMCA procedure; it does not determine whether any particular ROM download, possession, backup, or use is lawful, or explain other countries’ laws.
First, work out what you received
“Copyright notice” can describe different things. A platform may notify you that hosted material was removed; an internet service provider (ISP) may send a warning; a rightsholder or representative may send a demand; or you may have received a subpoena or court papers. These are not interchangeable, and not every warning follows the DMCA takedown process.

For a U.S. DMCA takedown, a compliant notice generally identifies the copyrighted work and the allegedly infringing material and its location, provides the complainant’s contact details, and includes good-faith and authority statements. The service provider must act expeditiously to remove or disable access to material covered by a compliant notice and notify the user. See the U.S. Copyright Office’s Section 512 overview and the statutory text.
Preserve and verify before responding
- Save the complete notice. Keep the original email or letter, attachments, headers if available, and any related messages. Do not discard it just because content is no longer accessible.
- Record the details. Note the date received, any stated deadline, the sender, the work and activity identified, what action the service says it took, and any requested response.
- Verify the message independently. If it claims to come from a platform or ISP, go to that service’s official website or contact support using details you obtain there. Do not rely only on a link or reply address in an unverified message, especially before providing personal information.
- Use the provider’s published procedure. For a platform takedown or counter-notice, check the service’s official DMCA instructions and designated agent details. The Copyright Office maintains a DMCA Designated Agent Directory; do not send sensitive information to an address supplied only by an unverified message.
- Separate warnings from legal process. A notice asking a service to remove material is not the same thing as a subpoena, summons, complaint, or other court paper. If you have formal legal documents, contact counsel promptly rather than treating them as routine account notices.
Does a takedown notice mean you are being sued?
No. The Copyright Office’s Section 512 FAQ answers the question directly: “No, a takedown notice does not mean you are being sued. If you are being sued, you will be served with court papers.” A takedown is part of a process for removing or disabling access to material through a service provider; it does not itself decide whether a particular ROM-related activity was lawful.

A subpoena, summons and complaint, or other court paper is different. Observe any deadline on the document and promptly consult a licensed attorney in the relevant jurisdiction. The same applies to a demand that threatens litigation or could have serious consequences. Do not assume that a takedown ends a dispute, and do not ignore formal legal papers.
Should you send a counter-notice?
Only consider a U.S. DMCA counter-notice if your hosted material was removed and you genuinely believe the removal resulted from mistake or misidentification. It is not a general appeal for anyone who disagrees with a copyright claim, and it is not an automatic response to a warning about downloading a ROM.

A counter-notice has formal requirements. Under the DMCA, it must include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
- Your name, address, and telephone number.
- Your consent to the jurisdiction of the relevant federal district court, with the location determined as the statute specifies.
- Your agreement to accept service of process from the person who submitted the original notice or that person’s agent.
A knowingly material misrepresentation in a counter-notice can expose the sender to liability for resulting damages, costs, and attorneys’ fees. Read the provider’s instructions and the statutory requirements carefully; consider legal advice before making sworn statements or agreeing to jurisdiction and service.

What happens after a compliant counter-notice?
Under the U.S. statutory process, a provider may restore access between 10 and 14 business days after receiving a compliant counter-notice unless it first receives notice from the original complainant that a court action seeking to restrain the user has been filed. This is a procedural time window, not a guarantee that every platform will handle every notice identically. The provider’s published DMCA instructions explain where and how to submit materials.

The Copyright Office’s Section 512 resources explain notice-and-takedown procedure; they do not establish whether a specific ROM download, possession, backup, or use is lawful, authenticate a notice addressed to you, or determine the right response to every ISP warning or private demand. They also do not state the law outside the United States. If the consequences could be significant, get advice from a qualified attorney in the relevant jurisdiction rather than inferring a case-specific legal answer from a takedown notice.
