How Fan-Made Game Levels Fit Into U.S. Copyright Law

Short answer: Making a custom level is not automatically illegal, but neither is it automatically authorized. U.S. copyright can protect your original, fixed design while also protecting the game’s characters, setting, audiovisual elements, music, and story that your level may reuse. The practical result depends on what the level copies, whether it is saved as a reproducible file, how you share it, what the game’s license permits, and whether a specific defense such as fair use could apply.

The clearest warning is Micro Star v. FormGen Inc., a 1998 Ninth Circuit case in which a commercial CD of player-created Duke Nukem 3D levels was likely an infringing derivative work. That decision does not make every fan map unlawful, and it is not a nationwide ruling for every U.S. court. It does show why a fixed level that uses a game’s expressive world and is distributed publicly or commercially carries substantially more risk than a private gameplay modification.

What copyright protects in a game level

U.S. copyright begins with an original work of authorship fixed in a tangible medium. Section 102 of Title 17 protects expression, not an abstract idea, gameplay system, procedure, process, or method of operation. A level’s general premise—such as “a maze with keys and locked doors”—is different from the particular rooms, geometry, lighting, text, enemy placement, artwork, dialogue, music, and other expressive choices used to implement it.

Fixation matters because a work must be recorded in a form that can be perceived, reproduced, or communicated. A saved map file, level description, screenshot, recorded walkthrough, custom artwork, or soundtrack is fixed. A temporary change that exists only while someone is playing may raise different questions from a level file that can be copied and run repeatedly.

Doom: The Dark Ages | Premium Edition | XBOX Series X|S & Windows Digital Code
  • PREMIUM EDITION CONTENT — Includes DOOM: The Dark Ages, the Revelations campaign DLC, Digital Artbook and Soundtrack, and the Divinity Skin Pack with matching skins for the DOOM Slayer, dragon, and Atlan.
  • BECOME THE SLAYER — Step into the blood-stained boots of the DOOM Slayer in a cinematic prequel to DOOM (2016) and DOOM Eternal.
  • STAND AND FIGHT — Take on demon hordes with the Super Shotgun, the versatile Shield Saw, and other devastating weapons in grounded combat.
  • TOOLS OF WAR — Take flight atop a Mecha Dragon, climb into an Atlan mech, and use the enhanced glory kill system against demons.
  • REIGN IN HELL — Witness the creation of a legend as the Slayer fights Hell’s forces and confronts their leader in a medieval war.

Your own original choices can be protectable even when they appear in a fan project. That does not erase rights in the game material you incorporated. One file can therefore contain two overlapping bodies of expression: your contributions and the publisher’s pre-existing material. Identifying who placed an object in an editor is not, by itself, a complete ownership analysis.

Why an original fan level can still use protected game material

A level built with an official editor may combine new layout decisions with the game’s protected characters, environments, visual style, sounds, music, names, or narrative setting. The fact that you supplied the arrangement does not necessarily give you permission to reproduce or adapt the underlying material. Conversely, the presence of recognizable game elements does not prove that every part of the map infringes. The details of the files and the rights being asserted matter.

Think of the legal questions as separate:

  • What did you create? Your original geometry, puzzles, text, art, or other expression may qualify for protection if it is sufficiently original and fixed.
  • What did you take? General mechanics and ideas receive different treatment from particular characters, settings, artwork, music, dialogue, and story elements.
  • What authorization exists? An editor license, end-user agreement, workshop policy, upload terms, or direct permission may define what you may make and distribute.
  • What did you do with the file? Private play, a free public upload, a platform-hosted file, and a commercial compilation create different practical and legal exposure.

No particular game’s current terms can be assumed from the existence of an editor. A policy may allow private experimentation but restrict public uploads, monetization, asset extraction, or use outside the game.

The central precedent: Micro Star v. FormGen

The Ninth Circuit decided Micro Star v. FormGen Inc., 154 F.3d 1107, on September 11, 1998. Duke Nukem 3D shipped with a Build Editor, and players created and posted custom levels. Micro Star collected 300 of those levels, put them on a CD called Nuke It, and sold the compilation.

Doom - PC
  • A Relentless Campaign: There is no taking cover or stopping to regenerate health as you beat back Hell's raging demon hordes
  • Return of id Multiplayer: Dominate your opponents in DOOM's signature, fast-paced arena-style combat
  • Near-Limitless Gameplay: DOOM SnapMap - A powerful, but easy-to-use game and level editor that allows for limitless gameplay experiences on every platform

At the preliminary-injunction stage, the court concluded that FormGen was likely to prove infringement. It reversed the denial of an injunction and sent the case back for entry of one. The court focused on the fact that the levels were permanent, reproducible files distributed to the public, rather than merely transient changes occurring during an individual play session. It also reasoned that the files drew on protected parts of Duke Nukem 3D’s story, including its setting and characters.

Judge Alex Kozinski wrote: “A copyright owner has the right to enter that market; whether it chooses to do so is entirely its business.” The sentence addressed the publisher’s potential market for sequels and derivative works. It was not a declaration that every fan creation is prohibited.

The procedural posture and geography are important. The ruling assessed the likelihood of success for an injunction, not a final trial verdict resolving every kind of fan level. It is a Ninth Circuit decision, binding in that federal appellate region and persuasive elsewhere, not a single nationwide rule that treats all custom maps alike.

How the main scenarios compare

Scenario What is copied How it is fixed How it is shared Practical legal issue
New design using only general gameplay ideas Mechanics, systems, or a broad premise A saved level may still be fixed Private use or public release Ideas and methods are treated differently from copied expressive implementation; other elements still require review
Fan map using game characters, setting, artwork, music, or story Protected expressive material from the game plus new level design Reproducible map, description, or audiovisual recording Upload, distribution, or sale Overlapping authorship and possible derivative-work or reproduction claims
Temporary in-session alteration Game content encountered during play Not saved as a distributable level file Used privately by the player Different facts from a fixed work offered to the public; the distinction does not decide every claim
Commercial compilation of fixed fan levels Game’s expressive world and the creators’ map files Permanent files on physical or digital media Sold to customers Closely resembles the conduct found likely infringing in Micro Star

Is it legal to make a custom level?

Usually, the act of designing a level is not answered by a simple yes or no. Creating original expression is different from obtaining permission to use the game’s expression. A private level made under an editor’s permitted use may present less exposure than a public upload, but “less exposure” is not the same as a legal guarantee.

DOOM: The Classics Collection (Limited Run #102)
  • Doom The Classics Collection physical game for Nintendo Swith.
  • This includes three classic DOOM games preserved on one cartridge - DOOM, DOOM II, and DOOM 3! No game downloads required.
  • Includes a full-color manual and reversible cover art.

Start by separating the content that could be yours from the content that belongs to someone else. A layout you designed, original puzzle logic, and new text may be your contributions. A game’s supplied character models, textures, music, dialogue, named locations, and story framework may remain protected by the rights holder. If the game requires those assets for the level to function, the relevant license may grant a limited right to use them inside the game without granting broader publication rights.

Can you share a fan-made level for free?

Free distribution can remove a sales transaction, but it does not automatically authorize copying or adaptation. The Copyright Office describes fair use as a fact-specific, case-by-case doctrine; it does not state that noncommercial fan levels as a category are fair use. A free upload can still reproduce or distribute protected material, and a rights holder may object even when no money changes hands.

Risk generally increases when a file is fixed, reproducible, publicly available, and built around recognizable characters, settings, or story elements. A private experiment that never leaves your device presents a different factual setting from a downloadable archive that anyone can mirror. The difference is not a bright-line safe harbor: the exact files, purpose, amount of material, and applicable terms still matter.

Can you sell a fan-made level or compilation?

Commercial distribution is the clearest danger in the available precedent. Micro Star’s sale of 300 fixed levels on Nuke It was the conduct the Ninth Circuit found likely to infringe. Selling an individual map, bundling maps into a paid pack, placing them behind a subscription, or monetizing a download can create market and distribution facts that are more difficult to defend than private use.

DOOM Eternal: Standard Edition - PC
  • Developed by id Software, DOOM Eternal is the direct sequel to the award-winning and best-selling DOOM (2016).
  • Hell’s armies have invaded Earth. Become the Slayer in an epic single-player campaign to conquer demons across dimensions and stop the final destruction of humanity.
  • Experience the ultimate combination of speed and power in DOOM Eternal - the next leap in push-forward, first-person combat.
  • Discover the Slayer’s origins and his enduring mission to Raze Hell
  • No disk included; Redeem the game via code inside the box

Do not assume that adding your own design work makes a sale permissible. New authorship may be valuable, but it does not automatically license the underlying game material. Before accepting money, determine whether the rights holder has expressly granted commercial permission and whether the editor or platform terms cover that exact form of monetization.

How fair use fits into the analysis

Fair use is a defense evaluated from the facts of a particular dispute. The Copyright Office identifies four statutory considerations:

  1. Purpose and character of the use: Noncommercial status can be relevant, but it is not an automatic result. Commercial distribution weighs differently, and a transformative purpose may matter when the work adds a new meaning or function.
  2. Nature of the copyrighted work: Highly creative game worlds, characters, artwork, music, and stories receive stronger protection than factual material.
  3. Amount and substantiality: Courts consider both how much was taken and whether the portion taken represents the expressive heart of the original.
  4. Effect on potential markets: A use that competes with authorized sequels, expansions, downloadable content, or licensed derivative works can create a serious problem.

These factors interact rather than operate as a checklist with automatic scores. The Copyright Office cannot decide whether an individual level is fair use, and no authority cited here establishes a categorical fair-use exemption for fan-made maps. If the consequences of publication or monetization are significant, obtain advice about the specific files and distribution plan.

What permission can change

Permission may come from several places, and each can have a different scope:

Best Value
Doom: The Dark Ages | Standard Edition | XBOX Series X|S & Windows Digital Code
  • STANDARD EDITION — Includes DOOM: The Dark Ages, a single-player dark fantasy and sci-fi shooter.
  • Editor or mod policy: It may allow creation inside the game while limiting extraction, redistribution, or commercial use.
  • End-user license agreement: It may address ownership, permitted modifications, warranties, and enforcement, but its language must be read for the particular game and edition.
  • Workshop or upload terms: Uploading may grant the platform a license while imposing representations, takedown rules, or restrictions on third-party material.
  • Direct license: A written agreement can define assets, territories, duration, attribution, revenue, and where the level may appear.

Check the terms that apply when you create and when you upload. Permission to make a level for personal play is not necessarily permission to publish it, sell it, include it in a compilation, or reuse the game’s assets in another engine, video, or storefront.

What happens when a platform receives a copyright complaint?

Section 512 of the Digital Millennium Copyright Act provides a notice-and-takedown process and potential safe harbors for qualifying online service providers, including platforms that host material supplied by users. A platform may remove or disable access to a level after a notice and may offer a counter-notice procedure under its rules.

Those mechanisms regulate the platform’s exposure; they do not grant a creator a license. An upload being online, searchable, or available for months is not proof that the rights holder authorized it. A counter-notice is a legal process with consequences, not a finding that the map is lawful. Follow the platform’s current instructions, preserve the relevant files and communications, and avoid reposting material while a dispute is unresolved.

Who owns a level made in a game editor?

Ownership can have more than one layer. Your original, fixed contributions may be protectable, while the publisher retains rights in its pre-existing characters, environments, art, music, story, and other content. The game’s terms may also assign rights, grant a license, or impose conditions on user-created material. Without the specific agreement, it is not possible to state who owns every element of a particular map.

Keep records of what you created yourself, what assets came from the game, which third-party materials were added, and the version of the terms you accepted. Those records do not create permission, but they make it easier to identify the boundaries of your work and respond accurately if a platform or rights holder asks questions.

A practical pre-release checklist

  1. Identify the jurisdiction. This explanation concerns U.S. law. If the creator, platform, or audience is elsewhere, obtain advice on the relevant country’s rules.
  2. Inventory the level. List original geometry, puzzles, text, art, sounds, music, characters, names, locations, and story references. Mark which items came from the game or another creator.
  3. Separate ideas from expression. Rework elements that merely reproduce the game’s distinctive visual or narrative expression when you do not have permission.
  4. Confirm fixation and distribution. Note whether the project is a saved map, an executable package, screenshots, a video, or another reproducible work, and where each version will be available.
  5. Read the current terms. Check the editor license, end-user agreement, workshop rules, and any monetization policy for the exact game and platform.
  6. Decide whether you need permission. Seek written authorization before selling, bundling, advertising, or using game assets outside the authorized environment.
  7. Evaluate fair use cautiously. Apply all four factors to the actual purpose, material taken, and likely market effect; do not rely on “free,” “fan-made,” or “noncommercial” as a shortcut.
  8. Plan for a complaint. Keep source files and permissions, understand the platform’s notice and counter-notice process, and be prepared to remove or revise the upload.

What this means for creators

There is no universal rule that custom levels are either legal or illegal. The strongest warning applies when a creator fixes a level that uses a game’s expressive characters, setting, or story and then distributes or sells it without permission. A level built from general ideas, containing substantial original expression, used within the permissions granted by the relevant terms, and shared in a limited way presents a different analysis.

Micro Star supplies an important boundary, not a blanket ban: a commercial collection of permanent fan levels can be treated as an unauthorized derivative use, while the legality of another project turns on its content, fixation, distribution, authorization, and any applicable defense. For a real release, review the actual files and current terms with a qualified copyright lawyer in the relevant jurisdiction.
