Choose the license for the code you wrote based on the reuse you want to allow. An MIT-style license permits proprietary forks when downstream users keep the required notices; GPLv3 requires distributed covered derivatives to preserve source availability and the GPL terms. Neither choice gives permission to redistribute Sony software, proprietary SDK components, console firmware, game code, trademarks, or other third-party assets.
Before publishing, inventory every contribution, dependency, SDK file, tool, and asset, verify that you have the right to license or distribute each one, then check the PlayStation agreements that apply to your console generation, region, software and distribution method.

Choose the downstream result first
A homebrew license is a copyright permission for material your project controls. The practical decision is not “Which license is best for PlayStation?” but “What should another person be allowed—or required—to do with my original code?” Decide that before selecting a text file for the repository.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problems- Choose a permissive license if you are comfortable with companies or individuals incorporating the code into closed-source products, commercial releases, or differently licensed forks.
- Choose a copyleft license if you want distributed modifications and larger works containing covered code to remain available under reciprocal source and licensing conditions.
- Pause for a rights audit if the repository contains code, libraries, SDK files, artwork, audio, fonts or data that you did not create or cannot clearly license.
MIT and GPLv3 are common reference points, but a label alone does not settle a mixed project. Read the complete license texts, check compatibility among all components, and document which files are covered by which terms.

MIT and GPLv3: what changes for a homebrew project?
GitHub’s Choose a License guide describes MIT as permissive and GPLv3 as copyleft. The choice affects how a person may redistribute your game, engine, loader, library or tools after modifying them.
| Decision axis | MIT-style permissive license | GPLv3-style copyleft license |
|---|---|---|
| Closed-source forks | The MIT summary allows larger works and modifications to be distributed under different terms, including without source code, provided the required notices remain. | Distribution of covered works carries conditions intended to keep the source and GPL terms available to recipients. |
| Typical compliance work | Keep the copyright notice and license text with copies or substantial portions of the code, as required by the full license. | Keep notices, identify changes as required, provide corresponding source when conveying covered works, and follow the applicable GPL conditions. |
| Patent wording | Do not assume an MIT comparison proves a patent grant; inspect the complete license and your project’s patent position. | The GPLv3 summary identifies an express patent grant, subject to the license’s terms. |
| Dependency fit | Usually attractive when downstream users need broad freedom, but every dependency still has its own conditions. | Check whether each combined component can legally be distributed under the resulting obligations; the word “GPL” does not by itself resolve compatibility. |
When MIT is the better fit
MIT is usually the straightforward choice for a reusable graphics routine, input library, asset pipeline, SDK helper or game framework when you want adoption with minimal downstream obligations. A studio could integrate the code into a proprietary title; a hobbyist could alter it for another console; a distributor could ship a binary while retaining the notices. That flexibility can increase reuse, but it also means a popular fork may never publish its improvements.
Use the complete text at GitHub’s MIT License page, include the copyright statement for the relevant contributors, and state clearly whether the MIT grant applies to the entire repository or only identified files.
When GPLv3 is the better fit
GPLv3 is designed for authors who want recipients of distributed covered works to receive source and the same freedom to modify and redistribute. It can suit an open console runtime, emulator-side utility, game engine or toolkit where improvements should flow back to users rather than disappear into proprietary forks.
GPLv3 does not automatically cover artwork, levels, third-party libraries or a separately distributed game. Mark the files that are covered, provide the corresponding source required for a conveyed build, and follow the full terms at the GPLv3 reference page. If you combine GPL code with another component, analyze the actual license texts and the way you link, bundle or distribute them.
A project license covers only material you can license
Putting “MIT” or “GPL-3.0-or-later” in a repository does not transfer rights you do not own. Copyright may be split among contributors, and a single release may contain works with completely different owners and conditions.

Build a provenance inventory
Create a file-level record before choosing the top-level license. For each item, record the author or supplier, source URL or acquisition method, version, applicable license, required attribution, and whether redistribution is permitted.
- Original source files and generated code.
- Contributors’ patches, commissions and jointly authored modules.
- Third-party libraries, runtime code, fonts and development utilities shipped in the release.
- SDK headers, libraries, examples, templates and build scripts.
- Textures, sprites, models, music, sound effects, fonts, logos, screenshots and game data.
- Keys, firmware images, console system files and any material extracted from another product.
Keep the inventory under version control and update it when a dependency or asset changes. A contributor agreement or written assignment may be necessary when ownership is shared, an employee created the work, or a contractor retained rights. Do not accept a pull request whose author cannot explain the provenance of copied code or assets.
Separate code from assets and platform material
A repository can contain several legal layers. Your original gameplay code might be MIT; a bundled font might require attribution; a sound library might prohibit commercial redistribution; and a proprietary SDK library might not be redistributable at all. Place separate notices beside those components and distribute only what their terms allow.
The HL-PSX licensing and distribution policy illustrates this boundary: it describes project code as GPL-2.0-or-later where its copyright holders can license it, while expressly excluding Half-Life, Valve assets, PlayStation and Sony technology, and other third-party material. That policy is an example of documentation practice, not a universal license for another project.
Your code license is separate from PlayStation terms
Sony’s platform agreements govern defined PlayStation software and system software; they are not grants of rights in your original source. The US PlayStation Product Software License Agreement states restrictions that include using unauthorized, illegal, counterfeit or modified hardware or software, circumventing encryption, security or authentication, and using the software to design, develop, update or distribute unauthorized software or hardware for PlayStation products. Its quoted prohibition—“You may not: (i) distribute, copy, lease, rent, sublicense, publish, modify, patch, adapt or translate the Software”—refers to the agreement’s defined “Software,” not automatically to code you wrote independently.

It also notes that some regions use separate Software Usage Terms for games and other software. Therefore, a US agreement cannot answer every question for a developer or distributor elsewhere, and neither agreement by itself is a universal legal ruling on all homebrew projects.

Do not infer permission to copy Sony libraries, firmware, SDK files, console security components, game content or trademarks from the MIT or GPL notice in your repository. Conversely, a platform term does not change the license on your independently authored code. Analyze both layers and the way your release interacts with them.
Console generation, region and toolchain affect the analysis
Identify the exact target
“PlayStation homebrew” can mean a PS1 program, a PS2 application, software for a later system, a PC tool that builds a console image, or a distribution service. Record the target console, firmware or system-software version, development region, intended users’ region and whether the release is source, binaries, a disc image, a package, a patch or a hosted service.
Older-console communities may distinguish an independent toolchain from proprietary development products. The PSn00bSDK documentation describes an open-source SDK effort for original PlayStation development and says it is not affiliated with Sony; that fact shows why toolchain provenance is distinct from the license on your game code. It does not establish that every tool, library or use is risk-free.
For commercial PS1 releases, the practical discussion at PSX.dev’s Commercial Homebrew FAQ raises concerns about Sony’s proprietary Psy-Q SDK and warns that its authors are not legal scholars and that the page is not legal advice. Treat it as community context, then verify the terms governing the specific SDK and distribution arrangement you plan to use.
Check region-specific terms
Record the jurisdiction in which the developer, publisher and principal distributors operate. Terms can differ by country, and Sony’s PS5 agreement explicitly points readers in some regions to separate software usage terms. If a release is commercial, uses a platform security feature, or distributes material supplied under a regional contract, obtain advice for the relevant jurisdiction rather than extrapolating from a US page.
Distinguish open-source notices from SDK grants
Sony publishes notices for particular open-source components. Its Eigen (US) notice identifies source under MPL 2.0 and lists component versions associated with PS5 system-software versions. That is a notice for the specified component and versions, not blanket authorization to reuse Sony source, proprietary SDKs or system software elsewhere. Preserve the applicable notice and inspect the referenced license if your distribution actually includes that component.

A step-by-step licensing workflow
- Define the release. Write down whether you will publish source, binaries, a disc image, a patch, a launcher, a hosted service, or a commercial physical product. Note the console generation, firmware assumptions and regions.
- Map ownership. List every contributor and identify employment, contractor, joint-authorship or assignment issues. Obtain a written permission or assignment where the person cannot grant the rights you need.
- Inventory dependencies and assets. Use the provenance record for libraries, SDK elements, generated files, fonts, sounds, models, images, data and build tools. Mark items that may not be redistributed.
- Split the repository into license zones. Decide which directories contain your original code, which contain third-party code, and which are merely build instructions for components users must obtain separately.
- Choose the downstream policy. Select permissive terms if proprietary forks are acceptable; select copyleft if distributed covered derivatives should provide source and reciprocal terms. If neither fits, evaluate another established license instead of inventing a short custom notice.
- Read compatibility conditions. Compare the complete license texts, linking or bundling method, attribution requirements, patent language and source-provision duties. A dependency’s label is not enough to determine whether the combined release is permitted.
- Prepare notices. Add the complete project license, copyright statements, third-party notices, attribution files and a clear list of excluded assets or separately obtained platform files. Identify modifications where the chosen license requires it.
- Audit the release artifact. Inspect the exact archive, package, disc image or download page users will receive. Confirm that prohibited SDK files, firmware, keys, copied game data and accidental build outputs are absent.
- Check platform and regional terms. Read the current agreement for the target system and the distribution method. Reassess anything involving authentication, encryption, security circumvention, modified hardware or Sony software.
- Document the decision. Add a licensing policy explaining what the project license covers, what it excludes, where third-party notices live and how contributors should submit provenance information.
How distribution plans change the practical obligations
| Planned release | Questions to answer before publishing | Typical documentation needs |
|---|---|---|
| Source-only library or engine | Can every source file be licensed under the selected terms? Are examples, test data and generated files covered separately? | License file, copyright headers where appropriate, dependency manifest and attribution records. |
| Binary homebrew game | Does the binary contain third-party code or assets? What source, notices or offer must accompany a distributed copyleft work? | Notices in the download or installer, source-access instructions where required, and an asset exclusion list. |
| Disc image or physical release | Does the image include proprietary SDK output, platform software, copied game content or keys? Who is authorized to manufacture and distribute it? | Reproducible build information, component licenses, physical-product notices and a rights review for every embedded asset. |
| Patch, mod or translation | Does the patch contain original code only, or does it redistribute protected game data? Does applying it require a copy of the user’s game? | Clear separation between the patch and user-supplied files, plus permissions for any included assets. |
| Commercial distribution | Are ownership, consumer terms, platform restrictions and regional rules resolved? Can you show a chain of title for commissioned work? | Contracts, contributor grants, compliance records and advice from a lawyer familiar with the jurisdictions involved. |

“The root license covers the whole ZIP”
It does not if the archive contains material owned by someone else. Remove unlicensed files, obtain permission, or distribute them separately under their original terms. Update the README so users can tell what they are receiving.
“The SDK came with the console, so redistribution is fine”
Availability to developers does not prove a redistribution right. Identify the SDK supplier and version, read its agreement, and avoid shipping proprietary libraries or headers unless the terms expressly allow it.
“GPL means every file must be GPL”
Scope depends on which code is covered and how components are combined. Mark independent assets and tools separately, then analyze the actual distribution and linking arrangement. Do not use a blanket statement to conceal unresolved compatibility.

Built-in cable management guides wires along the arms, keeping cords out of sight and out of the way. Enjoy a tidy, modern workstation that looks as good as it feels to use.
“An open-source notice from Sony authorizes the SDK”
An open-source notice identifies the specific component and version covered by that notice. The Eigen page, for example, is not a general SDK grant. Limit your use to what the component license actually permits.
“A community FAQ settles legality”
Community documentation can reveal practical concerns, but it is not a jurisdiction-specific legal opinion. The PSX.dev FAQ itself carries that qualification. Escalate unresolved ownership, platform-security or commercial questions to qualified counsel.
A defensible policy for contributors and releases
Publish a short policy that answers five questions: what your project license covers; which directories contain third-party material; what contributors must certify; how users obtain separately licensed SDKs; and which assets are excluded from redistribution. Require pull requests to include a provenance note for copied or generated code. Review the inventory whenever you change a dependency, add a new console target or prepare a commercial build.
If a contributor later withdraws permission or reveals that a file was copied without authorization, stop distributing the affected artifact, isolate the file in version control, identify a replacement or obtain permission, and issue a corrected release with updated notices. Do not assume that changing the root license cures an ownership defect.
When to obtain legal advice
Professional advice is warranted when you plan to sell the game, manufacture discs, accept investment, distribute in multiple countries, rely on a proprietary SDK, include extracted game content, ship modified system software, or interact with encryption, authentication or security mechanisms. Bring the provenance inventory, contributor agreements, dependency licenses, target regions, console generations and exact release artifacts to the lawyer. Those details determine the question; “it is homebrew” is not enough.
Final decision checklist
- Have you decided whether closed-source forks are acceptable?
- Can every contributor grant rights in the code attributed to them?
- Have you recorded the license and redistribution permission for every dependency, SDK component and asset?
- Are your original code, third-party material and excluded platform files clearly separated?
- Does the selected license match the distribution obligations you are prepared to meet?
- Are all required notices, license texts and source-access instructions included with the actual release artifact?
- Have you checked the current PlayStation agreement, console generation, region and distribution method separately from your code license?
- Have you obtained jurisdiction-specific advice for unresolved commercial, ownership or platform-security issues?
The result should be a narrow, honest grant: your license gives users the rights you control in your original work, while separate notices and platform terms govern everything else. That separation is what makes a PlayStation homebrew release understandable and maintainable for its next developer.
