Before release, identify every source asset and its license, inspect the finished frames for protected works and brand cues, check whether any person is recognizable, and make sure the presentation does not imply an untrue sponsorship or endorsement. Keep the tool terms, permissions, releases, prompts, drafts, and edit history that support those decisions.
This guide is based on U.S. federal guidance available through October 13, 2026. Copyright, trademark, publicity, privacy, and advertising results depend on the facts, the states involved, and the way a clip is distributed. The checks below reduce avoidable risk; they cannot guarantee that a particular video is lawful.

What “safe to use” actually requires
There are several separate legal questions in an AI-video workflow. A favorable answer to one does not settle the others. For example, you might add enough human editing to claim copyright in your finished trailer while still lacking permission for a photograph used as a reference, or you might avoid copying a photograph yet create a scene that makes viewers think a real company sponsored your game.

| Question | What to examine | Why it matters |
|---|---|---|
| Who authored the expressive elements? | Your script, shot design, selection, arrangement, compositing, editing, and other human contributions versus machine-determined output. | The U.S. Copyright Office’s January 29, 2025 Part 2 report says protection can cover expression determined by a human author, but prompting alone is not enough. |
| Were the inputs authorized? | Reference footage, game captures, photographs, music, voices, sound effects, logos, and other files supplied to the system. | Copyright in the final result is distinct from permission to copy or process protected source material. |
| Could a mark confuse viewers? | Logos, product shapes, packaging, storefronts, uniforms, names, and the surrounding commercial context. | A generated depiction can still raise trademark or unfair-competition concerns if it suggests a source, affiliation, approval, or sponsorship. |
| Is a person identifiable? | Faces, voices, body movement, names, biographical details, and a realistic digital replica of a real individual. | Publicity, privacy, digital-replica, and false-endorsement theories are separate from copyright and vary by state. |
| What impression does the audience receive? | Whether the clip is editorial, private, monetized, a game trailer, an advertisement, a product placement, or an endorsement. | FTC standards require advertising claims to be truthful, non-deceptive, and evidence-based; endorsements must be honest and material connections disclosed when required. |
Start with an asset and workflow inventory
Make the inventory before generating or publishing. Treat every item that enters the workflow as a rights question, including material that never appears in the final export.
List every input
Record the filename or description of each video, image, 3D model, music track, sound effect, script, voice recording, logo, game capture, and text prompt. Note who supplied it, where it came from, and whether it was copied, downloaded, licensed, generated, or created by your team. A “publicly visible online” file is not automatically public domain.

Capture the applicable terms
Save the generation service’s terms in effect on the date of creation, including clauses about user uploads, training, commercial use, output ownership, attribution, indemnity, geographic restrictions, and termination. Terms can change, so preserve a dated copy or a contemporaneous record. The terms do not replace a license for a photograph, song, game asset, or other third-party work that you upload.
Classify the provenance
- Original: created by you or your team without copying another work.
- Licensed: covered by written permission whose scope includes your intended medium, territory, duration, edits, and commercial use.
- Public domain: confirmed for the relevant jurisdiction and version, rather than merely described that way by a post or prompt.
- User-supplied: accompanied by a representation and permission that you can verify.
- Uncertain: unresolved until you obtain permission, replace the material, or obtain jurisdiction-specific legal advice.
Keep this classification with the project. It gives an editor or counsel a clear route to the decision instead of requiring them to reconstruct the workflow from memory.

Human authorship is the key test
The Copyright Office’s Part 2 report, released January 29, 2025, explains that generative-AI output may be copyrightable when a human author determined sufficient expressive elements. Human-authored material that remains perceptible in the result, and human creative arrangement or modification of generated material, can provide a basis for protection. The report also says that using AI assistance or including AI-generated material does not automatically prevent copyright in a larger human-created work.
A prompt by itself generally describes an intention rather than fixing the detailed expression. A short instruction such as “make a cinematic space battle” leaves the system to determine the characters, composition, lighting, motion, and other expressive details. Treat the resulting frames as material whose human authorship has not been established merely because you wrote the prompt.
Contributions that can matter
Document the human decisions that shape the final video: a written script and original dialogue; a storyboard with deliberate shot choices; selection of particular generations from many candidates; timing, pacing, and montage; hand-authored animation or compositing; color, sound, and visual effects; replacement of generated elements with your own artwork; and substantial revisions that express your creative judgment. These facts do not guarantee registration or infringement immunity, but they help identify the portion for which a human claim may be appropriate.

Do not describe every pixel as your own authorship when the machine determined the expressive elements. If you need strong, transferable rights, make the human-created components substantial and retain the working files that show how they were made.
Registration of a mixed work
The Copyright Office’s March 16, 2023 registration announcement says applicants have a duty to disclose AI-generated content in works submitted for registration. The application should identify the human-authored contribution and exclude material whose expressive elements were determined by the machine. A registration claim that silently treats all generated imagery as human authorship can create an avoidable problem. The 2025 Part 2 report supplies the current high-level authorship framework, but a particular application may require professional advice.
Copyright in source material and fair use
Input permission is a separate decision
If your workflow incorporates or processes copyrighted footage, music, images, dialogue, game captures, or other works, check the license or obtain permission. This remains true even if the final clip looks different or contains newly generated elements. A tool’s statement about output does not grant you rights in a third party’s input.
For a U.S. fair-use analysis, consider all four statutory factors:
- Purpose and character: whether the use is commercial, nonprofit, educational, transformative, or serving another purpose. Commercial use is not automatically disallowed, and transformation is not automatically enough.
- Nature of the work: factual and published material generally receives different consideration from highly creative, unpublished work.
- Amount and substantiality: examine both the quantity and the qualitative importance of what was taken. There is no safe number of seconds, frames, percentage, or file size.
- Effect on the potential market: consider whether the use substitutes for the original or harms a likely licensing market.
Fair use is a fact-specific U.S. defense, not a percentage rule and not a clearance label. If the analysis is uncertain, replace the input, license it, or obtain advice for the jurisdiction and use at issue.

Practical input checks
- For game footage, confirm who owns the game content and whether the applicable policy permits your trailer, stream, mod, or commercial promotion.
- For music and sound, check composition, recording, performer, and synchronization rights; a license for one layer may not cover the others.
- For photographs and artwork, identify the photographer or artist and any depicted people, products, or artwork within the image.
- For user uploads, obtain a written representation that the uploader has the necessary rights and permission to authorize your use.
- For “style” references, avoid copying a specific protected image, character, scene, or living artist’s distinctive work and do not assume a style instruction resolves source-rights issues.
Inspect generated frames for trademarks and brand cues
Review the export frame by frame. Generation systems can introduce a recognizable logo, product silhouette, package design, storefront, uniform, slogan, or fictionalized mark even when you did not request one. A prompt that says “generic energy drink” does not guarantee that the rendered can is legally generic.
What trademark confusion means in practice
USPTO guidance explains that marks may be confusingly similar by sound, appearance, meaning, or overall commercial impression. The relationship between the goods or services also matters. Ask whether a reasonable viewer could think the brand supplied, approved, sponsored, or is affiliated with the video. An incidental appearance in an editorial scene raises different questions from a prominently featured product in a paid game advertisement, but neither category receives an automatic pass.
A clearance screen for each clip
- Pause on every shot and note visible or audible marks, names, distinctive product shapes, packaging, signs, and uniforms.
- Search your own records and the USPTO’s recommended clearance resources for potentially conflicting marks; USPTO advises a comprehensive search rather than relying on one exact-word query.
- Describe the context: editorial explanation, gameplay, fictional world-building, product placement, comparison, or advertisement.
- Identify the goods or services associated with the mark and compare them with what your video promotes.
- Remove, redesign, blur, or replace an incidental cue when it is unnecessary and could imply affiliation. Do not use blurring as a substitute for permission when the mark is central to the message.
- Escalate a deliberate or prominent use for trademark review before release.
These are screening questions, not a legal conclusion about a particular mark. A generated logo can raise the same confusion issue as a logo inserted by an editor.
Real people, synthetic likenesses, and digital replicas
Why a synthetic person can still create liability
A realistic face, voice, body, name, biography, or mannerism may identify a real person even when no camera recorded that person. Potential issues include publicity rights, privacy claims, digital-replica laws, and false endorsement. They are independent of whether the video itself qualifies for copyright.
The Copyright Office’s Part 1 report on digital replicas, dated July 31, 2024, recommended federal legislation addressing knowing distribution of unauthorized realistic digital replicas. That recommendation is not proof that the proposed federal protection became law. Do not present it as a current nationwide statute.
Check the relevant state and commercial rules
USPTO’s name, image, and likeness guidance, updated September 17, 2026, explains that NIL protection generally comes from state law and varies by state. It also describes federal trademark protection when a person’s NIL is used commercially as a mark for goods or services. The location of the creator, the depicted person, the audience, and the distribution can all matter.

For a recognizable real person, especially in a game trailer, sponsored video, storefront, or other commercial promotion, obtain an appropriate release or use a clearly fictional character. A disclaimer saying “AI-generated” does not itself grant permission or erase a false impression of endorsement. Keep the release with the project and verify that it covers the media, territory, duration, edits, paid promotion, and sublicensing you actually need.
Advertising, sponsorship, and endorsement impressions
FTC advertising guidance requires claims to be truthful, non-deceptive, and supported by evidence. FTC endorsement guidance says an endorsement must be honest and not misleading; an endorser should not claim experience they did not have, and material connections that affect how consumers evaluate the endorsement should be disclosed when required. The FTC’s endorsement guides are guidance rather than regulations, but the agency may investigate potentially unfair or deceptive conduct under the FTC Act.
Common AI-video traps
- A synthetic streamer appears to say they used a game, controller, service, or supplement they have never used.
- A realistic executive or celebrity appears to announce that a company approved the trailer.
- A generated storefront or package implies that a named company sponsored an event in your game.
- On-screen text claims a performance, safety result, discount, or award without evidence.
- A disclosure is technically present but hidden, too brief, or contradicted by the overall impression.
Evaluate what a reasonable viewer takes away from the whole presentation, not merely whether a disclaimer appears in a corner. If the scene is an advertisement or paid placement, substantiate objective claims before publication and disclose a material connection in a clear, noticeable way where required.
An end-to-end release procedure
Use this sequence for each finished clip, not only for the first generation.
- Define the use: record whether the clip is private, editorial, monetized, a game trailer, an advertisement, a sponsorship, or an endorsement; list the countries and states you expect to reach.
- Freeze the source list: export a manifest of every uploaded or referenced asset, including files later removed from the timeline.
- Verify permissions: attach licenses, releases, public-domain evidence, or a documented fair-use analysis to each source. Mark unresolved items instead of assuming they are cleared.
- Preserve human work: save scripts, storyboards, prompts, generation candidates, selection notes, edit timelines, compositing files, and original artwork.
- Run a visual and audio pass: inspect every shot for copyrighted characters or footage, music, logos, product shapes, names, voices, and identifiable people.
- Test the audience impression: ask an uninvolved reviewer what company, person, sponsorship, or product claim the clip appears to communicate.
- Correct the risky element: replace the input, redesign the asset, remove the mark or likeness, obtain permission, add an accurate disclosure, or change the claim. Do not rely on a vague “AI-generated” label.
- Check registration language: if you will seek copyright registration, identify the human-authored material and disclose AI-generated content as required by the Copyright Office.
- Approve and archive: keep the final export, review checklist, terms, permissions, releases, substantiation, and decision notes together.
Use a risk matrix to decide when to stop
The following matrix is an editorial triage tool, not a legal safe harbor. A clip can move to a higher-risk category if any one factor changes.
| Workflow profile | Typical indicators | Practical response |
|---|---|---|
| Lower screening risk | Original or licensed inputs; fictional people and brands; substantial human script and editing; private or clearly editorial distribution; no unsupported claims. | Keep the records, complete the frame review, and confirm the tool terms before release. |
| Moderate screening risk | Uncertain reference material; incidental logos or distinctive products; monetized distribution; limited human control over key imagery; broad or cross-border audience. | Replace uncertain inputs, remove unnecessary marks, strengthen human contributions, and obtain a targeted rights review. |
| High screening risk | Real person’s recognizable likeness or voice; prominent brand placement; paid endorsement; copied footage or music; claims about performance or sponsorship; unresolved ownership. | Pause publication. Obtain written permissions and claim substantiation, redesign the clip, or obtain jurisdiction-specific legal advice. |
What to do when a problem appears after editing
If the source cannot be cleared
Remove the source from the project, regenerate without it, or substitute material with documented permission. Do not assume that changing color, cropping, mirroring, speeding up, or adding noise cures infringement.

If a logo or product appears unexpectedly
Determine whether it is necessary to the story and what affiliation viewers may infer. If it is unnecessary, redesign the object or background. If it is central, seek permission and review the goods, services, placement, and advertising context.
If a person is recognizable
Stop the commercial release until you have a release covering the intended use or have changed the character enough that identification and endorsement concerns are no longer reasonable. State-law rules differ, so a release from one jurisdiction may not answer every distribution question.
If the clip makes an unsupported claim
Remove the claim, obtain competent evidence, or rewrite it as clearly fictional or opinion-based content that does not mislead the audience. Keep the substantiation used for the final wording.
Documentation that makes review possible
Maintain a project folder containing the dated tool terms; source manifest; licenses and permissions; releases; prompts and generation settings; candidate outputs; edit and compositing files; music and voice records; frame-review notes; advertising substantiation; disclosures; and the final approval. This is practical recordkeeping guidance, not a statement that the federal sources require one particular retention system. Its purpose is to show what a human created, what was supplied by others, what the audience was told, and why each risk decision was made.
Limits of this U.S. guidance
The Copyright Office reports and USPTO and FTC materials do not decide the outcome of a particular fair-use defense, trademark dispute, publicity claim, or digital-replica case. State publicity and privacy protections vary, and countries outside the United States may apply different rules. Recheck the status of federal AI reports, applicable state and federal law, and current FTC guidance before a major release. When a recognizable person, prominent brand, copied source, or paid endorsement is central to the video, obtain advice on the specific facts and jurisdictions rather than relying on this general checklist.
Bottom line
Use AI footage as a production method, not as a rights shortcut. Clear the inputs, establish and document your human creative contribution, inspect every frame and soundtrack for protected material, obtain permission for recognizable people and deliberate brand uses, and make advertising claims and endorsements accurate. If any of those questions remains unresolved, change the clip or pause distribution until the issue is addressed.
