iam8bit Sues Skybound Game Studios Over Fraud and Design-Theft Allegations

iam8bit’s lawsuit accuses Skybound Game Studios of accounting and contract violations, plus alleged misuse of confidential information and Stray marketing materials. Skybound says the claims are without merit; no final outcome is confirmed by the cited sources.

iam8bit is suing Skybound Game Studios over alleged contract and accounting violations, and claims Skybound used confidential information and copied marketing materials in connection with a physical Nintendo Switch release of Stray. Skybound disputes the claims. The allegations have not been established as facts in court.

What is iam8bit accusing Skybound of?

Skybound Holdings’ SEC filing says Skybound Game Studios was served with the complaint on December 4, 2025. The plaintiff is iam8bit, a video-game co-publisher that had a strategic partnership agreement with Skybound. The filing dates that agreement to May 2020 and says it was terminated in November 2023, though some rights and obligations continued.

The complaint raises two broad kinds of dispute: financial reporting and contract obligations, and iam8bit’s allegations about confidential information and creative work. The SEC filing lists claims including fraud, conversion, breach of contract, breach of the implied covenant of good faith, negligence, and violations of the California Uniform Trade Secret Act. Engadget also reports claims of unjust enrichment and misappropriation.

These are causes of action asserted by iam8bit, not findings that Skybound committed fraud, misappropriated trade secrets, or stole designs.

What does Stray have to do with the lawsuit?

In its account of the dispute, iam8bit says it created promotional materials for the PlayStation and Xbox launch of Stray. It alleges that Skybound used confidential information about iam8bit’s royalty split with Annapurna Interactive to secure a separate Nintendo deal for a physical Switch release that excluded iam8bit. iam8bit also alleges that marketing materials were copied, according to Engadget’s report on the complaint.

PC Gamer’s account likewise describes the allegations about confidential information and marketing materials. It reports that iam8bit had offered a special edition of Stray and soundtrack vinyl. That product context is separate from the alleged Nintendo Switch deal; it does not, by itself, establish what information or materials were used.

What is the accounting dispute?

iam8bit alleges Skybound did not provide accurate monthly financial reports and included millions of dollars in disputed expense items. Engadget reports that the complaint says: “Skybound failed to provide the monthly reports as agreed.” The SEC filing describes the case as including contract and accounting-related claims.

The two reported monetary figures should not be treated as one award. Skybound Holdings’ SEC disclosure says more than $2.8 million in compensatory damages is sought. Engadget’s December 4, 2025 report says iam8bit sought more than $4 million in damages related to accounting issues, along with monetary damages, punitive damages, and attorneys’ fees. Both figures describe claims or requested relief, not money awarded by a court.

How has Skybound responded, and has the case been decided?

In its SEC filing, Skybound Game Studios says the claims are without merit and characterizes the non-contractual allegations, in practice, as an accounting dispute. The company said it had retained outside counsel.

The filing described the litigation as being in the pleadings and discovery stages. That disclosure does not establish the case’s status as of October 8, 2026, and the available sources do not confirm a later procedural update, final judgment, or resolution. Accordingly, the allegations remain disputed rather than adjudicated in the material cited here.

Why do reports give different partnership dates?

Skybound Holdings’ SEC filing says the strategic partnership agreement was made in May 2020. Engadget describes the companies as entering a partnership in April 2021. The cited accounts do not reconcile those dates, so they should not be treated as interchangeable: the agreement date is the SEC filing’s description, while April 2021 is Engadget’s account.
