Botting is not automatically illegal in the United States. The answer depends on what the bot does, what systems or information it accesses, whether that access is authorized, and whether the conduct triggers a specific law. A game or website’s rules can also lead to account or other consequences even when breaking them alone is not a federal crime.
What “botting” means matters
Botting can refer to game automation, automated browsing or scraping, bulk account creation, spam, ticket buying, or attempts to reach restricted data. Those activities are not one legal category. The relevant questions are whether the automation crosses an access boundary, obtains or alters information the user is not entitled to access, furthers fraud, causes damage, or circumvents a control covered by a specific law.
For video-game players, that means a game’s prohibition on bots does not, by itself, establish a federal crime. But the circumstances can matter: using automation to access an account or system area without authorization, cause damage, or commit fraud raises different legal issues from merely violating a game’s rules. No single answer applies to every game or bot.
How the federal CFAA applies
The Computer Fraud and Abuse Act (CFAA), at 18 U.S.C. § 1030, covers specified forms of computer access, fraud, and damage. It is not a blanket ban on automation. The statute has distinct offenses and mental-state requirements; depending on the subsection and facts, it addresses intentional access without authorization or exceeding authorized access to obtain information, access connected to fraud, and conduct causing damage to a protected computer.

The statute defines “exceeds authorized access” as accessing a computer with authorization and then using that access to obtain or alter information the person is not entitled to obtain or alter. Whether a bot falls within a CFAA provision therefore depends on its conduct and the access involved—not simply on the fact that software performed the action.
The Supreme Court’s access-boundary interpretation
In Van Buren v. United States, 593 U.S. 374 (2021), the Supreme Court held that a person exceeds authorized access when they enter a computer with authorization but obtain information in particular areas—such as files, folders, or databases—that are off-limits to them. The case concerned an officer who used a valid database credential for a purpose barred by department policy; the Court focused on access to information areas the user was not entitled to reach.

“An individual ‘exceeds authorized access’ when he accesses a computer with authorization but then obtains information located in particular areas of the computer—such as files, folders, or databases—that are off-limits to him.”
That is the Court’s formulation in the Van Buren syllabus. It helps explain why violating a rule about how to use an account is not necessarily the same as entering an area or obtaining information the user is forbidden to access.

Does breaking a game or website’s terms make botting a crime?
Not by itself under the federal CFAA’s “exceeds authorized access” provision, according to the Department of Justice’s charging policy. The DOJ Justice Manual’s CFAA guidance says federal prosecutors will not bring such a case based solely on violating a public website or web service’s contract or terms of service. Its guidance focuses on computationally divided areas—such as files, accounts, or databases—that a person is unconditionally prohibited from accessing, with knowledge of the relevant restriction.
This is DOJ policy for federal charging decisions, not a court ruling that platform rules have no consequences. A game or service may still suspend or close an account, and contract claims, state law, or other legal consequences may be relevant depending on the facts. The Justice Manual says its provisions guide government attorneys and do not create an enforceable right for litigants.

Ticket bots have a specific federal law
The BOTS Act, codified at 15 U.S.C. § 45c, addresses a particular kind of automation: circumventing a security measure, access-control system, or other technological control used by a ticket issuer to enforce posted ticket purchase limits or preserve the integrity of posted online ticket-order rules. The statute also covers certain interstate sales or offers of tickets obtained through that circumvention when the seller participated in, controlled, or knew or should have known of the violation.
The FTC’s plain-language explanation describes the law as prohibiting circumvention of ticket-purchase controls. The statutory text defines the precise scope; this ticket-specific law should not be treated as a general rule about game bots or every type of automated purchasing.

A practical way to assess a botting scenario
These questions can help identify what facts matter, but they are not a legal test that decides an individual case:
- Authorization: Was the user allowed to access the computer or account, and had access been revoked or limited?
- Access boundary: Did the bot reach data, accounts, or system areas the user was not entitled to access?
- Conduct and intent: Did it obtain or alter information, further fraud, or knowingly circumvent a technological control?
- Effect: Did it impair system or data integrity or availability, or cause legally relevant loss?
- Specific law and jurisdiction: Does a law such as the BOTS Act apply, and which state law or other rules are relevant?
Because botting can involve different conduct and laws, a concrete allegation, investigation, or threatened claim calls for advice from a lawyer licensed in the relevant jurisdiction.
