There is no blanket yes-or-no answer. The legal risk depends on what the port contains, how it works, and which country’s law applies. A port that includes a Nintendo game file or reproduces Nintendo code or other protected material raises different questions from independently written software. Safety is separate: no source cited here evaluated any particular port or executable, so none can be called safe on that basis.
Start by checking what the download actually contains
“PC port” can describe very different things: a package containing a Nintendo game file, software that reproduces parts of the game, or an emulator or other tool used with a game file. Those distinctions matter. A download’s label or the fact that it runs on a computer does not establish that it is authorized.

Why a bundled ROM creates a significant copyright issue
Nintendo’s Intellectual Property & Piracy FAQ says that downloads of Nintendo game files through third-party links or peer-to-peer networks are unauthorized copies, and states: “The uploading and downloading of pirate copies of Nintendo games is illegal.” That is Nintendo’s official position. WIPO’s 2022 legal analysis separately explains that making a ROM duplicates the whole video game and says unauthorized copying would infringe reproduction rights in most jurisdictions. The WIPO statement is broad legal analysis, not a ruling about every country or every individual download.
Nintendo identifies its eShop and Nintendo website as legitimate channels for downloading its console games. A file hosted elsewhere is not made authorized merely because it is described as a backup, fan project, or port.

A port without a ROM can still raise copyright questions
Not bundling a game file removes one important issue, but it does not by itself make a port lawful. Nintendo identifies source and executable code, visual displays, music, characters, manuals, artwork, and publications among material protected by intellectual-property rights. A port that reproduces such material may raise copyright questions even if users must obtain a game file separately.
Nintendo’s Game Content Guidelines for Online Video & Image Sharing Platforms, updated September 2, 2024, address specified sharing of gameplay footage and screenshots. They are not a general license for fan-made PC ports: the guidelines say that other uses are governed by applicable law. Nintendo also says it cannot give legal advice and recommends seeking legal counsel about a particular proposed use.

Emulators and bypassing protection are separate issues
An emulator is not the same thing as a ROM, and it is too broad to say that every emulator is illegal. The relevant questions include whether the emulator or related conduct bypasses a technological protection measure and whether the software is used to copy or access protected material without authorization.
For the United States, the Copyright Office’s overview of the Digital Millennium Copyright Act says section 1201 “prohibits circumventing technological protection measures (or TPMs) used by copyright owners to control access to their works.” It also covers trafficking in certain circumvention technologies. This describes U.S. federal law; it should not be treated as a universal rule for every country or as a court ruling on every emulator.

Does owning the Nintendo game make the PC download lawful?
Ownership of a cartridge or digital copy does not, by itself, establish that a separate ROM download or unofficial port is authorized. The sources cited here do not settle every backup, personal-copying, or ownership scenario. The answer depends on the relevant country’s law and on what the particular port and download do; do not assume that owning the console game resolves those questions.

Not from the word “port,” a download page, or the legal status of the project. No source cited here examined a named port or its executable for malware, so there is no file-specific safety assessment to rely on.

CISA’s 2020 “Emotet Malware” advisory recommends scanning software downloaded from the internet before executing it. A scan is a precaution, not a guarantee that malware will be detected or that a file is safe. In practice, avoid running unknown executables or installers and avoid password-protected archives from sources you cannot verify. Prefer official download channels and keep reputable security protections enabled.
A practical check before you download
- Identify the files. Check whether the package includes a ROM or another Nintendo game file, rather than relying only on the project’s description.
- Check for Nintendo material. Look for claims that the port includes or reproduces Nintendo code, graphics, music, characters, or other game content.
- Consider circumvention. Determine whether using the download requires bypassing a protection measure; U.S. section 1201 may be relevant when U.S. law applies.
- Assess the source and the file separately. A reputable-looking page does not prove the executable is safe. CISA recommends scanning downloaded software before running it, but that does not certify it.
- Apply the law where you are. Nintendo’s stated policy, WIPO’s general analysis, and the U.S. Copyright Office’s explanation do not decide every country-specific or port-specific case.
Lower-risk way to get a Nintendo game
If you want to play the Nintendo game rather than take the legal and security uncertainty of an unofficial PC port, use Nintendo’s eShop or Nintendo website for authorized console-game downloads. Nintendo identifies those as legitimate download channels; that does not mean Nintendo endorses a third-party PC port.
