Downloading an unauthorized complete copy of a game can infringe copyright. Downloading a mod is a separate question: a mod may use only new material, or it may copy the game’s code, graphics, music, or other protected content. Your country, the mod’s authorization and contents, the game’s terms, and whether installation bypasses access controls can all matter.
First, distinguish the game from the mod
A complete game copy and a modification file are not legally interchangeable. The U.S. Copyright Office says that downloading protected works without the copyright owner’s authority infringes the owner’s reproduction and/or distribution rights. That warning applies to unauthorized copies of games; it does not decide the status of every mod.
A mod can be made without copying protected game elements, but many mods incorporate elements such as game code or altered original graphics. Whether a particular mod copies protected expression, and whether its use is authorized or covered by an exception, depends on the facts.
What the rules say in the United States
Copyright and mods
Under 17 U.S.C. § 106, copyright owners have exclusive rights to reproduce protected works, prepare derivative works, and distribute copies, subject to statutory limitations and exceptions. A mod that copies protected game material may raise copyright issues. The label “mod” alone does not establish whether it is lawful.

Downloading a complete game
The U.S. Copyright Office states: “Uploading or downloading works protected by copyright without the authority of the copyright owner is an infringement of the copyright owner’s exclusive rights of reproduction and/or distribution.” Whether a work is available with the owner’s authority is a question of fact.
The Office describes possible statutory damages of up to $30,000 per infringed work, or up to $150,000 per work if willful infringement is proven, as well as possible attorney’s fees. These are potential remedies, not automatic charges or penalties for every download.

Bypassing DRM
U.S. law also restricts circumvention of technological measures that control access to copyrighted works. That is a distinct issue from whether the mod itself copies protected content. A narrow exemption in the current regulation covers certain lawfully acquired games when a publisher or its representative has stopped providing an external server needed for authentication, for specified local-playability or institutional preservation purposes. It is not a general permission to bypass DRM to install mods.
What the rules say in the United Kingdom
Section 50C of the Copyright, Designs and Patents Act 1988 allows a lawful user of a computer program to copy or adapt it when that is necessary for lawful use and is not prohibited by a term governing the circumstances of lawful use. The section gives error correction as an example; it does not grant blanket permission to download any mod or redistribute protected game material.

UK government guidance also says that technological protection measures are protected under UK and EU law and describes circumvention as illegal. So a mod’s copyright status and the method used to access or install it need separate consideration.

- Identify what you are downloading. Is it a mod file for a game you obtained lawfully, or a complete copy of the game? The latter raises a different and more direct copyright concern.
- Check authorization and provenance. Look for the publisher’s current mod policy or an official workshop or publisher-approved source. An unfamiliar mirror does not establish that the owner authorized the download.
- Consider what the mod contains. New, independently created material presents a different copyright question from a mod that includes copied game code, art, music, or other protected content.
- Check the access method. Ordinary installation is different from bypassing DRM or another technological protection measure, which can create a separate legal issue.
- Review the game’s current terms and use context. Online or competitive play may involve separate publisher or platform rules. The legal materials summarized here do not establish any particular game’s current policy.
- Apply the law of your location. The U.S. and UK rules above are not a worldwide answer. Other countries may treat these issues differently.
Owning the base game, downloading a mod for free, using it privately, or seeing no objection from the publisher does not by itself establish that every mod is lawful. For a specific legal conclusion, the relevant jurisdiction, mod, download source, and game terms would need to be assessed together.
