In the United States, writing emulator software, copying a game or firmware, bypassing security, and using PS5 system software are separate issues. A narrow court ruling about an original PlayStation emulator does not decide whether a particular PS5 emulator or game copy is lawful.
This is a general explanation of US law and Sony’s US system-software terms, not legal advice about a particular person’s conduct. Other countries may apply different laws.
Is PS5 emulation legal?
It depends on what is being done. An independently written emulator is not the same thing as a copy of a copyrighted game or Sony firmware. Copying, circumventing an access control, and using system software may raise distinct legal or contractual questions.

Is a PS5 emulator itself illegal?
The existence of an emulator does not, by itself, answer every legal question about its development, distribution, or use. The closest cited US precedent is Sony Computer Entertainment, Inc. v. Connectix Corp., a Ninth Circuit case from 2000 about the original PlayStation, not the PS5.

Connectix reverse engineered the original PlayStation BIOS while developing Virtual Game Station. The court treated certain intermediate copying needed to reach functional elements as fair use in the circumstances before it, explaining: “We conclude that intermediate copying in this manner was ‘necessary’ within the meaning of Sega.” That holding is relevant to the possibility that some emulator development can involve lawful intermediate copying; it does not decide the legality of PS5 emulator code, any current project, or the game and firmware copies an end user might obtain.
Is downloading PS5 ROMs legal if I own the game?
The cited US authorities do not establish a blanket “own the disc, download the ROM” rule. Owning a physical game is relevant context, but it does not by itself establish permission to download a separate copy, reproduce copyrighted code, or bypass an access control. Each act may raise a different question.

Section 1201 of the US Copyright Act generally prohibits circumventing a technological measure that effectively controls access to a copyrighted work. It includes an interoperability provision, but that provision is conditional: among other requirements, a person must have lawfully obtained the right to use the program, the analysis must concern elements needed for interoperability with an independently created program that are not readily available, and the acts must not infringe copyright. It is not a general authorization to acquire game files or defeat protections. Read the statute.
Can I use my PS5 game disc on an emulator or dump a copy?
A disc purchase does not settle whether extracting, copying, or downloading game data for an emulator is permitted. The available sources do not establish a general personal-use exemption that makes those steps lawful whenever the user owns the game. The answer can depend on the particular copying and any access-control circumvention, as well as applicable law.

Does Sony allow PS5 firmware to be used in an emulator?
Sony’s US PS5 System Software License Agreement grants a non-exclusive, non-commercial right to use system software solely on a PS5 system. It also restricts, among other things, using tools to bypass, disable, or circumvent PS5 encryption, security, or authentication mechanisms; using unauthorized or pirated software with system software; and obtaining system software outside Sony-authorized distribution methods. Sony states that its most current agreement supersedes prior versions; the search result identifying the agreement cited here showed version 1.12. Check the agreement itself for its current wording.
In the agreement’s words: “Subject to this Agreement’s terms, SIE Inc grants you a non-exclusive, non-commercial right to use System Software solely on your PS5 system.” These are license terms, not a judicial determination of how every provision applies in every circumstance. Do game-preservation exceptions make PS5 emulation legal?
US rules adopted through the Copyright Office’s triennial process provide limited, conditional exemptions, not a general emulation or downloading permission. One provision covers certain lawfully acquired complete games when external authentication-server support has ended, for restoring personal local gameplay. Separate provisions apply to eligible libraries, archives, and museums under conditions that include no direct or indirect commercial advantage and limits on making a game available outside the institution’s physical premises.
These provisions are not a general exception for ordinary supported PS5 games or arbitrary downloads. Eligibility and permitted acts depend on the regulation’s detailed definitions and conditions. The Copyright Office explains the limited-exemption process, and the regulation sets out the applicable terms: 2024 Section 1201 proceeding and 37 C.F.R. § 201.40.
