What is the difference between a MIG Switch and a modchip?

Nintendo’s Portuguese-language FAQ expressly calls pirate game cards such as MIG Switch/MIG Flash “dispositivos de evasão” (“circumvention devices”). That is Nintendo’s policy position, not a court ruling about every individual circumstance.
Is either one the same as backing up a game to a microSD card?
No. A microSD card is storage; it does not by itself copy a Switch cartridge or make a cartridge-copying method authorized. Nintendo’s microSD data-copy support page explains copying the Nintendo folder from an existing card to a computer and then to a new card. It also documents an alternative involving reformatting, redownloading software and additional content, and copying screenshots and videos. This is ordinary console data management, not a guide to dumping a game card.
If the need is to move supported data to another card, use Nintendo’s documented process rather than treating a MIG device or a modchip as a storage upgrade. Nintendo’s Switch terms of use describe software as licensed rather than transferred and list restrictions concerning copying or modifying software and unauthorized console modifications, accessories, or software. The terms also say updates may be required and may change or disable system components or data. Contract interpretation and applicable local law can vary.

What does the law say about MIG Switch devices?
United States: allegations in a 2024 complaint
In a complaint filed June 28, 2024, Nintendo of America Inc. v. Ryan Michael Daly, Nintendo alleged that MIG Switch and MIG Dumper devices were used to circumvent protections and enable unauthorized copying or playing. A complaint records the plaintiff’s allegations; it is not itself a court finding. The complaint copy does not establish a general legal rule for every U.S. private backup or every possible use.
Netherlands: a decision about a retailer’s sales
A legal report published September 14, 2026, reproduces an excerpt attributed to the District Court of The Hague’s September 2, 2026 decision, ECLI:NL:RBDHA:2026:25479. The report says the court found that the defendant acted unlawfully under Dutch law and infringed Nintendo copyrights by offering and selling MIG Switch cards and dumpers intended to circumvent technical measures. It also says the seller acknowledged sales during September–December 2024. This is a case about that defendant’s commercial offerings; it should not be generalized into a ruling on all private backups in the Netherlands, the EU, or elsewhere. Can you compare reliability, bans, or safety?
Not from the cited evidence. It provides no controlled comparison of console failure rates, performance, or online-ban likelihood, and no population statistics for either method. Nintendo’s warnings describe possible consequences of unauthorized devices, not how often each consequence occurs or which device is more likely to cause it. A claim that a MIG Switch is more reliable, faster, safer, or less likely to trigger an online restriction than a modchip would go beyond what these sources establish.
