Rep. Ritchie Torres (D-NY-15) announced on October 15, 2026, that he plans to introduce the Power To The Players Act, a federal proposal aimed at changing what consumers receive when they buy a video game. The measure would direct the Federal Trade Commission (FTC) to create rules recognizing three rights: the right to own a purchased game, the right to keep playing it, and the right to transfer it.
The announcement describes a proposal, not an enacted law. At the time of the announcement and contemporaneous reporting, no formal bill number or statutory text was available.

What the Power To The Players Act would change
Torres’s proposal is built around the idea that paying for a game should create ownership rather than only a revocable license. Today, digital purchases are commonly governed by platform and publisher terms that can limit how a game is accessed, particularly when accounts, authentication systems or online services are required. The proposed legislation would instruct the FTC to establish consumer-protection regulations addressing that problem.
The right to own
The first principle would treat a purchased video game as something the buyer owns. Torres summarized his position in a reported interview with a simple rule: “if you pay for it, you own it.” His congressional announcement made the same argument, saying a game that can disappear when a company ends support resembles a rental disguised as a sale.

The right to play
For games that include online functionality, the proposal says an offline mode would have to be available before the supporting servers are shut down. That requirement is intended to preserve access to the purchased game after network services end. The announcement does not yet define what features an offline mode must retain, whether every mode must remain playable, or how games that were designed exclusively for online use would be treated.
The right to transfer
The third principle is a right to transfer, including the ability to preserve resale or hand a game to someone else. The stated goal is to let players continue using games with friends and family after a company moves on. The proposal does not yet specify how digital transfers would work across accounts, storefronts, platforms or regions.

Why NBA 2K25 is the example in the announcement
The congressional release uses NBA 2K25 to illustrate the concern. It lists the standard edition at $69.99 and the All-Star Edition at $99.99, with both prices attributed to the Office of Rep. Ritchie Torres in 2026. The release says the game was scheduled to be delisted from digital storefronts on October 30 and that its online servers were scheduled to shut down on December 31, roughly two years after release.

Would it let you resell a digital game?
The proposal presents transfer and resale as rights, so its intended effect is broader than merely allowing a player to keep a game installed. However, no implementation language was available when Torres announced the bill. That leaves open whether a transfer would move a complete license, a copy tied to an account, or another form of digital entitlement, and whether publishers could impose technical safeguards against duplicate use.
Those details matter because a digital transfer system must determine who can access the game after the transaction and how downloadable content, patches, saved data and platform entitlements are handled. The announcement establishes the policy direction, not the mechanism.

What happens to a game when servers shut down now?
Under the proposal’s stated approach, a game with online functionality would need an offline mode before its supporting servers are retired. Until regulations exist, that outcome is not guaranteed by this announcement. The practical result for any particular game still depends on its design, storefront rules, publisher terms and the services required to start or play it.

The Power To The Players Act is intended to make preservation of playable access a legal requirement, but the scope of that preservation awaits formal text.

What the bill does not cover
Coverage of Torres’s proposal says it is limited to video games rather than movies or music. Torres has indicated that a successful video-game rule could provide a precedent for other digital purchases, but those products are not included in the announced scope.
What to watch next
- Formal introduction of the bill and assignment of a bill number.
- Statutory definitions of ownership, transfer, resale and offline play.
- Rules for games containing licensed music, sports leagues, characters or other third-party material.
- FTC implementation details, including timing and enforcement.
- Congressional support and whether the proposal advances beyond introduction.
Until those steps occur, the announcement is a policy proposal rather than a new consumer right. Players who bought digital games do not gain an automatic federal ownership guarantee from the October 15 statement alone.
