The case involved allegations that Viggiano passed confidential financial information to associates, followed by guilty pleas reported by the Justice Department.
Who said “there’s no tracing Xbox 360 chat”?
The speaker was Anthony Viggiano, according to a transcript included in the September 28, 2023 indictment. In a conversation with Christopher Salamone after FBI interviews in or about June 2023, Viggiano said: “Because similar to you . . . signal, or like XBOX 360 chat, there’s no tracing that. Good luck ever finding that.” The indictment reproduces the statement as part of the recorded conversation.
It is a remark attributed to Viggiano, not an independent technical finding about Xbox 360, Microsoft’s data retention, or law-enforcement access. The official records cited here do not establish what Xbox chat data, if any, was stored or retrievable.
Did investigators trace or recover Xbox 360 chat logs?
The cited indictment and Justice Department announcements do not say that investigators recovered, traced, or subpoenaed Xbox 360 chat logs, or that such logs exposed the scheme. The indictment provides no basis for treating Viggiano’s confidence in the conversation as a verified description of the service.

The Justice Department’s September 2023 charging announcement says Forlano allegedly passed information to friends and family, among other means, through a video-game console’s audio-chat function. That is an allegation about a communication method; it does not establish that prosecutors obtained the specific Xbox 360 communications. The announcement does not identify recovered console logs as evidence.
What was the insider-trading case about?
Prosecutors alleged that Viggiano, a former employee of two financial firms, used confidential information about potential transactions to tip Salamone and Stephen Forlano, who then traded securities. The indictment describes communications about trades and reproduces the conversation containing the Xbox line; its allegations should be distinguished from facts established by later pleas.

On January 11, 2024, DOJ reported that Viggiano and Forlano pleaded guilty to securities fraud. Salamone had pleaded guilty earlier, on September 21, 2023. The later plea announcement says Viggiano tipped his associates ahead of at least eight transactions involving publicly traded companies. DOJ’s plea announcement describes the case after those pleas.
What DOJ reported about profits
- DOJ said Viggiano and Salamone agreed to split profits, yielding total illegal profits of over approximately $300,000.
- DOJ said Forlano himself illegally profited at least approximately $100,000.
These are figures reported by the U.S. Attorney’s Office for the Southern District of New York, not independent audit figures established by the records cited here.

What the Xbox detail does—and does not—show
The case connects a video-game console audio-chat function to prosecutors’ account of how information was allegedly passed. It does not establish that Xbox 360’s chat was technically untraceable, that chat records were recovered, or that the console communications were how investigators uncovered the conduct. The “no tracing” line is relevant as part of the recorded conversation, not as a verdict on the technology.
The September 2023 announcement quoted then-U.S. Attorney Damian Williams saying, “No matter how evasive insider traders’ conduct, or the lengths gone to hide their offenses, this Office will track down and prosecute those who attempt to cheat the system.” That is the office’s statement about prosecution, not evidence of a particular investigative method.
