The answer depends on what you copy or change, why and how you decompile it, whether you bypass access controls, the game’s terms, and the law where you are. Copyright, anti-circumvention law, and contract terms are separate questions; satisfying one does not automatically settle the others.
Why do decompiling and modding raise separate legal questions?
Decompiling means translating or examining compiled program code to learn how it works. Modding means changing a game or adding content or functionality. A project may involve both, but neither word describes a single legal act: a mod might use original code, reproduce game assets, change files without decompiling, or depend on bypassing a technical access control.

Assess three issues independently: whether the project reproduces or adapts protected expression; whether the method of access or inspection violates an anti-circumvention rule; and whether the game’s license, platform rules, or other terms allow the conduct. What parts of a game can copyright protect?
A game is not just its executable code. A mod may use or alter source or object code, graphics, music, dialogue, text, characters, or other expressive material. In the United States, the Copyright Act gives owners exclusive rights that include reproducing a work and preparing derivative works, subject to statutory limits. Whether a particular mod exercises one of those rights depends on what it uses and how.
The EU Software Directive distinguishes a program’s protected expression from the ideas and principles underlying its elements, including interfaces. That software-specific rule does not mean that a game’s graphics, music, story, or other expressive content are unprotected. The directive does not turn a game’s general concept or mechanics into a blanket permission to copy its assets or code.

When can a program be decompiled under EU software rules?
Article 6 of Directive 2009/24/EC provides a limited route to decompilation without the rightsholder’s authorization. It applies only where reproducing code or translating its form is indispensable to obtain information necessary for interoperability between an independently created program and other programs, and the conditions below are met. It is not a general exception for making gameplay mods.

- The person doing the work, or the person on whose behalf it is done, is entitled to use a copy of the program.
- The information necessary for interoperability is not already readily available.
- The work is confined to the parts of the original program necessary to achieve interoperability.
- The information obtained is not used for a different purpose, improperly disclosed, or used to develop a program substantially similar in its expression or to commit another copyright infringement.
Article 5(3) separately allows a person entitled to use a copy to observe, study, or test the program’s functioning, while performing acts that person is entitled to perform, to identify the ideas and principles underlying program elements. The directive also addresses necessary use and backup copies. These are specific provisions, implemented through national law; they should not be read as authorization for every kind of decompilation, mod creation, or distribution.
What does U.S. anti-circumvention law add?
Copyright infringement and circumvention are distinct legal questions. Section 1201 of the U.S. Digital Millennium Copyright Act generally prohibits circumventing technological measures used to control access to copyrighted works, including games and software. The Copyright Office describes a recurring process through which the Librarian of Congress may adopt limited, temporary exemptions for particular classes of noninfringing use. An exemption applies only within its stated class and conditions; a conclusion that a use does not infringe copyright does not, by itself, establish that bypassing an access control is permitted.
What the current video-game exemption covers
The video-game regulation described by the U.S. Copyright Office is narrow. It covers specified conduct involving a lawfully acquired complete game that depends on an external authentication server when the rightsholder or its representative has ceased providing that access. It permits limited circumvention for personal local gameplay restoration and certain preservation by qualifying libraries, archives, or museums, subject to conditions that include restrictions on commercial advantage and external distribution for the institutional provision.
That exemption is not a general authorization to bypass an operating online service, enable ordinary mods, or distribute game copies. Check the regulation’s exact conditions before relying on it; the fact that a project involves preservation or a game whose server has shut down does not alone establish that the exemption applies.

Not automatically. Section 107 of the U.S. Copyright Act calls for a case-by-case assessment of four factors. A mod’s being free or noncommercial may be relevant, but neither fact decides the outcome.

The statute lists examples such as criticism, comment, teaching, scholarship, and research, but fitting a category does not automatically make a particular mod fair use. Nor does calling a project transformative or educational replace the full factor analysis.

Owning or being entitled to use a copy can matter to particular legal exceptions, but it is not a blanket license to extract, adapt, or distribute the game’s code or assets. Check the specific game’s end-user license agreement, mod policy, and the relevant platform’s rules. Those terms may address reverse engineering, modifications, online play, or sharing; what they say and whether they are enforceable depend on the particular terms and applicable law.
Distribution can raise issues beyond private experimentation. Sharing a mod that contains game code, art, music, text, or other protected expression presents a different set of facts from making a change for personal use. Selling or monetizing a mod adds further facts to consider; neither free distribution nor private use alone determines legality.
How should you assess a specific decompilation or mod project?
Before starting or distributing a project, write down the relevant facts rather than relying on a general claim that “mods are legal” or “decompilation is illegal.” These questions identify the issues to investigate; they do not themselves decide the result.
- Identify the jurisdiction. Determine which country’s law may apply to your conduct and distribution. The EU directive and U.S. statutes discussed above are not universal rules.
- Confirm your access and the game’s terms. Establish whether you are entitled to use the copy and review the game EULA, mod policy, and platform rules.
- Describe the purpose precisely. Distinguish interoperability, observation or study, preservation, repair, and gameplay modification. The EU decompilation exception, for example, is tied to interoperability of an independently created program.
- Identify what you will copy or change. Separate program code from graphics, music, text, characters, and other expressive assets. Record whether the mod includes material from the original or merely interacts with it.
- Check for access controls. Determine whether the process bypasses a technological measure controlling access. In the U.S., analyze section 1201 separately from copyright infringement and verify that any claimed exemption covers the user, purpose, and conditions at issue.
- Decide whether and how you will share it. Private use, public release, online play, and sale present different facts. Consider the material included, amount used, market effects, and applicable terms.
If you need to decide whether a particular project can safely proceed, especially before releasing or monetizing it, consult a lawyer familiar with copyright and the law in the relevant jurisdiction. A concrete answer requires the game, location, access method, material used, and intended distribution.
