A U.S. private-sector union campaign usually moves through several possible stages: coworkers discuss shared concerns, support is organized, authorization cards document interest, and the union either seeks voluntary recognition or files a petition for a secret-ballot election through the National Labor Relations Board (NLRB). The NLRB investigates the petition, resolves disputes about the bargaining unit and voter eligibility, and arranges a vote when the legal requirements are met. A union wins an election with a majority of votes cast—not by merely reaching the 30% petition threshold.
The sequence is not mandatory and the timetable is not fixed. Some campaigns end with voluntary recognition before an election; others involve hearings, objections or challenged ballots. This overview describes the NLRB process most relevant to private-sector workplaces, including video-game studios, publishers, quality-assurance teams and other game-industry employers when they fall under the agency’s jurisdiction.

What this process covers
The NLRB process applies to many U.S. private-sector employees, but not every worker or employer. Coverage can depend on the employer, the employee’s status and other jurisdictional rules. Construction work has special considerations, and public-sector employees generally use different labor-relations systems. If a specific workplace is unsure whether the Act applies, the relevant NLRB Regional Office or a qualified labor attorney can address that case’s facts.
“Campaign” describes the period in which workers and a union build support, while an employer and employees who oppose representation communicate their views. The NLRB is a neutral administrator of the representation process; it does not endorse a union or an employer’s position.

1. First conversations: identifying common concerns
Organizing often starts informally. Coworkers may compare experiences about pay, benefits, schedules, staffing, safety, workload, job security or how workplace decisions are made. In a game workplace, conversations might involve release deadlines, overtime practices, remote-work policies, credit for creative work or the treatment of contractors and temporary staff. These are examples of subjects employees might discuss, not a required agenda or proof that any particular employer has violated the law.
Employees may contact an established union, speak with a union organizer or explore representation on their own. The NLRB’s employee guidance recognizes rights to discuss unionization and, in protected circumstances, solicit authorization cards. Employees also have the right not to participate, to oppose a union and to campaign against representation. Lawful, nondiscriminatory workplace rules can affect where and when solicitation or distribution may occur, so a rule must be assessed in context rather than assumed valid or invalid.
No compulsory script
There is no NLRB-required sequence of meetings, number of supporters or organizer involvement. A campaign can begin with a small group of coworkers, with an outside union, or with both. Early participants commonly test whether concerns are shared, explain what collective bargaining could change and decide whether to seek broader support.
2. Building support and using authorization cards
Authorization cards are written or electronic statements that an employee wants a union to represent the proposed bargaining unit. Organizers use them to measure support and, in some situations, to present evidence for voluntary recognition. A card is not the same thing as a secret-ballot vote: signing one does not automatically cast an election ballot, and an employee’s views can change before an election.
For an NLRB election petition, the union must show interest from at least 30% of employees in the proposed bargaining unit. This is a gateway to agency consideration, not the percentage needed to win. The NLRB states the distinction plainly:

“If a majority of workers wants to form a union, they can select a union in one of two ways: If at least 30% of workers sign cards or a petition saying they want a union, the NLRB will conduct an election.”
In an election, the union generally must receive a majority of votes cast. That is a majority of participating voters’ valid votes, not 30% of everyone employed and not necessarily a majority of the entire workforce.
3. Two routes to representation
Once support is substantial, there are two principal ways a union can become the representative.
| Feature | NLRB representation election | Voluntary recognition |
|---|---|---|
| Decision-maker | Eligible employees decide through a secret-ballot election administered under NLRB procedures. | The employer decides whether to recognize the union after receiving evidence of majority support, typically authorization cards. |
| Support evidence | At least 30% showing of interest in the proposed unit is required to move a qualifying petition toward an election. | Evidence that a majority of employees in the unit wants representation is presented to the employer. |
| Agency process | Petition, investigation, notice, agreement or rulings on the unit and voter issues, then an election and possible post-election proceedings. | Recognition occurs outside the NLRB election process, although NLRB rules can affect notice and when an election petition may be filed afterward. |
| How representation is established | The union is certified if it wins a majority of votes cast. | The employer’s recognition establishes the bargaining relationship, subject to applicable legal conditions. |
| Secret ballot | Yes. | No NLRB secret-ballot election is held as part of the recognition decision. |
Voluntary recognition is not an employer obligation. An employer may accept majority evidence, or the union may proceed by petitioning for an election if the legal requirements are met.
4. Filing an NLRB petition and the agency’s investigation
A union seeking an election files a petition with the appropriate NLRB Regional Office. Agency staff investigate threshold questions, including whether the NLRB has jurisdiction, whether the union is qualified to appear, whether an existing collective-bargaining agreement or a recent election bars another election, and which employees belong in the proposed bargaining unit.

Notice to employees and the employer
After a petition is filed, the employer must post a Notice of Petition for Election. The notice must also be distributed electronically when the agency’s rules require that method. The notice gives employees information about the petition and the process so they can understand that a representation case is pending.

Defining the bargaining unit
The parties and NLRB agents try to agree on the group of employees who share a community of interest for bargaining purposes. In a game company, that could involve questions about developers, artists, designers, producers, quality-assurance staff, support personnel, supervisors and temporary workers. Job titles alone do not decide eligibility; the agency applies the facts and the governing standards to the proposed unit.
Agreeing on election details
Where possible, the parties and the agency agree on ballot language, voter eligibility, and the election’s date, time and place. The arrangement may include in-person or other authorized voting logistics. If the parties cannot resolve the unit or another material issue, the Regional Director can hold a pre-election hearing and issue a decision explaining whether, and under what conditions, an election will be directed.
The current procedural framework
For petitions filed on or after December 26, 2023, the NLRB’s representation-case rule restored procedural provisions first adopted in 2014 and changed hearing scheduling, notice timing, election details and treatment of some eligibility questions. The current framework is described in the agency’s Representation Case Procedures page. Older “quick election” charts should not be treated as a guaranteed schedule for a current case.
5. The campaign before the vote
During the campaign, union supporters and opponents present arguments to employees. Employees may discuss unionization, distribute literature in protected circumstances, attend meetings and decide whether to campaign actively, remain neutral or oppose representation. Participation is voluntary; an employee does not have to sign a card, attend a meeting or speak publicly.

What employers may and may not do
Employers may communicate their views about unionization and answer questions, but the NLRB’s employer guidance prohibits threats of adverse consequences and promises of benefits intended to influence the choice. Other conduct can unlawfully interfere with free choice, depending on the facts and timing. A statement, policy change or meeting should therefore be evaluated in context rather than labeled lawful or unlawful from a slogan alone.
Employees who believe conduct interfered with their rights can ask the NLRB about filing an unfair-labor-practice charge. A party can also raise election objections when conduct may have affected the vote. The agency, not an online campaign checklist, determines whether the facts support a remedy.
Rights on both sides
- Employees may support organizing, sign or decline to sign authorization cards, and discuss workplace concerns.
- Employees may campaign against representation or choose not to participate.
- Union representatives and employees must follow lawful workplace access, solicitation and nondiscrimination rules.
- Employers cannot use threats or promises to force a choice, and employees cannot be compelled to support a union.
The NLRB summarizes these protections in its employee-rights guidance and its employer guidance.

After the Regional Director authorizes an election or the parties complete an agreement, the NLRB generally schedules the vote for the earliest practicable date. “Earliest practicable” is not a fixed number of days. Unit disputes, voter-eligibility questions, litigation, requests to postpone and allegations of interference can change the schedule. The Conduct Elections page explains the agency’s current process.

The ballot asks eligible employees whether they want the named union to represent them for collective bargaining. Employees who are eligible but whose status is disputed may have their ballots challenged. Depending on the number and effect of those challenges, the Regional Director may need additional proceedings before the result is final.

7. What the result means
If the union wins
If the union receives a majority of votes cast, the NLRB certifies it as the employees’ representative. The employer then has a duty to bargain over wages, hours and other terms and conditions of employment. Certification does not instantly produce a contract or guarantee that every proposal will be accepted; bargaining is the next legal stage.
If the union does not win
If the union fails to receive a majority of votes cast, there is no certification based on that election. A party can file objections alleging conduct that affected employees’ free choice. The agency may investigate, order additional proceedings or provide another remedy when the legal standard is met.
8. How voluntary recognition changes the path
When an employer recognizes a union after receiving evidence of majority support, no NLRB election is held as part of that recognition. The parties move into bargaining, subject to the agency’s rules governing notice and when an election petition may be filed. The NLRB’s election guidance describes a reasonable period for bargaining after voluntary recognition as at least six months and no more than one year after the first bargaining session, under the conditions the agency explains. That period is not the length of an organizing campaign; it concerns the bargaining relationship after recognition.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problems9. Why no reliable “typical campaign length” exists
The official NLRB pages provide legal thresholds and procedural steps, not a measured national average for how long campaigns last, how common they are or how often unions win. A campaign can move quickly when the unit and election arrangements are uncontested, or take longer when jurisdiction, eligibility, unit scope or conduct is disputed. The agency’s earliest-practicable-date standard and the possibility of hearings or objections make a single promised timeline misleading.
| Stage | What can affect the timing |
|---|---|
| Initial conversations and support building | The number of employees involved, access to coworkers, internal decisions and whether a union is contacted. |
| Petition review | Jurisdiction, union qualification, contract or election bars and the proposed bargaining unit. |
| Pre-election arrangements | Agreement or disagreement over ballot language, voter eligibility, election logistics and hearing issues. |
| Voting and certification | Challenges, objections, requests to postpone and any post-election review. |
10. Practical questions for employees in game workplaces
Who is likely to be in the unit?
Do not assume every person who works for a studio votes. The proposed unit may distinguish employees from independent contractors, supervisors or other categories excluded by law. The NLRB determines eligibility under the facts of the case.
Can remote or distributed teams participate?
Remote work does not by itself answer whether an employee is eligible or how voting will occur. The parties and the Regional Office determine the unit and authorized election arrangements, including notice and voting logistics.
What should someone do after signing a card?
Read the card’s language and understand what it authorizes. Signing documents support for organizing, but it is not an NLRB secret-ballot vote. Employees retain the right to ask questions, support or oppose the union, and seek information about the process.

Quick Recap
11. The central distinctions to remember
- Thirty percent is a petition threshold. It shows enough interest for a qualifying NLRB election petition; it does not win representation.
- A majority of votes cast determines an election. The denominator is ballots cast in the election, not every employee on the payroll.
- Cards and ballots are different evidence. A card signer has not automatically voted in an election.
- Recognition and election are separate routes. Voluntary recognition depends on employer acceptance of majority evidence and does not include an NLRB secret ballot.
- There is no guaranteed campaign timetable. Agency review, disputes and post-election proceedings can change the sequence and duration.
