What Nintendo’s 2022 Joy-Con Drift Lawsuit Dismissal Actually Decided

Nintendo’s 2022 win in Sanchez dismissed the minors’ claims for lack of standing. The order did not decide whether Joy-Con drift was a defect, and the parents’ claims were stayed for arbitration.

Nintendo won dismissal of the minor plaintiffs’ claims in Sanchez v. Nintendo of America Inc. in September 2022, but the ruling was about standing—not whether Joy-Con drift was a product defect. The parents’ claims were stayed for arbitration, so the order did not resolve the entire dispute on its merits.

What did the court dismiss?

On September 7, 2022, the U.S. District Court for the Northern District of California dismissed the minors’ claims in Sanchez v. Nintendo of America Inc. for lack of standing. The judge found that the complaint did not adequately allege that the minors owned the Switch; it alleged, at most, access to or shared possession of the console. In the circumstances pleaded, that was not enough to allege injury in fact. The order put it this way: “The minors’ use did not make them owners.” Read the court order.

The court denied the plaintiffs’ brief request for leave to amend as it had been presented, while allowing them to seek leave through a further motion noticed on the ordinary calendar by September 29, 2022. That procedural allowance was not itself a finding on the merits.

Did the ruling decide whether Joy-Con drift was real?

No. The order recounts the complaint’s allegation that a Switch and its Joy-Cons had a defect that caused avatars to move without player input. That is a description of what the plaintiffs alleged, not a judicial finding that the defect existed or that Nintendo was liable for it. The dismissal turned on the minors’ standing as pleaded, not on testing or adjudication of the alleged controller problem.

What happened to the parents’ claims?

The parents’ claims followed a different path from the minors’ claims. The parents had been sent to arbitration on the question of who decided arbitrability; the arbitration panel determined that their claims had to proceed in arbitration. The district court stayed the action as to the parents. Thus, the 2022 order did not simply throw out every claim because of the Switch end-user license agreement: it dismissed the minors’ claims for lack of standing and left the parents’ claims stayed for arbitration. The order sets out both tracks.

How do the other Joy-Con drift cases fit in?

Related cases had different procedural histories, and should not be treated as one final ruling covering every Joy-Con drift lawsuit.

Carusone: arbitration ordered in 2020

In Carusone v. Nintendo of America Inc., a Northern District of Alabama order dated June 30, 2020, granted Nintendo’s motion to compel arbitration, denied its motion to dismiss, and closed the action pending arbitration. The order described the claimed gameplay issue and recorded that the plaintiff bought a replacement Joy-Con set after drift interfered with gameplay. Diaz and Carbajal: dismissal requests reported in 2024

Nintendo Life reported on May 14, 2024, citing Game File reporter Stephen Totilo, that Nintendo and plaintiffs in Diaz and Carbajal had called for dismissal. The report also said Sanchez had been disposed of. It does not provide the underlying docket entries, so it is evidence of reported requests and status—not, by itself, verification of final entered dismissal orders in those cases. What was France’s separate 2026 action?

France’s DGCCRF regulatory action was separate from the U.S. lawsuits. Le Monde reported on June 8, 2026, that the regulator imposed a €35 million fine on Nintendo of Europe over how consumers were informed about malfunctions in certain Joy-Con controllers. The report says Nintendo accepted the terms of a settlement agreement while denying intentional deception, and characterized the agreement as an amicable resolution. Read Le Monde’s report.

Le Monde also reported that Nintendo had offered free repairs for affected controllers in Europe from 2023 following coordinated European action. This does not establish current eligibility everywhere, or for every controller model.

What should you do if your Joy-Con drifts?

Check Nintendo’s official support for your country and controller model before paying for a replacement. Repair eligibility and terms can vary by location and may change; the reported European repair offer is not a universal promise. If repair is unavailable or unsuitable, compare a replacement only after confirming its compatibility with your Switch model and the current local options.
