Do not buy on the strength of a merger headline. Before paying, identify the exact game, edition, platform, storefront and country; establish whether the transaction is proposed or complete; read the precise scope of any remedy; verify account, server, subscription and cloud requirements; and check the refund rules that apply to your purchase. A regulator’s allegation about possible competition harm is not a prediction that your copy will disappear, and a cloud-streaming commitment is not a blanket promise about native console access.
1. Write down exactly what you are buying
A publisher-wide transaction can affect different games, editions and services in different ways. Create a purchase record before opening the checkout page. Include:

- Game and edition: base game, deluxe edition, expansion bundle, remaster or collector’s edition.
- Platform: a specific console model, Windows PC, Mac or a cloud-streaming service.
- Storefront and seller: the platform store, a publisher launcher, a physical retailer or a key seller.
- Country or market: consumer rights, catalogs, prices and licensing can vary by territory.
- Ownership model: a permanent digital license, a disc, a subscription entitlement or a time-limited promotion.
- Online requirements: an account, an internet connection, a subscription tier, authentication or publisher-operated servers.

2. Separate a proposed deal, a regulator’s allegation and a completed transaction
The word merger can describe several different stages. A proposed acquisition may still be under review, a regulator may be litigating to block it, or the parties may have closed after changing the terms. Those stages do not carry the same practical meaning for a buyer.

- Find the current status. Use a current notice from the relevant competition authority or an official company announcement. Record the publication date, because an old announcement can describe a status that no longer applies.
- Read the operative terms. If the transaction closed with commitments, locate the final order, undertakings or licensing arrangement rather than relying on headlines about the original proposal.
- Distinguish assertions from findings. A complaint explains what an agency alleges could happen. It is not evidence that every listed effect occurred, or that a particular game will suffer it.
- Check for later amendments. A revised deal can replace the rights and obligations described in an earlier announcement.
The Federal Trade Commission’s December 2022 announcement about Microsoft’s proposed acquisition of Activision Blizzard described the deal as worth $69 billion and alleged that Microsoft could change rival access, pricing, quality, timing or availability for Activision franchises. Holly Vedova, then director of the FTC’s Bureau of Competition, said Microsoft had “already shown that it can and will withhold content from its gaming rivals.” Both the $69 billion figure and that quotation describe the agency’s historical position in that enforcement proceeding; neither is a forecast for an individual purchase.
The FTC gaming page, updated May 22, 2025, lists that administrative matter as closed. That later status should not be confused with the allegations made in the 2022 announcement. For a different publisher or a new transaction, check the current authority record instead of assuming this example supplies a general rule.
3. Read the remedy’s boundaries, not just its headline
When a transaction includes a commitment, extract five boundaries: which games, which platforms or services, which territories, how long, and which people or providers receive the right. Also check whether the obligation covers games already released, games released in the future, or both.
The revised UK arrangement
The UK Competition and Markets Authority’s description of the revised Microsoft/Activision arrangement centered on cloud-streaming rights. Ubisoft received specified global cloud-streaming rights, excluding the European Economic Area, for Activision PC and console games released during the next 15 years. For EEA cloud rights, the arrangement provides a non-exclusive license. The CMA says Ubisoft can license those rights under models including buy-to-play and multigame subscriptions.
Microsoft’s dated August 21, 2023 announcement described the same 15-year release window and called the rights perpetual. That wording is Microsoft’s description; the CMA page is the regulator’s account of the arrangement. The two descriptions should not be stretched into a promise that every console version, future title, territory or unrelated publisher transaction will remain available.

If the game you want is available only through a native download, disc or cartridge, a cloud remedy may not answer your question. If it is a cloud title, verify which provider holds the license, whether your country is included and whether your subscription or purchase model is supported.
4. Check what the commitment means for EEA cloud streaming
For consumers in the European Economic Area, Microsoft’s Xbox legal page says that a consumer with a license for an eligible Activision Blizzard PC or console game may stream it through eligible cloud-streaming services under the European Commission commitments. The page states that Microsoft’s obligations last 10 years. It also says a consumer or provider license taken during that period endures perpetually.

Those statements are explicitly EEA-specific. A buyer elsewhere must check the rules for that country, and an EEA buyer still needs an eligible game, an eligible service and a valid license. “Perpetually” describes the endurance of a qualifying license under the stated arrangement; it does not mean every service will operate forever, remain available in every market or offer the same performance.
5. Ask whether your platform will still have the game
Answer the platform question in separate branches rather than treating “available” as one thing.
Native console or PC version
Check the current store listing for your exact hardware, edition and account region. Look for delisting notices, compatibility notes and whether the listing is a purchase or a subscription entitlement. A cloud-streaming license does not itself preserve a downloadable build, a disc print run or multiplayer servers.

Cloud streaming
Identify the actual cloud provider, not merely the publisher. Confirm that the game is in that provider’s catalog, that your country is served, and that your account or subscription tier qualifies. Catalog placement can be different from ownership of a native copy.

Determine whether you are buying the game or only borrowing access while subscribed. Check what happens if the title leaves the catalog, your subscription lapses or the service changes its plan. A transaction remedy may govern licensing between companies without guaranteeing a fixed subscription price or catalog duration.
Online-only or account-bound games
Read the current end-user license and support pages for authentication, account linking and server dependence. The documented sources do not establish the future server life of any unnamed game, so do not infer a shutdown date—or perpetual support—from the merger example.
6. Review account, service and content dependencies
Before checkout, answer these operational questions:
- Can the game launch offline after installation, or does it require periodic authentication?
- Which account owns the license, and can that account be transferred?
- Is a platform subscription required for online multiplayer or cloud streaming?
- Are downloadable expansions, cosmetics or saved games tied to a separate service?
- What happens to access if the publisher changes its launcher, closes a login service or removes a regional listing?
Use the current official license and support pages for those answers. A merger remedy normally addresses a defined competitive concern; it is not a substitute for the game’s technical support policy.

7. Check refund rights before you pay
Refunds are governed separately from merger remedies. Microsoft Store support guidance says digital goods, including games, are not refundable unless the offer or applicable law makes the buyer eligible. It provides a request route for Microsoft Store PC games and notes that online returns are not available in all markets.
That means a changed catalog, delayed feature or disappointing post-merger decision does not automatically create a refund right. Check the storefront’s policy for your country and purchase type before payment, and read local consumer-law information where relevant. Save the policy version and your order details.

Do not assume that a regulator’s order or a publisher’s licensing commitment changes the seller’s standard return process. If access fails, use the storefront’s documented support route and cite the order date, product listing and the policy that applied when you bought.

A physical copy can reduce dependence on a storefront catalog, but it may still require an account, a large download, patches or servers. A digital copy is convenient and may include automatic updates, but access is tied to the account and store license. Compare the actual edition and seller rather than treating either format as automatically safer.

Only compare options that are actually in stock and sold for your country. The merger example does not identify a particular game or edition that can be recommended.

9. A practical pre-purchase procedure
- Capture the listing. Save the title, edition, platform, storefront, seller, price, release status and region.
- Check the transaction date and status. Read the latest regulator or company notice and note whether the deal is proposed, under review, closed or subject to revised commitments.
- Locate the binding document. Find the final order, undertaking or licensing description, not just a news headline.
- Mark the scope. Write down covered games, future-release window, platforms, territories, service type and duration.
- Test the platform path. Verify native compatibility, cloud catalog entry or subscription eligibility for your country.
- Check dependency requirements. Confirm accounts, launchers, online multiplayer, authentication, subscriptions and server requirements.
- Read the refund policy. Check eligibility, deadlines, market limitations and any download or usage conditions.
- Compare another format if available. Evaluate physical and digital editions using the same platform, region, content and return-policy criteria.
- Save proof of purchase. Keep the receipt, order number, product page and policy text in one folder.
- Decide based on the access you actually need. If you require native offline play, do not treat a cloud-only remedy as an equivalent safeguard. If you require streaming, verify the eligible provider and territory instead.
10. Common mistakes and how to correct them
“The merger means the game will disappear.”
That conclusion goes beyond the evidence. Start with the exact title, platform and region, then check the current listing and any binding commitment.
“A regulator said access could be harmed, so this title is unsafe.”
Regulatory complaints describe alleged potential effects in a proceeding. Treat them as context, not as a title-specific probability or guarantee.
“A 15-year cloud-rights window guarantees my console copy.”
The documented 15-year arrangement concerns specified cloud-streaming rights for Activision PC and console games released in that window. Confirm native console or PC terms separately.

The EEA page’s perpetual language concerns qualifying consumer or provider licenses taken during the stated 10-year obligation period. It does not promise unchanged catalogs, prices, hardware support or service operation everywhere.
“A merger gives me a special refund right.”
Refund eligibility remains a matter of the storefront offer and applicable law. Review the policy before paying and use the seller’s support route if a problem occurs.
“A physical copy removes every risk.”
Physical media can still require patches, account activation, subscriptions or servers. Check those dependencies on the game’s current support page.
11. What the documented example can—and cannot—tell you
The Microsoft/Activision case is useful because it separates several concepts that are often collapsed into one merger story. The FTC’s 2022 allegations concerned possible effects on rivals. The CMA’s revised UK arrangement focused on cloud-streaming rights, including a defined release window, territory carve-outs and licensing discretion. Microsoft’s EEA page described a 10-year obligation and perpetual endurance for qualifying licenses. Microsoft Store guidance treated digital refunds as conditional on offer terms or law.
