If a U.S. retailer delays or cancels a physical game preorder, ask whether the order is still active and whether you can consent to the delay or cancel for a full refund. For most covered online, mail, or phone merchandise orders, the seller must ship by its stated deadline—or generally within 30 days if it stated no deadline—and must offer a delay choice or cancellation and refund if it cannot ship on time. Digital preorders follow storefront-specific rules instead.
First, identify what you ordered and what the seller promised
“Oversold” usually describes a seller taking more orders than it can fulfill; it is not a separate legal category with one universal remedy. A preorder might be delayed because of an inventory or allocation problem, or it might be canceled outright. Check the order status and the seller’s stated reason rather than assuming what happened.

The rules and practical options depend on whether you bought a physical game or collector’s edition, or a digital license/download; the shipping or release timing the seller promised; your location; and how you paid. The federal guidance below is for U.S. merchandise orders. State and local law may add protections.
What to do about a delayed or canceled physical preorder
- Save the key records. Keep the order confirmation, order number, edition and format, order date, advertised release or shipping date, amount paid, payment method, order-status screenshots, and all delay or cancellation messages. Save your replies and any refund confirmation too.
- Ask the retailer for the order’s status. Use the account order page or the retailer’s documented support channel. Ask whether the order remains active, the revised ship date, and whether the retailer is offering you a choice to wait or cancel for a refund.
- Decide whether to wait or cancel. If the revised date is acceptable, clearly tell the retailer you agree to the delay. If you do not want to wait, clearly cancel and request a refund to your original payment method. The FTC says that when a covered seller cannot ship on time, it must notify you and offer the choice to accept the delay or cancel for a full refund. - Escalate an unpaid refund. If the game never arrives and the seller will not refund you, contact your card issuer or payment provider promptly to ask about disputing the charge. Procedures and deadlines vary by payment method. Keep your order records and seller communications. The FTC’s consumer guidance on undelivered orders describes charge disputes as an option.
- Report suspected fraud through the appropriate channel. The FTC accepts reports of suspected fraud. For other consumer disputes, a state or local consumer protection office may be relevant; the right office depends on where you live.
What the federal shipping rule means
For most U.S. online, mail, or phone orders of merchandise, a seller must ship within the time it stated. If it stated no shipping time, the general deadline is 30 days from the order. If the seller cannot meet the deadline, it must send a delay notice and offer you the choice of consenting to the delay or canceling for a full refund. Required refunds generally cover amounts paid for unshipped merchandise, including shipping and handling where applicable. These rules address merchandise shipment; do not assume they automatically govern digital content or settle every state-law question.

A delay notice should give a definite revised shipment date, or say that no date is available, and explain your cancellation and refund option. If the seller cannot give a definite date and you agree to wait indefinitely, you may still cancel before the item ships. A further delay requires a renewed delay option. The FTC guide says required refunds generally must be made within seven working days for most payment methods, or within one billing cycle if the seller extended credit; the applicable timing depends on the payment method and transaction facts.
What to do about a digital preorder
Do not apply physical-shipping deadlines automatically to a digital purchase. Check the platform policy for the region on your account, when payment is taken, and whether the game has started downloading, streaming, or preloading. The following are U.S.-specific examples, not universal rules.

PlayStation Store
Under PlayStation’s U.S. preorder cancellation policy, if you paid more than 14 days before release, you may cancel before release if the main product has not started downloading or streaming. If you paid 14 days or less before release, the stated cancellation window is up to 14 days after payment, subject to the same no-download-or-streaming condition. Automatic downloads or preloads can therefore affect eligibility.
Nintendo eShop
Nintendo’s U.S. eShop preorder FAQ says you can cancel before payment is processed and the game is preloaded, up to seven days before release. Nintendo’s preorder cancellation support page lists insufficient eShop funds at the payment point as one possible reason for a cancellation.

Wait or cancel? Compare the practical trade-offs
A preorder may include an edition, price, or bonus you care about, but the sources cited here do not establish that a retailer must preserve those terms or compensate you beyond applicable refund rights. Before deciding, weigh:
- How definite and how far away the revised shipping date is.
- Whether you can get a refund to your original payment method, and when it is expected.
- Whether the edition or preorder bonus matters enough to justify waiting.
- For a digital preorder, whether payment or a download/preload has begun and how that affects cancellation under the platform’s terms.
- The cost and availability of buying elsewhere against the possibility of losing the current price or bonus.
If the seller says “store credit only”
For a covered physical merchandise order that was not delivered, FTC consumer guidance says the seller should refund the payment rather than satisfy the refund only with a gift card or store credit. State and local law, the transaction details, and whether the purchase was physical or digital can affect the specific rights that apply. If the seller refuses a refund for an undelivered order, ask your payment provider promptly about a dispute.

They do not determine the rules in other countries, every U.S. state-specific right, or every retailer’s cancellation window, payment-capture practice, preorder-bonus terms, or inventory remedy.
