Why Nintendo Sued Genki Over Its Unofficial Switch 2 Mockups—and How the Case Ended

Nintendo’s case over Genki’s early Switch 2 mockups ended with a confidential settlement, an undisclosed damages payment, and a permanent injunction governing Genki’s branding and compatibility claims.

Nintendo’s lawsuit against accessory maker Genki ended on September 10, 2025, with a confidential settlement and a court-entered permanent injunction. Nintendo received an agreed payment for damages, but the public judgment does not disclose the amount. The case grew out of Genki’s early Switch 2 accessory promotions and a mockup shown before Nintendo publicly revealed the console—not a public trial verdict establishing every allegation Nintendo made.

Why did Nintendo sue Genki?

Genki, operated by Human Things, Inc., began advertising accessories for the then-unannounced Switch 2 by at least January 7, 2025. The court judgment says the company displayed an alleged 3-D-printed mockup and a digital render at CES 2025, and that the mockup displayed Nintendo trademarks. Nintendo’s first-look trailer came on January 16; it presented the console publicly before Nintendo released technical specifications at its April 2 presentation. Nintendo’s complaint alleged trademark infringement, unfair competition, and false advertising. In its account of the dispute, the European Innovation Council and SMEs Executive Agency said Nintendo objected to Genki’s use of “Nintendo Switch” and “Joy-Con” in ways Nintendo argued could suggest affiliation or endorsement. Did Genki have an unreleased Switch 2?

The judgment notes media reports that Genki had accessed an unreleased Switch 2 and that such access was said to have helped it develop accessories. It also records Genki’s contrary representation: “Defendant represents and attests that it did not obtain access to any of Plaintiff’s property (e.g., including but not limited to an unreleased Switch 2 or any documents, files, consoles, or accessories relating thereto) prior to the Plaintiff’s First-look Trailer or official launch of the Switch 2.”

That statement is Genki’s representation in the stipulated judgment. Because the case ended without a trial resolving the mockup’s precise source, the public order does not establish that Genki used a genuine unreleased console or official Nintendo schematics. September 10, 2025 judgment.

How did the lawsuit end?

The court entered a stipulated judgment and permanent injunction on September 10, 2025, after the parties resolved Nintendo’s claims under a separate confidential settlement agreement. The judgment says Nintendo was awarded judgment on its claims and a damages payment in an agreed amount. The amount is not public, and each side bears its own attorney fees and costs. The order describes a settlement-backed consent judgment, not a trial verdict based on adjudication of each disputed allegation. September 10, 2025 judgment.

What does the injunction require Genki to do?

The injunction limits how Genki can use Nintendo’s identity and describe its accessories. Its requirements include:

  • No Nintendo branding as Genki branding: Genki may not use Nintendo logos or design marks, or confusingly similar marks, in connection with its business. It may not use “NINTENDO,” “SWITCH,” “SWITCH 2,” “JOY-CON,” or confusingly or substantially similar terms in Genki product names.
  • Compatibility references must be limited and accurate: Genki may refer to Nintendo or Nintendo products only in a nominative fair use manner, to the extent necessary for accurate, verifiable, lawful compatibility claims or to accurately disclaim affiliation, endorsement, or sponsorship.
  • Unlicensed status must be clear: Packaging, product design, and descriptions for accessories compatible with or marketed for Nintendo products must make clear that Genki is an unlicensed accessory manufacturer.
  • Avoid imitating Nintendo presentation: The order bars “Glitch,” “Glitch 2,” “Genki Direct,” “Genki Indirect,” and similar approximations of Nintendo intellectual property, product names, characters, presentations, or marks. It also restricts packaging, product design, descriptions, marketing, and branding that replicate or are confusingly or substantially similar to specified Nintendo core color schemes.

The injunction applies worldwide and remains enforceable by the court; violations may expose Genki to contempt sanctions. September 10, 2025 judgment and permanent injunction.

What was Nintendo’s official Switch 2 announcement?

Nintendo announced Switch 2 on April 2, 2025, describing it as the successor to Nintendo Switch with a larger screen, magnetic Joy-Con connectors, and increased processing and graphics capability. Its announcement set June 5, 2025, as the release date for the Japanese-language system in Japan and listed that model’s manufacturer’s suggested retail price at 49,980 yen, including tax.
