Treat every AI-generated game asset as an uncleared draft until your studio can prove who made it, what data and tool produced it, what rights were granted, and what each platform requires. Prompts alone generally do not create U.S. copyright in an output, while meaningful human selection, arrangement, editing or other authorship may protect the human-created portions. That distinction does not eliminate third-party copyright, trademark, publicity, confidentiality, privacy or contract risk.
The practical gate differs by asset. Art needs provenance and similarity review; code needs license, security and dependency checks; a synthetic voice needs performer-specific written consent. Provider terms, data handling, storefront rules and the law where you release the game all apply independently. The sections below turn those requirements into a documented pre-ship decision.

There is no universal “AI is legal” or “AI is illegal” answer. Ship only after the studio has an evidence trail for the tool and model version, inputs, human contribution, rights grant, third-party review, consent where a person is involved, privacy basis, platform disclosures and a named approver.
The U.S. Copyright Office’s 2025 report says generative-AI output can be protected only where a human author has determined sufficient expressive elements. A prompt by itself normally is not enough. Human-authored painting over, compositing, layout, selection, arrangement, dialogue direction or engineering can be protectable, but the raw generated material should be identified separately in the asset register. This is U.S. guidance, not a worldwide rule; local copyright, publicity, labor and data laws can differ.

How do art, code and synthetic voices differ?
Use the same clearance gate for every asset, but change the evidence you demand. The risk profile is different because an image may resemble a protected work, code may carry a reciprocal license, and a voice can identify a living performer even when no copyright claim succeeds.
| Asset | Primary rights questions | Human contribution to document | Pre-ship controls |
|---|---|---|---|
| Art and marketing images | Copyright, trademark, character, publicity and derivative-work risk; provider commercial-use terms | Brief, prompt choices, selection, compositing, paint-over, layout and final approval | Visual-similarity, trademark, character and marketplace checks; remove or escalate recognizable third-party material |
| Code | Output license, copied or substantially similar code, dependency compatibility, confidentiality and security | Engineer who reviewed, modified, tested and accepted the code; tool and version | Code review, tests, dependency and license scans, secret detection, security review and retained scan decision |
| Synthetic voice | Performer consent, publicity, unfair-competition, privacy, labor contract, recordings and model rights | Direction, approved scripts, role and use limits; identity of the performer or source | Specific written consent, compensation terms, retention/deletion controls and clear player disclosure where required |
What should a developer check before shipping AI-generated art?
Define the asset and its rights basis
Record whether the image is concept art, final in-game art, user-interface material, store-page marketing, promotional copy or a derivative of an existing character or world. The intended use determines which licenses, trademark permissions and publicity rights are relevant. A concept image that never ships still matters if it was used to brief a contractor or train an internal workflow.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Preserve provenance and human authorship
Save the provider, model or feature, version, generation date, accepted terms, commercial-use status and relevant settings. Keep the human-directed brief and approval trail. Store meaningful edits such as paint-over, compositing, masking, typography, color work, layout and selection among alternatives so a reviewer can identify the human-authored elements.
Investigate similarity instead of trusting the model
Do not treat an “in the style of” prompt as a clearance. There is no single bright-line rule that makes every style reference lawful or unlawful, but targeting a living artist’s distinctive style, a recognizable franchise character, a celebrity likeness or a protected logo creates an obvious escalation point. Run visual-similarity, character, trademark and marketplace searches appropriate to the asset. If a recognizable work or person appears, pause the release and obtain a rights decision; the fact that a model produced it does not prove independent creation.
Separate protectable additions from generated material
In the asset register, identify the raw output and the human-authored additions separately. The Copyright Office states that including AI material in a larger human-authored work does not automatically remove copyright from the human-created portions. Keep layered files, edit history and approvals that show what the studio actually contributed.

Is AI-generated code safe to ship?
Only after ordinary software controls and a license review. AI assistance does not replace code review, testing, security analysis or dependency governance, and a “no match” scan is not proof that a snippet is original.

Confirm output ownership or license language, commercial-use limits, training and retention settings, output restrictions, security commitments, model-update practices and any indemnity. Save the terms in force when the code was generated.
- Identify the responsible engineer. Record the exact tool and version, the repository location and the engineer who reviewed and accepted the final code. Apache guidance says contributors must be legally entitled to grant the project license and should disclose generative tooling where it affects contribution rights.
- Run normal engineering checks. Perform peer review, tests, static and dynamic security review, dependency scanning, license scanning and secret detection. Fix vulnerabilities and remove credentials or proprietary material before merge.
- Investigate similar snippets. Search suspicious code and retain the scanner result plus the reviewer’s decision. Scanners see only the databases and rules they contain, so an empty result cannot establish originality.
- Preserve third-party notices. If a snippet or dependency is identified, keep its copyright notice and license file and verify compatibility with the project’s distribution model. Do not silently relicense code whose terms do not permit it.
- Protect confidential inputs. Never paste unreleased source, credentials, private partner material, personal data or secret design documents into a service without an approved data-handling basis, access controls and retention decision.
Do I need permission to clone a voice?
For an identifiable performer, obtain clear, conspicuous, voice-specific written consent before recording, training or shipping a synthetic replica. Copyright may be only one part of the problem: publicity, unfair competition, privacy and labor-contract rules can apply even when a voice itself is not copyrighted.
Make the consent scope specific
SAG-AFTRA’s February 2026 bulletin says consent “Must be put in writing in a clear and conspicuous manner.” A usable agreement names the project or code name, genre, character and role, dialogue context, media, territory, term, sensitive content, role size and whether the game is based on existing intellectual property. State whether pre-rendered, interactive or real-time dialogue is allowed.
Cover money, data and future use
Address compensation, recordings, training-data use, model retention, deletion, security, sublicensing, marketing, sequels and franchise expansions. Specify who may operate the model, where data is processed, how long source recordings remain and what happens if consent is suspended or revoked. A generic “AI rights” clause is not a substitute for these limits; SAG-AFTRA distinguishes visual and vocal digital replicas and gives special treatment to real-time generated dialogue.
Record the agreement and player notice
Store the signed or separately initialed consent with the asset record and link each voice model or file to the approved scope. Prepare a disclosure plan for menus, dialogue, store pages or other locations required by the platform, jurisdiction or context. Do not imply that a fictional character’s voice is human-recorded if the presentation would mislead players.

Which provider and data terms matter?
Archive the terms and privacy documentation accepted when each production asset was generated. At minimum, verify:
- commercial-use permission and the provider’s ownership or license grant;
- whether prompts and outputs are used for training, human review or service improvement;
- retention, deletion, geographic processing, subprocessors and model-update effects;
- security, access controls, audit logs and the provider’s ability to restrict or remove output;
- output restrictions, disclosure duties and any indemnity, exclusions or usage caps; and
- how the provider handles personal data, confidential material and requests for access or deletion.
Microsoft’s responsible-AI guidance illustrates the operational baseline: control inputs and outputs, give necessary notices and obtain consents, test the system, keep human oversight, provide feedback channels and secure the service. For voices and other personal data, document the lawful basis, notice, consent, retention, deletion, access control and vendor decisions. The exact GDPR or state-law answer depends on where the studio and players are located, so obtain jurisdiction-specific legal advice rather than assuming one global rule.
What must a game disclose on platforms and in the EU?
Roblox experiences
Roblox Community Standards apply to AI-generated content, and the developer remains responsible for third-party AI output. Extended AI interactions can require content-maturity disclosure and a Restricted label. Roblox gives this example wording: “This is an AI-powered conversation, not human. It may make mistakes.” Adapt the notice to the actual interaction and keep moderation and reporting controls in place.
Google Play distribution
AI-content apps must follow existing safety rules, prevent restricted or deceptive content and provide an in-app mechanism for users to report or flag offensive output. Passing a copyright review does not satisfy these separate safety obligations.
EU-facing releases
Article 50 of the EU AI Act applies from 2 August 2026. Providers must support machine-readable marking of synthetic audio, image, video or text, and deployers must clearly disclose qualifying deepfakes. The European Commission describes maximum figures of up to €15 million or 3% of total worldwide turnover for specified Article 50 violations, subject to proportionality and enforcement context. A limited grace period applies to certain pre-existing systems’ marking duties. Assess whether your game generates or presents content covered by the article and retain the marking and disclosure implementation record.

Before submission, read the current platform agreement, content-rating questionnaire, AI disclosure rules, user-reporting obligations and restrictions on deceptive or impersonating content. Compliance on one platform or in the EU does not establish compliance elsewhere.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.How do I run a pre-ship AI asset gate?
Use one record per asset or model, with a named owner and approver. Stop the release when a required field is unknown.
- Classify the asset. Mark it as art, code, voice or mixed, and note whether it is shipped, user-facing, interactive, marketing-only or a development aid.
- Capture provenance. Record provider, model or feature, version, date, settings, prompts where appropriate, input files and the terms and privacy notice accepted.
- State the rights basis. Identify the copyright or license theory, human-authored contribution, third-party materials and any trademark, publicity, confidentiality or contract issue.
- Complete specialist review. Run similarity and trademark checks for art; code, security, dependency and license checks for software; and performer-consent and data checks for voices.
- Confirm consent and privacy. Attach signed voice permissions, notices, lawful-basis analysis, retention and deletion decisions, and access controls for personal or confidential inputs.
- Apply shipping controls. Set moderation, reporting, age or maturity labels, machine-readable marks, watermarks and player disclosures required by the destination platform and jurisdiction.
- Approve exceptions in writing. Escalate recognizable people or works, incompatible licenses, missing consent, confidential-input exposure and uncertain legal bases to counsel or the rights owner.
- Archive the release packet. Keep the final asset, source or layered files, code-scan results, contracts, notices, screenshots of disclosures, terms snapshot and the named approver with the build record.
What evidence proves an AI asset was cleared?
A defensible file lets another reviewer reconstruct the decision without relying on memory. Include the generation record, provider terms, input classification, human edit history, similarity or license scans, reviewer comments, consent documents, privacy assessment, platform settings and final approval. For code, preserve dependency manifests and notices; for voice, preserve the exact script, role and territory approved; for art, preserve layered working files and the comparison results that explain why a similarity concern was rejected or escalated.

What should the final approver sign?
The approver should confirm eight facts: rights basis; provenance; identifiable human contribution; third-party similarity or license review; performer consent where relevant; privacy and confidentiality controls; platform and storefront compliance; and disclosure or marking in the shipped experience. If any item is unresolved, classify the asset as blocked, replace it, or obtain a documented legal exception before submission.

Frequently Asked Questions
Can a prompt log alone prove that my studio owns an AI-generated asset?
No. A prompt log shows how an output was requested, but it does not establish human authorship, third-party clearance or the provider’s commercial-use grant. Pair it with edit history, accepted terms, similarity review and an approval record.
Does keeping an AI-generated asset out of the player-facing build remove the legal risk?
No. A development-only image or code fragment can still expose confidential inputs, incompatible licenses or personal data, and it may later be reused in marketing or a sequel. Classify its intended and possible downstream uses when it is created.
Can I revoke a performer’s synthetic-voice consent after launch?
Only if the written agreement provides a workable suspension or revocation process and explains its effect on existing recordings, models, builds and marketing. Negotiate those conditions before training or release; do not assume a general contract cancellation right applies.
Do machine-readable marks replace a visible AI disclosure to players?
Not necessarily. Machine-readable marking serves technical detection, while storefronts and laws may require clear language that users can see or hear. Implement both when the applicable platform or jurisdiction calls for them.
