No U.S. ban on ANBERNIC handhelds is confirmed. A report published October 12, 2026 says the Entertainment Software Association (ESA) recommended that the Office of the U.S. Trade Representative (USTR) classify ANBERNIC as a “superfake,” citing handhelds sold with microSD cards containing pirated game ROMs. That is a reported industry-group recommendation—not a USTR decision or an order restricting sales.
What is the current U.S. status of ANBERNIC handhelds?
The available reporting does not establish that ANBERNIC is barred from selling handhelds in the United States, or that a restriction has been approved or ordered. Retro Handhelds reported the ESA recommendation on October 12, 2026, while describing any consequences as conditional. Neither a formal USTR action nor an official decision is established by that report. [c001]

The term “superfake” is attributed to the ESA recommendation in that report; it is not an official USTR finding. No named statement from an ESA or USTR representative was verified in the coverage.

What is the reported concern?
According to Retro Handhelds, the ESA’s concern is ANBERNIC handhelds sold with microSD cards containing pirated game ROMs. The report does not establish whether any possible government action would apply broadly to the hardware or narrowly to bundles that include game-loaded cards. That scope remains uncertain.

The distinction matters to buyers: the reported issue concerns the way some devices are sold with game files, not a confirmed prohibition on every ANBERNIC device. The report does not establish that a hardware-only model is exempt from any future action, either.
What would need to happen for a restriction?
The ESA’s reported recommendation is not itself a government restriction. USTR would need to take a formal step before the report’s conditional possibility could become an actual U.S. trade measure. The underlying ESA submission and an official USTR response were not verified, so the exact request and any government position are not established.

A separate route sometimes mentioned in discussions of imported goods is a Section 337 investigation. The U.S. International Trade Commission says such investigations most often involve intellectual-property claims, including allegations of patent or trademark infringement involving imported goods. Its general description does not show that the USITC has opened a case or issued an order against ANBERNIC. A reported USTR recommendation should not be described as a USITC proceeding. On April 21, 2025, Android Authority reported that ANBERNIC had suspended orders shipping from China to the United States in response to tariff-policy changes and pointed customers toward products from its U.S. warehouse. That was a reported shipping-policy response at the time, not a legal ban. It is historical and does not confirm current shipping options, stock, or retail availability. That earlier shipping disruption should not be treated as evidence that the 2026 recommendation has taken effect. The two stories concern different issues: tariffs and shipping in 2025, and a reported ESA request concerning ROM-loaded microSD bundles in 2026.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Does the Italian ROM investigation change the U.S. picture?
No. Ars Technica reported on July 16, 2025, that an Italian investigation involved a creator who reviewed handhelds with pre-loaded ROMs and alleged promotion of copyrighted material. That is a separate case in a different jurisdiction; it does not establish ANBERNIC’s U.S. legal status or determine the legality of every emulator or ROM use in the United States.
