ANBERNIC is not confirmed to be banned in the United States. Reports published on October 12 and 13, 2026 say the Entertainment Software Association (ESA) recommended that the U.S. Trade Representative (USTR) consider ANBERNIC for the annual Notorious Markets process. The reported concern is not the existence of a retro handheld by itself, but microSD cards bundled with some devices that ESA alleges contain unauthorized copies of games from ESA member companies.
That recommendation is an advocacy submission, not a final USTR listing, court judgment, import order, or sales ban. USTR has not been verified as having accepted the recommendation or ordered ANBERNIC to stop selling in the United States.

What the ESA recommendation means
The Notorious Markets process identifies marketplaces and other channels that rights holders say facilitate significant copyright or trademark infringement. ESA can submit information for USTR to consider, but USTR decides what appears on the final list. Android Authority reported that ESA submitted suggestions through Regulations.gov and emphasized that inclusion is not automatic. The underlying docket page returned a 403 error when checked, so the filing itself could not be independently reviewed.
Retro Handhelds reported the recommendation on October 12, 2026, and Android Authority followed on October 13. Both accounts describe a recommendation rather than a completed government action. USTR could decline to adopt it, seek more information, or address only particular products, sellers, or distribution channels.

Is ANBERNIC banned in the US?
No verified evidence supports saying that ANBERNIC has been formally listed, banned, or ordered to stop selling hardware in the United States. The possible consequences remain conditional because the reports do not establish whether USTR will act, when it might act, or what any action would cover.
| Question | What is established | What remains unknown |
|---|---|---|
| Has USTR issued a final listing? | Not verified in the October 12–13 reports. | Whether ANBERNIC will appear on a final Notorious Markets list. |
| Is the handheld hardware itself prohibited? | No such prohibition was reported. | Whether any future measure would address hardware, bundles, sellers, or shipping channels. |
| Could US sales change? | Reports describe that possibility as conditional. | The timing, scope, and practical effect of any action. |
What ESA is alleging about the microSD cards
The reported allegation centers on memory cards supplied with certain handheld packages. ESA is said to have told USTR that these preloaded cards contain unauthorized copies of games published by ESA members. The reports do not establish how many devices or cards are involved, which specific game files were identified, or whether every ANBERNIC configuration includes such a card.

That distinction matters for buyers. A device sold without infringing files presents a different factual question from a bundle that arrives with copyrighted games already copied to removable storage. The available reporting does not confirm that a hardware-only configuration is offered, in stock, or shipped to any particular country, so buyers should verify the exact contents, seller, shipping terms, warranty, and return policy before ordering.

Emulator software
An emulator is software that imitates the behavior of another console or computer so compatible programs can run. The existence of an emulator does not, by itself, establish that a device contains unauthorized game copies. Nintendo’s support materials note that some emulator software may circumvent security measures; that is Nintendo’s stated position, not a universal legal ruling about every emulator or every jurisdiction.

ROM files
“ROM” commonly refers to a digital copy of a game originally distributed on a cartridge or disc. Nintendo’s Intellectual Property & Piracy FAQ describes unauthorized game files as ROMs and states: “The uploading and downloading of pirate copies of Nintendo games is illegal.” Nintendo also says that preinstalled games on retro devices can infringe its rights. Those statements express Nintendo’s enforcement position and should not be treated as an adjudication of the ESA allegation involving ANBERNIC.
Legal treatment can depend on the country, the rights holder, how a file was obtained, and what a person does with it. Readers should consult the relevant rights holder’s guidance and use only content they are legally entitled to use. A blank replacement microSD card is merely storage; it does not make unauthorized game files lawful.

What could happen next
USTR declines the recommendation
USTR may choose not to include ANBERNIC. In that case, the ESA submission would not itself create a US sales restriction.
USTR lists a specific market or channel
A future notice could focus on a marketplace, seller, importer, or distribution practice rather than every ANBERNIC product. The reports provide no confirmed scope, so it would be misleading to predict a blanket hardware ban.

Commercial effects without a formal ban
Even without a prohibition, sellers could alter bundles, remove preloaded cards, change listings, or stop shipping to certain destinations in response to rights-holder pressure or compliance concerns. None of those outcomes has been confirmed.
How buyers should evaluate an ANBERNIC listing now
- Read the configuration line. Check whether the listing includes a microSD card and whether it says the card is preloaded.
- Ask what is on the card. If a seller does not clearly identify the contents, treat that uncertainty as a purchasing risk.
- Prefer legally obtained content. Use your own lawful backups or officially supplied software where permitted, and follow the applicable rights holder’s instructions.
- Check fulfilment details. Confirm the seller’s location, shipping destination, warranty coverage, and return window; these terms can change independently of any USTR decision.
- Keep documentation. Save the product description and order record in case the delivered package differs from the advertised configuration.
Timeline and evidence limits
- October 12, 2026: Retro Handhelds reported that ESA recommended ANBERNIC for consideration and tied the concern to preloaded microSD cards.
- October 13, 2026: Android Authority reported an ESA submission through Regulations.gov and reiterated that USTR makes the final determination.
- Current status: No verified final USTR listing, US sales ban, or order to stop selling ANBERNIC hardware.
The two reports are secondary accounts. Because the linked Regulations.gov filing could not be opened, details beyond those accounts should be treated as unconfirmed until the official docket or a USTR notice is available.
