Yes—generally, you can sell a game made with generative AI in the United States. But permission to sell is not the same as copyright ownership: your tool’s terms must allow commercial use, the game must not infringe someone else’s rights, and each store’s disclosure rules must be followed. Purely AI-generated assets usually are not protected by U.S. copyright; human-written, designed, edited, or arranged parts may be. This guide reflects publicly stated U.S. copyright policy and store rules available as of October 29, 2026. It is general information, not legal advice for a specific game.

What does “legal to sell” actually mean?

There are three separate questions: whether you may sell the game, whether you own copyright in its contents, and whether the contents infringe someone else’s rights. A “yes” to the first does not settle the other two.

  • Commercial permission: Check the terms for the exact AI tool and plan you used. A free tier may be personal-use-only, a paid tier may permit commercial use, and some plans require attribution. Terms can change, so check the current terms before shipping.
  • Third-party rights: A tool’s commercial-use grant does not clear another person’s copyright, trademark, or rights in their face or voice. Do not treat generated content as safe merely because a tool produced it.
  • Store compliance: Disclose AI use as required by the store where you publish. A compliant disclosure does not excuse illegal or infringing content.

Steam, itch.io, the Apple App Store, and Google Play all list games made with generative AI, according to developer guidance available in October 2026. That does not mean every AI-assisted game will pass review, or that every store has the same disclosure form. The exact current policies for Apple and Google were not established in the developer documentation reviewed for this article, so check their live rules before submission.

Can you copyright AI-generated game assets?

Under current U.S. Copyright Office policy, purely AI-generated expression is not copyrightable. Human authorship can protect human-written or human-created elements, and sufficiently creative human edits or arrangements may also qualify; the dividing line depends on the specific contribution.

The Copyright Office’s Copyright and Artificial Intelligence, Part 2: Copyrightability, published January 29, 2025, states: “The outputs of generative AI can be protected by copyright only where a human author has determined sufficient expressive elements.” It also explains that “Copyright protects the original expression in a work created by a human author, even if the work also includes AI-generated material.” By contrast, “Copyright does not extend to purely AI-generated material, or material where there is insufficient human control over the expressive elements.” The Office’s AI hub is at copyright.gov/ai/.

Why a prompt alone usually does not give you copyright

The Office concludes that, with current generally available technology, prompts alone do not provide sufficient human control over the expressive elements of the output. Its report explains that prompts may express an idea or mental conception without controlling how that idea is expressed; the gap between a prompt and the generated result is one reason the user may lack control over the fixed expression.

That means a prompt-only sprite, music track, or NPC line generally will not become your copyrightable work just because you wrote the prompt, paid for a tool, or received a contractual assignment of the output. The Office’s 2023 registration guidance says that if a work’s “traditional elements of authorship were produced by a machine, the work lacks human authorship and the Office will not register it.”

What kinds of human contribution can matter?

The relevant question is not simply how much time you spent prompting, or how many generations you reviewed. It is whether a person contributed original expression and controlled expressive elements. The Office says these questions are analyzed case by case. Its guidance recognizes that a human-created work can remain protected where its expression is perceptible in an AI-assisted output; original human modifications may also be protected if they meet the ordinary originality standard.

For a game, potentially protectable human-authored elements include your script, level design, code architecture, hand-painted changes, UI, and the original selection and arrangement of assets or scenes. Copyright in those human contributions does not automatically extend to AI-generated elements standing alone. Selecting one generated image from a batch is not, by itself, the kind of creative authorship that establishes copyright in the image.

The Copyright Office’s 2023 registration guidance also requires applicants to disclose more-than-de-minimis AI-generated material in a work submitted for registration and briefly explain the human author’s contributions. Applicants should exclude the AI-generated material from the copyright claim. Omitting it risks cancellation and may give a court grounds to disregard a registration under 17 U.S.C. § 411(b).

Is there a 30% rule for AI-generated content?

No. Neither the Copyright Act nor Copyright Office guidance sets a 30% threshold for how much of a work must be changed or human-made. Copyrightability turns on human control and original expression, assessed case by case—not a fixed percentage of edits, prompts, or generated content.

What do the court decisions establish?

On March 18, 2025, the D.C. Circuit affirmed the refusal to register a work listing an AI system as its sole author in Thaler v. Perlmutter. The court said the Copyright Act requires eligible work to be authored in the first instance by a human being. The Supreme Court denied review on March 2, 2026, leaving that ruling in place. The decision does not specify how much human involvement is enough in a particular game asset, and it does not prohibit copyright in work made with AI assistance.

Two examples help show the distinction. In its February 21, 2023 decision on Zarya of the Dawn, the Copyright Office recognized the human-authored text and the selection and arrangement of the comic, but not the individual generated images. In January 2025, the Office registered A Single Piece of American Cheese, an image in which a human actively selected, coordinated, and arranged elements through inpainting. That registration example does not create a general rule that a particular editing method or amount of work guarantees protection. As of mid-October 2026, the merits of Allen v. Perlmutter, involving Jason Allen’s AI-assisted artwork, remained pending.

Does a tool’s “you own the output” clause settle the issue?

No. A vendor can allocate contractual rights between itself and a user, but its terms cannot create a federal copyright where the law recognizes no human authorship. Nor can a vendor grant permission to use someone else’s protected work if it does not hold those rights.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For example, OpenAI’s Terms of Use effective January 1, 2026 say: “As between you and OpenAI, and to the extent permitted by applicable law, you (a) retain your ownership rights in Input and (b) own the Output. We hereby assign to you all our right, title, and interest, if any, in and to Output.” The qualification “if any” matters: an assignment cannot transfer a copyright that does not exist. The same terms warn that outputs may not be unique, prohibit using the service to infringe others’ rights, and prohibit representing output as human-generated when it was not.

Read the terms for the plan actually used, including commercial-use limits, attribution requirements, and any licence back to the vendor. A 2026 vendor-terms dataset reported that Leonardo.Ai and Recraft did not allow commercial use on their free plans but did on paid plans, while Scenario and PixelLab allowed commercial use on free and paid plans. Those are examples, not a substitute for checking the current terms yourself. Midjourney’s exact current primary terms should also be verified before relying on a commercial-use grant.

Can an AI-generated game infringe someone else’s rights?

Yes. Your right to sell under a tool contract and your copyright in your own contributions are separate from whether an output unlawfully copies someone else’s expression or uses a protected identity. Avoid prompting for a known character, logo, celebrity face, or recognizable voice without permission, and review outputs before shipping.

Similarity is not always infringement, but close copying is risky

Copyright generally does not protect a style by itself. That does not make every style imitation safe: an output that copies protected expressive details can raise a different issue. Trademarks and publicity rights are separate concerns, particularly when an asset uses a recognizable brand, real person, or voice.

Copyright disputes over AI training and outputs remain fact-specific. In Bartz v. Anthropic, a court found fair use for training on lawfully obtained books but not for pirated library copies; final approval of a class settlement followed on July 20, 2026. In Kadrey v. Meta, summary judgment for Meta was based on the record before that court. On September 29, 2026, the Third Circuit found no fair use in Thomson Reuters v. ROSS, involving a competing legal-search tool. None of those cases decided whether a particular game asset infringes.

Separate litigation also underscores that these issues are unresolved. Disney and Universal sued Midjourney on June 11, 2025; Warner Bros. filed suit on September 4, 2025, and the cases were consolidated on November 4, 2025. The cases were undecided as of October 29, 2026. The complaints seek statutory damages of up to $150,000 per work for willful infringement; that is a claimed legal remedy, not a finding that any game developer owes that amount. A UK ruling in Getty Images v. Stability AI on November 4, 2025 concerned limited historic trademark infringement involving watermarked outputs; its scope and jurisdiction should not be mistaken for a general U.S. ruling on game assets.

What does Steam require you to disclose?

Steam has accepted games with generative-AI content since January 2024 and requires disclosure through its Content Survey. Valve narrowed the survey in January 2026 to focus on AI-generated content that ships with the game or is consumed by players, rather than efficiency gains from development tools.

Valve explained: “Efficiency gains through the use of these tools is not the focus of this section. Instead, it is concerned with the use of AI in creating content that ships with your game, and is consumed by players. This includes content such as artwork, sound narrative, localisation, etc.” Valve also states that prerelease reviewers evaluate AI-generated output like other content, and asks developers to describe guardrails for live generation. Steam says much of a developer’s disclosure will appear on the game’s store page, so it is not a private filing.

Pre-generated and live-generated content are different

  • Pre-generated: AI-assisted material created during development and shipped as fixed content. Examples include sprites, textures, character art, voices, music, dialogue, localisation, and store or promotional assets such as capsule art and trailers.
  • Live-generated: Content created with AI while the game is running, such as generated dialogue or images. Steam requires developers to explain guardrails intended to prevent illegal content. Players can report failures through the Steam overlay.

Routine use of coding assistants, debugging tools, or internal reference images that never ship is not the focus of Steam’s updated content section. But if the store page advertises AI use, make sure the survey describes the same use accurately. The Steam Distribution Agreement still requires the game to avoid illegal or infringing content and to match its marketing materials; a disclosure does not replace those obligations.

How do Steam and itch.io disclosure rules differ?

Both stores ask developers to disclose generative AI, but itch.io’s form explicitly includes code while Steam’s current focus is player-facing content. Complete each store’s form separately and describe the same game honestly in both places.

Store What to disclose What happens after disclosure
Steam Pre-generated content shipped with the game and live-generated content; live generation also calls for an explanation of guardrails. Valve says much of the disclosure will appear on the store page. Prerelease review evaluates generated output like other content.
itch.io Graphics, sound, text and dialogue, and code. Its guidance distinguishes generative AI from traditional game AI such as pathfinding, procedural levels, or dynamic difficulty. A “yes” response adds an “AI Generated” tag and relevant content-type tags. A “No AI” tag appears only if the creator explicitly marks the project as having no AI.

On November 20, 2024, itch.io administrator leafo announced the “Generative AI disclosure” field on project edit pages. The store’s Quality Guidelines, accessed October 29, 2026, say failure to tag an asset page may result in delisting and warn creators not to mass-upload automatically generated or AI-generated product pages. The same update distinguishes using a tool privately for information from inserting its generated code into the project: the latter is project content that should be disclosed.

For Apple’s App Store and Google Play, verify the live review and developer policies directly before submission; the exact current generative-AI disclosure text was not established here. Epic’s CEO Tim Sweeney argued in 2025 that stores should stop tagging AI-made games, but no current Epic Games Store disclosure rule was established as of October 29, 2026. Do not infer a store’s requirements from another store’s form.

How should you prepare an AI-assisted game for release?

Build an asset-by-asset record before submission. That makes it easier to check commercial permissions, prepare accurate store disclosures, and explain what human authorship you claim if you seek registration.

  1. Inventory player-facing and marketing material. Include art, audio, voices, text, localisation, capsules, trailers, and community items. Note which assets were generated, edited, or created without AI.
  2. Check each tool’s current terms for the plan used. Confirm commercial use, attribution, and any licence back to the vendor. Keep a dated copy or record of the applicable terms.
  3. Screen for third-party rights. Do not ship generated depictions of protected characters, brands, or real people without appropriate permission. Review outputs for recognizable copying, not just for whether the prompt was original.
  4. Keep human creative control where it matters most. Put people in the loop for distinctive characters, key art, story, and other assets that carry the game’s identity or that you would need to protect against copying.
  5. Keep a dated AI asset register. Record the tool, prompt or input, human edits, and who approved each asset for release. These records can help explain authorship to a publisher, insurer, or registration examiner.
  6. Complete each store’s form accurately. Describe categories of AI use in plain language, including shipped and promotional content where the form requires it. Keep store-page claims consistent with the survey answers.
  7. Limit any copyright claim to human authorship. If registering a game containing more-than-de-minimis AI material, disclose it and describe the human contributions—such as text, code, modifications, or creative arrangement—rather than claiming the generated material alone.
  8. Align contractor agreements. Require disclosure of AI use and address assignment of rights that exist, a backup licence or waiver for unprotectable portions, and indemnity language that specifically covers AI outputs.
  9. Plan controls for runtime generation. Explain guardrails in Steam’s survey and anticipate player reports if the game can generate dialogue or imagery during play.

Does the answer change outside the United States?

Yes. This article describes U.S. federal copyright policy and selected PC-store rules, not a worldwide authorship rule. The UK’s Copyright, Designs and Patents Act section 9(3) can attribute a computer-generated work to the person who made the arrangements for its creation, but a 2026 UK government process could change that protection. Verify the law before relying on it.

The EU generally requires human authorship for copyright in purely generated work, according to the available legal summaries. A Wuhan court in China protected an AI-assisted short drama in a decision dated September 23, 2026, but that ruling is not a U.S. rule. A Tokyo District Court decision on September 30, 2026 concerned publicity rights in AI-style narration imitating a voice actor, not copyright authorship of game assets. For a release across multiple countries, check local copyright, likeness, and consumer-disclosure rules rather than assuming a U.S. outcome travels with the game.

What is the practical takeaway for an indie developer?

A game does not become unsellable just because AI helped make it. The safer approach is to treat commercial permission, third-party clearance, store disclosure, and copyright ownership as separate checks. Keep the human-authored parts identifiable, disclose AI use honestly, and do not promise yourself exclusive copyright over content that is purely generated.

Frequently Asked Questions

Can I use AI for debugging without listing it on Steam?

Valve’s January 2026 explanation says efficiency gains from AI-powered development tools are not the focus of the Content Survey; the focus is content that ships and is consumed by players. itch.io asks about code inserted into a project, so its disclosure form can require an answer where Steam’s content survey does not.

Can I protect an AI-generated asset with a work-for-hire agreement?

A contract can allocate whatever rights exist between the parties, but it cannot create federal copyright in material that has no human author. Have agreements require disclosure and address licences or waivers for noncopyrightable material as well as assignment of copyrightable contributions.

Does a Steam AI disclosure mean Valve has approved every generated asset?

No. Valve says its prerelease review evaluates AI-generated output by the same standards as other content. Disclosure is a transparency requirement, not a finding that an asset is lawful, non-infringing, or approved for all purposes.

Can I rely on a vendor’s commercial-use terms after my subscription ends?

That depends on the exact tool terms and plan, which may set conditions for outputs created during or after a subscription. Save the terms applicable when you generated the asset and verify the licence’s duration and any continuing obligations before shipping.
