A crypto token is a broad kind of blockchain-based asset; an NFT is a non-fungible token, meaning it is distinguishable from other tokens rather than interchangeable with them. That technical difference does not tell you what rights a purchase includes, whether an asset is an investment contract, or how safely you can access it. Check the specific token, sale terms, and custody arrangement before buying.
What is the difference between a crypto token and an NFT?
“Token” is the broader term. Crypto assets can be issued as fungible units or as non-fungible units. Fungible units of the same token are generally interchangeable; an NFT is a distinct, identifiable unit. The National Institute of Standards and Technology (NIST) defines an NFT as “an owned, transferable, and indivisible data record that is a digital representation of a physical or virtual linked asset” in NIST IR 8472 (March 2024).

| Buyer question | Fungible crypto token | NFT |
|---|---|---|
| Are units interchangeable? | Generally, yes. Units of the same fungible token are interchangeable; ERC-20 is a common smart-contract representation. | No. Each NFT is non-fungible and distinguishable from others. |
| What does it represent? | Depending on its design and terms, it may serve different functions or represent different kinds of assets. | A blockchain record linked to a physical or virtual asset. The link alone does not establish what rights the buyer receives. |
| Does the label settle its legal status? | No. | No. |
| What should a buyer check? | Project or issuer promises, function, sale terms, custody, network, and legal context. | Creator or issuer terms, the linked content, any license or access rights, transferability, custody, and marketplace or network. |
“Generally” describes the category, not a guarantee that every implementation works identically. A token is not automatically a fungible coin, and an NFT is still a kind of token.

Does buying an NFT mean you own the art?
Not necessarily. The NFT is a blockchain record linked to an asset; it is not necessarily the image, video, game item, or other file itself. Buying the record also does not automatically transfer copyright or grant an unrestricted license. The rights depend on the sale terms and applicable law.

Before paying, find out what the token points to, what rights the creator or issuer says transfer, whether those rights are a license or ownership interest, and what happens if a linked website, app, or service stops working. Content availability and access may depend on services beyond the blockchain record.
Are crypto tokens or NFTs securities?
The words “token” and “NFT” do not by themselves answer that question. In the United States, a joint SEC and CFTC interpretation effective March 23, 2026, describes crypto assets through categories that include digital commodities, digital collectibles, digital tools, stablecoins, and digital securities. The agencies’ explanation focuses on characteristics, uses, and functions rather than relying only on labels. See the SEC/CFTC interpretation and the SEC’s crypto asset categories.

An asset that is not itself a security may still be offered or sold as part of an investment contract, depending on the representations, promises, and circumstances of the transaction. The SEC’s educational overview and transaction guidance explain this distinction. A collectible label is not a safe harbor, and tokenization alone does not make something a security. This is U.S. federal securities-law context, not a determination about any particular asset; other jurisdictions may apply different rules.

- Identify the asset. Confirm the network, contract or collection, token identifier where relevant, and the seller or issuer. Make sure the listing corresponds to the asset you intend to buy.
- Read the terms and promises. Check what transfers, what is merely licensed, what access or utility is promised, what can change, and what happens if a related site, application, or service closes.
- Check how the transaction works. Review the marketplace or platform, transaction and transfer fees, network compatibility, and whether the seller controls the asset being offered.
- Understand custody and recovery. Determine whether a platform or you control the credentials, how account recovery works, and what security, privacy, transfer, or withdrawal conditions apply. Never share a private key or seed phrase.
- Assess investment claims on their facts. Promises of appreciation, the issuer’s development efforts, and expectations of profit can matter to the U.S. investment-contract analysis. Do not treat a category name as a legal conclusion.
- Compare the whole purchase. Consider rights, utility, transferability, liquidity, reliance on an issuer or service, custody, fees, and the possibility of losing value or access—not just the asking price.
How custody affects access
A crypto wallet does not hold crypto assets in the way a physical wallet holds cash. Investor.gov explains that wallets store the private keys or passcodes used to access crypto assets. Losing or exposing those credentials can put access at risk. Read Crypto Asset Custody Basics for Retail Investors before deciding between a hosted custodian and self-custody.

For a hosted account, ask who controls the keys and what recovery and withdrawal arrangements apply. For self-custody, understand how you will protect and recover your credentials; a device or wallet choice does not remove key-management risk. In either arrangement, verify addresses and network details before transferring, since a mistake can jeopardize access.

- Credential loss or theft: losing or exposing access credentials can put control of the asset at risk.
- Unclear rights: the NFT record may not give you the copyright, broad usage rights, or access you assumed.
- Service dependence: linked media, game features, or other utility may rely on a website, platform, or issuer.
- Transfer friction: fees, network incompatibility, or marketplace rules can affect moving or selling an asset.
- Value and liquidity risk: the purchase may lose value, and a buyer willing to purchase it later may not be available.
These risks vary by asset and transaction. The general distinctions above cannot establish the rights, durability, or security of a specific collection, platform, issuer, or wallet.
