Yes—Fortnite is back on the U.S. App Store. Epic announced on May 19, 2026, that the game had returned to Apple’s App Store worldwide, including the United States. The legal fight is not over, however: Apple is still challenging parts of the injunction governing alternative payment links, App Store restrictions, and developer payments.
That makes the old framing—Epic going to court to force Fortnite back onto U.S. iPhones—outdated as a description of the current situation. The game’s distribution has been restored; the broader dispute over Apple’s App Store rules remains active.

What happened to Fortnite on iPhone?
On August 13, 2020, Epic Games activated an undisclosed payment option inside Fortnite that bypassed Apple’s in-app purchase system. Apple removed the game from the App Store for violating its developer agreement and payment rules.
Epic had deliberately triggered the confrontation. It immediately sued Apple and launched a public campaign arguing that Apple’s control over iOS distribution and payments restricted competition. Apple argued that Epic had breached its contractual obligations by implementing the payment change without permission.

The dispute therefore involved two related but distinct issues:
- Distribution: whether Epic could distribute Fortnite through Apple’s App Store.
- Payments: whether Apple could require developers to use its payment system, restrict links to outside payment options, and charge fees on transactions.
Apple’s account of the 2020 payment bypass and removal appears in its Supreme Court materials, including the appendix to its stay application.
What the original court ruling decided
The 2021 district-court judgment was not a complete victory for either side. The court largely rejected Epic’s federal antitrust claims, but it issued an injunction addressing how developers could communicate with users about alternative payment methods.
That distinction matters. Epic did not win a ruling that Apple’s entire App Store business model or all of its commissions were unlawful. The continuing case has focused heavily on the scope of the injunction and on whether Apple complied with it.

In later proceedings, Epic argued that Apple continued to impose restrictions that undermined the injunction’s protections for external payment links. Apple disputed that interpretation and sought to preserve aspects of its App Store rules.
What changed in 2025 and 2026?
On April 30, 2025, the district court found Apple in contempt over its handling of the injunction, according to Apple’s later court filings. The Ninth Circuit subsequently upheld the contempt finding while reopening a narrower question about whether Apple could impose a cost-based fee in some circumstances.
The appellate decision did not simply declare that every Apple commission was invalid. It addressed the specific legal obligations created by the injunction and the restrictions the courts found incompatible with it. The Ninth Circuit’s opinion and the Associated Press account of the ruling provide the relevant legal context.

Apple asked the Supreme Court to intervene. Justice Kagan denied Apple’s application for a stay on May 6, 2026, leaving the lower-court mandate in effect while the Supreme Court considered Apple’s petition. The stay docket is available from the Supreme Court.

Why did Fortnite return if the dispute continues?
Epic announced on May 19, 2026, that Fortnite was back on the App Store worldwide. Epic said the unresolved dispute concerned Apple’s payment terms and the conditions attached to returning—not simply whether the game could be distributed on iOS.
That creates an important practical separation:
- Access: U.S. iPhone and iPad users can find and download the official App Store version, subject to the usual account, region, device, and software requirements.
- Commerce: Epic and Apple still disagree about payment processing, fees, external links, and the restrictions Apple may impose.
- Litigation: The Supreme Court is reviewing a legal question about the injunction. It has not issued a final merits decision resolving the entire dispute.
Epic’s announcement said the return was worldwide but identified Australia as an exception at that time. Availability can also differ by region and can change independently of the U.S. case.

What is the Supreme Court considering?
The case is Apple Inc. v. Epic Games, No. 25-1311. On June 30, 2026, the Supreme Court granted Apple’s petition, limited to Question 1. That grant means the Court agreed to hear a specific legal issue; it does not mean the Court has ruled for Apple or reversed the lower courts.

The docket listed September 14, 2026, as the deadline for Apple’s merits brief and joint appendix, and November 13, 2026, as the deadline for Epic’s response brief. As of September 20, 2026, the docketed case remains an active Supreme Court proceeding. The current docket should be checked for later filings, scheduling changes, or a merits decision.
The Supreme Court’s review could affect how the injunction operates and what Apple may do regarding alternative payment links and related fees. It does not turn the game’s return into a pending question: Epic has already announced that Fortnite returned to the U.S. App Store.

- Open the App Store and search for Fortnite.
- Confirm that the publisher is listed as Epic Games, Inc.
- Download or update the official listing rather than using an unofficial installation file.
- Sign in with your Epic Games account if you want to access account-linked progress, subject to Epic’s account rules.
- Check the listing for your device’s current iOS or iPadOS compatibility requirements.
If you cannot find the game, do not assume that the court case has removed it again. Check your Apple account’s country or region, your device and operating-system compatibility, whether the app requires an update, and whether the service is experiencing a temporary distribution or review issue.
A listing on the App Store also does not guarantee identical performance, features, input support, or update timing across iPhone, iPad, PC, Android, and consoles. Avoid unofficial “Fortnite iOS download” sites, which can create account-security and malware risks.

Why the case matters beyond Fortnite
The legal fight could affect how developers direct users to payment options outside Apple’s in-app purchase system. The central questions are not limited to whether one game is available. They include how much control Apple can exercise over external payment links, whether it may charge a fee on transactions made outside its system, and what restrictions it can place on developer communications.
Those questions could matter to many App Store developers, but the outcome should not be described as a universal ruling that eliminates Apple’s commission structure. The applicable rules may depend on the transaction, developer, program, jurisdiction, and the final interpretation of the injunction.
Nor does Epic’s return mean that it permanently accepted Apple’s preferred payment terms. Epic chose to bring the game back while continuing to challenge the payment conditions it considers unlawful. Apple’s Supreme Court appeal remains a separate, unresolved stage of the dispute.
