Generative AI does not create one legal question for a game studio. Before release, you must answer four separate questions: do you have permission for the material entering the system, did people contribute enough expressive choices to claim rights in the shipped result, did an identifiable performer consent to any replica, and what must you disclose to a registry, storefront, or player? A tool licence rarely answers all four.
The right process is a feature-by-feature review tied to the applicable jurisdiction and contract. U.S. copyright analysis, performer agreements, Steam’s developer survey, and the European Union’s AI Act use different triggers and audiences. Treat the U.S. Copyright Office’s training report as agency analysis rather than a court ruling, and treat the European Parliament’s March 2026 resolution as a request for further action rather than an enacted disclosure rule.

What should a studio decide before releasing a game that uses generative AI?
Build an evidence trail for every AI-assisted feature, then make four decisions independently: input rights, human authorship, performer consent, and disclosure. A background tool used to brainstorm a texture raises a different set of issues from a live NPC that imitates a named actor and generates dialogue for players.
- Input rights: identify every script, image, recording, code sample, player submission, reference work, and fine-tuning dataset that enters a model. Record its source, licence, restrictions, and the terms that apply to the model or vendor.
- Human authorship: show which people selected, arranged, rewrote, edited, directed, or otherwise determined expressive elements in the shipped asset.
- Replica consent: establish whose voice, face, movement, or other performance is reproduced, under which contract, for which project and uses, and what happens if the feature changes.
- Disclosure: separate notices for a copyright-registration application, a storefront questionnaire, an EU-facing product, and an in-game player communication.
Do not use a single “AI used” statement as a substitute for those records. The same asset can require a rights analysis in the United States, a specific contractual permission for a performer, a Steam survey response, and an EU disclosure—or none of those, depending on the feature and release markets.

Can I copyright AI-generated game art?
In the United States, an AI-assisted asset can contain protectable human expression, but a prompt alone does not establish authorship of expression determined by a model. Whether a particular image, animation, dialogue passage, or code file qualifies depends on what a person actually contributed and how that contribution appears in the final work.
Separate the prompt from the expressive decisions
Keep the prompt in your records, but do not treat its existence as proof of authorship. A stronger record identifies the human decisions that shaped the result: choosing among generations, compositing elements, repainting anatomy, timing an animation, rewriting dialogue, directing a performance, editing code, or arranging assets into a distinctive sequence. The U.S. Copyright Office’s January 2025 analysis recognizes protection when a human determines sufficient expressive elements, while declining to treat prompts by themselves as authorship.
Copyright Office Register Shira Perlmutter summarized the principle in the agency’s January 29, 2025 announcement: “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.” The surrounding qualification matters: human creativity remains the requirement, and protection is assessed for the human-authored material rather than automatically for every model output.
What should a U.S. registration application say?
For a U.S. registration, describe the human contributions and exclude more-than-de-minimis AI-generated material from the claim, following the Office’s guidance. Preserve the version history, source files, edit logs, art direction notes, and contribution statements that allow counsel to identify what a person created. Do not promise that a game’s entire asset package is protected without examining each material component.
A tool licence does not settle this question. It may grant permission to use the service, while leaving authorship, output restrictions, indemnities, and rights in uploaded material to separate terms. Read the terms in force for the specific account, model, and use case, and retain a dated copy.
Can I train an NPC on copyrighted dialogue?
There is no automatic fair-use answer for training. The U.S. Copyright Office describes a fact-sensitive inquiry that can depend on the works used, their source, the purpose of training, controls on outputs, and effects on relevant markets. Its report is a pre-publication agency analysis, not a judicial decision that clears or prohibits a particular game.

Inventory what enters training or fine-tuning
Start with a dataset register. For each item, record the creator or licensor, acquisition route, territory, licence scope, restrictions on machine learning or derivatives, and deletion or opt-out obligations. Include internal scripts, contractor material, player submissions, voice recordings, reference art, music, localization files, and code. “Publicly accessible” is not the same as “automatically cleared for training,” but it is also inaccurate to say every use is necessarily infringing. The Office notes that licensing markets are unevenly developed and cautions against prejudging a particular fair-use case.
Control the model’s outputs
Document technical and editorial controls that reduce the chance of memorized or substantially similar output: dataset filtering, duplication checks, prompt restrictions, retrieval boundaries, refusal rules, human review, and escalation. These controls may be relevant evidence in a rights analysis, but they are not a legal safe harbor. A model that can reproduce a recognizable passage still requires a response plan, including quarantine, replacement, and an incident record.
What if the NPC generates dialogue at runtime?
Runtime generation adds a second layer. A studio must assess the training material and the player-facing output separately. Define whether player prompts can introduce protected text, how the game handles requests for a living author’s style or a specific character, what moderation occurs before display, and whether problematic output can be logged and removed. The product specification should state who can change the prompt, model, retrieval corpus, or safety settings after launch.
Do voice actors have to consent to AI voices?
Consent requirements depend on the person, the project, the applicable jurisdiction, and the contract. For work covered by SAG-AFTRA’s 2025 Interactive Media Agreement, the union’s FAQ describes a reasonably specific intended-use description, including project and role information and whether dialogue will be generated in real time. Those terms are not a universal rule for every actor or game.

Match permission to the actual replica
Ask whose identity is being reproduced and what the system can generate. A licence to record a performance for one character in one title may not cover a synthetic voice in a sequel, downloadable content, advertising, another game, or an unrelated conversational assistant. Record duration, territory, media, compensation, approval or notice rights, storage and security, model-training permissions, and the process for changing the use.
The union’s materials also explain that consent under the cited agreement can cease to authorize a use that no longer fits the reasonably specific description, and discuss suspension connected with strike activity. Do not convert that into a claim that every performer can freely revoke every consent at any time; the contract and facts control.

Document alternatives and change control
Keep an approved reference performance, the final synthetic output, and the contract version together. If the feature expands from pre-recorded lines to live dialogue, stop and obtain a coverage analysis before enabling it. A change-control checklist should identify new games, characters, languages, promotional uses, and model capabilities, then route the change to the person responsible for performer agreements.
For context, SAG-AFTRA reported that 95.04% of voting members approved its 2025 Interactive Media Agreement. That figure records the ratification vote; it does not show how common digital replicas are or establish coverage for a non-union production.
Do I have to disclose AI on Steam?
Steam’s Content Survey asks about player-consumed AI content, including the distinction between pre-generated material and content generated while a game runs. Developers using live generation are asked to describe guardrails against illegal output. Completing the survey is an information submission, not authorization to include infringing material.
Answer for what players actually consume
Separate internal assistance from shipped content. A private brainstorming image may not be player-consumed AI content, while an AI-written quest, generated localization, synthetic voice, or runtime image is. For each feature, record whether the result is fixed before release or generated during play, whether players directly prompt the system, and which moderation and refusal controls operate in production.
Prepare a live-generation description
For a live NPC or other runtime system, be ready to explain the guardrails in product terms: input filtering, output screening, blocked categories, fallback lines, rate limits, reporting, human escalation, logging, and the procedure for disabling the feature. These are implementation questions, not a guarantee that any particular safeguard satisfies a law or platform policy. Recheck Steam’s current survey wording before submission because platform questions can change.
Does the EU require an AI label in games?
Not every AI-assisted game asset receives the same notice. Article 50 of the EU AI Act creates different duties for providers and deployers, including rules for direct AI interactions, machine-readable marking of covered synthetic output, and disclosure of qualifying deepfakes. Article 50 has applied since August 2, 2026. The limited December 2, 2026 transition concerns the specified marking obligation for qualifying systems placed on the market earlier; it does not postpone every notice.

Determine your role and the feature
For each system, determine whether the studio is acting as a provider, a deployer, or both, and whether players directly interact with the AI. Then test the output against the Act’s definition of a deepfake rather than assuming that every fictional character or generated texture qualifies. A synthetic asset can be fictional without reproducing an identifiable person.
Understand the human-facing notice
Where a qualifying deepfake is presented in a creative or fictional work, the applicable disclosure can be made in a way that does not unnecessarily disrupt enjoyment. That flexibility changes the manner of disclosure, not whether a disclosure exists. The European Commission’s guidance also indicates that a human-facing deepfake notice cannot be satisfied merely by an embedded machine-readable mark.
The European Parliament’s March 2026 resolution calls for further action; it is not itself a binding, blanket requirement to label every AI asset in a game. Check the current Act, Commission guidance, national implementation information, and the studio’s provider or deployer role before release in the EU.
How should a studio run the review in production order?
Use one record per feature or asset family and move through these decisions before content lock.

Which workflow is lower risk: human-created, AI-assisted, fixed, or live?
No workflow is automatically cleared, but the comparison below shows which questions become more demanding as a feature moves toward live generation or identity replication.
| Workflow | Primary rights question | Human-authorship record | Consent and disclosure focus |
|---|---|---|---|
| Human-created shipped asset | Are the source materials and contributors properly licensed? | Creator identity, drafts, assignments, and approvals | Ordinary contract and platform review; no AI-specific conclusion follows automatically |
| AI-assisted shipped asset | What entered the system, and were those inputs permitted? | Human selection, arrangement, rewriting, modification, and direction | U.S. registration description may need AI-generated material excluded; platform treatment depends on player exposure |
| Licensed original performance | Does the contract cover the recording and intended uses? | Performance and editorial records | Contract scope, duration, territory, project, and later-use changes |
| Licensed digital replica | Does the permission specifically cover synthetic reproduction? | Reference performance, model version, approvals, and output review | Union or individual agreement, real-time dialogue terms, changed uses, and any applicable player notice |
| Fixed AI output | Can the shipped result be traced and reviewed before release? | Final-selection and editing trail | Storefront survey category and any jurisdiction-specific disclosure |
| Live NPC dialogue or other live generation | Can training, retrieval, prompts, and outputs introduce protected material? | System design, prompt ownership, moderation, and change logs | Steam live-generation questions, player interaction controls, incident response, and possible EU duties |
What records should remain after launch?
Retain the asset register, dataset and prompt inventories, model and vendor terms, contracts, performer-use descriptions, approval logs, versioned outputs, moderation rules, Steam submission, registration disclosures, and EU role analysis. Tie each record to a build number and release territory so a later patch can be evaluated against the permission originally granted.

Set an owner and review date for every live feature. A model update, new retrieval source, language expansion, sequel, advertising use, or player-prompt change can alter the rights and disclosure analysis even when the game’s name stays the same.
What should a studio do if a feature changes after approval?
Pause the changed feature, compare the new use with the original input licences and performer description, and route the difference to legal and production owners. Re-run the player-exposure and storefront analysis if output moves from fixed to live, if players gain direct prompting, or if a synthetic performance is added. Update notices and records before the build containing the change is distributed.
Frequently Asked Questions
Can a game studio use public internet text to train an NPC?
Public availability does not establish permission to copy or train on the material. Keep a source and licence record, assess the purpose, controls, and market effects for the specific dataset, and obtain project-specific advice where the material is important to the product.
Does hiring a voice actor automatically allow a synthetic voice later?
No. A conventional recording licence may not describe model training, digital replication, real-time generation, sequels, advertising, or other later uses. The permission should identify the intended replica use with enough specificity for the contract and the project.
Is a credits notice enough to satisfy AI disclosure rules?
A credits entry reaches a different audience and may not appear where a player interacts with an AI system or views a qualifying synthetic depiction. Determine the trigger and required format for the storefront, jurisdiction, and feature instead of relying on one universal notice.
What is the difference between a machine-readable AI mark and a player notice?
A machine-readable mark is designed for technical detection by systems, while a player notice communicates directly to people. Under the EU Commission’s explanation of applicable deepfake duties, an embedded machine-readable mark alone may not replace a human-facing disclosure.
