Google lost its appeal in Epic Games v. Google. On July 31, 2025, the U.S. Court of Appeals for the Ninth Circuit affirmed the jury’s antitrust verdict against Google and upheld a broad injunction affecting Google Play’s app-distribution and billing practices. Google later sought Supreme Court review, but that petition was dismissed under Rule 46 on March 9, 2026. The Supreme Court never issued a merits ruling against Google.
The result is a major legal victory for Epic, but it does not mean that Google Play disappears, every Android phone immediately gains another app store, or the Epic Games Store is automatically available through Google Play. The injunction opens a legal path for rival stores and alternative payment options while allowing Google to maintain reasonable security controls.

The short version
- The Ninth Circuit affirmed the jury’s finding that Google unlawfully maintained monopoly power in Android app distribution and related in-app billing markets.
- It upheld an injunction requiring Google to let rival Android app stores access the Google Play catalog and be distributed through Google Play.
- Developers must be allowed to provide users with information about alternative billing, pricing and distribution options.
- Google cannot use certain incentive or exclusivity arrangements to favor Google Play.
- Google may still impose reasonable technical and security requirements.
- The injunction is a three-year remedy, not a permanent order abolishing Google Play.
- Epic said its Android store would come to Google Play, but the ruling did not automatically approve or launch that listing.
How the Epic and Google dispute began
The case grew out of Epic’s challenge to Google’s rules for distributing Fortnite and processing in-app purchases. Google required apps distributed through Google Play to use Google Play Billing for relevant transactions. At the time described in the Ninth Circuit’s opinion, Google and Apple charged a 30% commission on the relevant in-app transactions.

But the lawsuit was never only about one game’s delisting. Epic challenged Google’s control over Android app distribution, in-app payments, developer communications, rival app stores and agreements involving developers, device manufacturers, carriers and other distributors.
Epic’s case against Google also should not be confused with Epic Games v. Apple. The Apple case was resolved in Apple’s favor, while a jury found for Epic in the Google litigation. The cases involved different records, legal theories, markets, procedures and remedies.
What the jury found
On December 11, 2023, a unanimous jury found Google liable on Epic’s antitrust claims under federal and California law. The jury found that Google:

The jury identified relevant markets for Android app distribution and Android in-app billing services. It described the geographic market as worldwide excluding China. That geographic limitation matters: the verdict should not be presented as a ruling governing the Chinese Android ecosystem.
The jury’s verdict established liability, but it was not the complete remedy. The district court held additional proceedings before entering an injunction on October 7, 2024. The Ninth Circuit later reviewed both the liability findings and the resulting remedy.
What the district court ordered Google to change
Rival app stores must receive access to the Play catalog
The injunction requires Google to permit third-party Android app stores to access the Google Play catalog of apps. This is intended to reduce the advantage Google receives from controlling the largest distribution channel for Android applications.
Rival stores must be allowed to use Google Play as a distribution channel
Google must allow third-party app stores or app-distribution platforms to be distributed through Google Play. That does not mean Google must accept every submission without review. Google can apply reasonable technical and security measures, but those measures cannot be used as a pretext to exclude rival stores.

Developers can communicate alternative options
Developers offering apps through Google Play must be able to provide users with information about alternative billing, pricing and distribution channels. This addresses “steering” restrictions that can prevent developers from telling customers that another payment method or store exists.
Some exclusive arrangements are restricted
The injunction also limits Google’s ability to provide certain benefits to developers, app distributors, original equipment manufacturers and carriers in exchange for favoring Google Play. It does not automatically cancel every commercial contract or make every agreement involving Google invalid; the precise restrictions depend on the injunction’s terms.
The remedy lasts three years
The relevant injunction provisions operate for a three-year remedy period. That makes the order substantial, but it is inaccurate to describe it as a permanent loss of Google’s ability to operate Google Play.
What the Ninth Circuit decided on July 31, 2025
The Ninth Circuit did more than deny an emergency request or reject a procedural motion. It affirmed the jury’s verdict and upheld the district court’s injunction. The court rejected Google’s challenges to the market definitions, trial procedures, jury instructions and scope of the remedies.

Google argued, among other things, that Epic’s position about the relevant market conflicted with Epic’s litigation against Apple. The court rejected that argument. The Ninth Circuit also addressed whether the case could be tried before one jury alongside Google’s counterclaims, whether the jury should have received a single-brand aftermarket instruction, and whether the Rule of Reason instruction was legally adequate.
Google further argued that the injunction was too broad, insufficiently specific and disconnected from the violations found at trial. The appellate court rejected those arguments and concluded that the remedies were sufficiently connected to the competitive harms established in the case.
The full appellate decision is available in the Ninth Circuit’s July 31, 2025 opinion.

Does this put the Epic Games Store inside Google Play?
No—not automatically. The ruling creates a legal pathway that prevents Google from categorically blocking rival app stores, but it does not guarantee immediate approval, a particular Play Store listing, favorable ranking or successful user adoption.
Google may apply reasonable protections addressing technical and security concerns. Those protections must be comparable to the safeguards Google already applies to apps and cannot become a disguised way to exclude competition.
After the Ninth Circuit decision, Epic CEO Tim Sweeney said the Epic Games Store for Android would be coming to Google Play. Epic’s Android store was already available through Epic’s website, but Epic’s statement was a plan or public announcement—not proof that a Google Play listing was already live.
Even if a rival store is accepted, several separate questions remain: whether users can find it, whether developers publish their apps there, whether payment systems work smoothly, and whether the store can earn enough trust and scale to compete with Google Play.
What the ruling means for Android users
Android users could eventually gain more ways to discover and install app stores, access competing app catalogs and use payment options other than Google Play Billing. Competition may give developers more leverage to negotiate fees or offer different prices.

The injunction does not require every Android device to display multiple app stores, make every app cheaper or eliminate Google Play. Device configuration, regional implementation, developer participation and user behavior will all affect what people actually see.
More choice also brings trade-offs. Different stores may provide different levels of malware screening, update reliability, refunds, parental controls, content moderation and customer support. Google’s security concerns are therefore relevant, but the Ninth Circuit did not accept them as a justification for the broader exclusionary practices challenged by Epic. Instead, it preserved room for reasonable security measures.

What the ruling means for developers
Developers may gain greater freedom to tell users about alternative payment methods and distribution channels. They may also gain additional routes to reach Android users and more negotiating leverage over commissions and store terms.
That legal freedom does not automatically create a better or cheaper business model. A developer using another store may need to manage additional publishing workflows, technical integrations, fraud prevention, subscriptions, taxes, refunds and customer support. It may also need to persuade users to trust a new store and keep it installed.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteAlternative billing can change who processes a transaction, but it does not make payment operations disappear. Developers still have to handle the practical obligations of commerce, and the exact economics depend on the injunction’s implementation and any later court orders.
Likewise, access to the Play catalog does not necessarily mean identical ranking, merchandising, promotional placement or technical support. A rival store can receive a legal opportunity to compete without immediately attracting enough developers or users to challenge Google Play commercially.

Google continues to operate Google Play. The ruling limits how Google can use its position, rather than ordering it to shut down the store or surrender ownership of it.
The most important change is competitive access: rival stores must be able to seek catalog access and distribution through Google Play, while developers must be able to communicate alternative billing and distribution options. Google retains the ability to operate its own store, enforce reasonable security standards and maintain safeguards for users.
That means “Android is completely open now” is also wrong. Android has long been more modifiable and distributable than iOS, but Google Play remains a powerful gatekeeper in the Google Android ecosystem. The injunction expands the space for competition; it does not eliminate the technical, commercial and trust advantages of Google Play.

How the Supreme Court proceedings changed the headline
The Ninth Circuit’s decision was issued on July 31, 2025, and rehearing was denied on September 12, 2025. Google then sought Supreme Court review. The Supreme Court denied Google’s application for a partial stay on October 6, 2025, meaning the injunction was not paused through that request.
Google’s petition was later dismissed after Google and Epic jointly stipulated to dismissal. The Supreme Court docket records the dismissal under Rule 46 on March 9, 2026.
So the precise current description is: Google lost in the Ninth Circuit, failed to obtain a stay of the injunction, and later had its Supreme Court petition dismissed. The Supreme Court did not issue a merits opinion holding that Google violated antitrust law.
The main appellate ruling therefore remains the controlling appellate decision in this litigation, subject to implementation questions, compliance disputes and any future proceedings concerning the injunction.
What happens next
The legal opening created by the injunction is only the first step. The competitive result will depend on how Google implements the access requirements, how courts resolve disputes over technical and security conditions, whether rival stores participate, whether developers publish through them and whether users adopt them.
The case also does not establish that Fortnite is currently available on Google Play. The legal ruling and the game’s practical availability are separate questions, and the existence of the injunction should not be treated as confirmation of a current Fortnite listing.
For users, the likely effect is gradual rather than a single dramatic redesign of Google Play. For developers, the more immediate significance may be increased freedom to communicate alternative options and negotiate distribution and billing arrangements.
Bottom line
Epic won a major antitrust victory against Google. The Ninth Circuit affirmed the jury’s findings and upheld a three-year injunction that opens Google Play to rival app stores, protects developer communications about alternative billing and distribution, and restricts certain exclusionary arrangements.
But the ruling is not an order handing Google Play to Epic, guaranteeing an Epic Games Store launch, or making every Android app cheaper. It removes important barriers and creates room for competition. Whether that room becomes a durable alternative to Google Play will depend on execution, security, developer participation and user trust.
