Yes, an AI-generated 3D asset may be usable in a commercial game, but that depends on more than whether the generator permits commercial use. Check the generation service’s terms, the specific asset license, any marketplace publishing rules, and whether the asset includes material that may belong to someone else. Those permissions do not automatically give you copyright ownership of the output or establish that every right in it has been cleared. This guide focuses on U.S. copyright guidance and examples from Unity, Fab, and Epic; it is not legal advice, and rules and platform terms differ by jurisdiction and can change.
What does “commercial use” mean for a game asset?
For a game developer, commercial use usually means incorporating an asset into a game or related project that is sold, monetized, or otherwise distributed commercially. That is not necessarily the same as being allowed to sell or share the asset file itself. A license might permit an asset to appear inside a finished game while restricting standalone resale or redistribution of the model, textures, or source files.

It helps to separate three questions that are often blurred together:
- Permission: Do the generator’s terms and the asset’s license allow the specific use you have planned?
- Copyright: Is any part of the asset protected by copyright, and if so, who owns or controls those rights? Permission to use an output is not the same thing as owning copyright in it.
- Third-party rights: Does the asset contain recognizable material—such as a character, logo, brand, or copied design—that may belong to someone else?
A “yes” to the first question does not answer the other two. A tool may allow commercial use of generated outputs while leaving unresolved whether a particular output is copyrightable, whether it resembles protected material, or whether a marketplace will accept it.

Can I use AI-generated 3D models in a commercial game?
Possibly. First confirm that the generator’s applicable terms allow the intended use of its output. Then check any separate marketplace or asset-level license that applies to the model. Finally, assess the asset itself for third-party material and comply with any rules imposed by the store where you plan to publish it.
The U.S. Copyright Office’s 2025 guidance says that using AI as an aid, or including AI-generated material in a larger human-generated work, does not bar copyrightability. That statement does not mean every purely machine-generated asset is protected by copyright, nor does it decide the status of any specific model. For an individual asset, the relevant facts may include what a person contributed and what expression the person authored. The Office’s announcement is general guidance, not a determination of a particular workflow.
As a practical matter, consider the game’s distribution model separately from the asset’s creation. Embedding a model in a shipped game may be covered by a license that does not permit offering that same model as a standalone download. A license can also distinguish source-file access from use in a finished project. The precise grant and restrictions in the applicable terms—not the fact that the model was AI-generated—determine what uses are permitted under the agreement.

Do I own an AI-generated game asset?
Do not assume that you own copyright in an output simply because you prompted a generator, paid for a service, or received permission to use the result commercially. Copyrightability and contractual permission are different issues. The U.S. Copyright Office’s 2025 statement leaves room for copyright in human-authored expression, including human-generated work that incorporates AI-generated material, but it does not establish that a purely machine-generated output is copyrightable.
If you edit an asset, keep a record of what you changed and which parts reflect your own creative work. Save project files, versions, notes, and other creation records that help explain the human contribution. These records may be useful when describing provenance or assessing rights, but no particular amount of editing should be treated as a guarantee of copyright protection.
Also distinguish ownership from a license. A license can authorize use without transferring ownership, and a seller’s license can only provide the permissions that the seller is entitled to grant. Before relying on an asset, establish who made or generated it, what license applies, and whether the seller has authority to offer it on those terms.

How do tool terms, asset licenses, and store policies differ?
These are separate rule sets. The AI generation service may set terms for using its output. A marketplace license may govern a model obtained from that marketplace. A destination store may impose submission, disclosure, or content requirements for publishing the asset there. Read the terms that apply to the exact asset and workflow rather than assuming one platform’s permission answers every question.

Fab describes its marketplace as supporting Unreal Engine, Unity, and other 3D formats. Format compatibility is not evidence that an individual asset is rights-cleared. The license for the specific product and the seller’s authority still matter.
Can I sell a game that uses AI-generated assets?
A game may be commercially distributable under the relevant terms even when an included asset is not itself for resale. Fab’s Standard License summary illustrates that distinction: it describes commercial distribution of projects incorporating assets while forbidding standalone resale or free redistribution of the asset. The full EULA, selected license, and asset-specific terms govern; a summary alone is not binding.

Before shipping, map the planned distribution to the actual license grant. Consider whether the game will be sold, offered free, monetized through another model, distributed across several platforms, or developed with collaborators. Verify whether the license covers those circumstances, modifications, and any source-file access your team needs. The available facts do not establish one universal permission for every asset, generator, or business model.
Be particularly careful when your project exposes the model file, rather than only incorporating it into the game. A standalone asset pack, mod kit, downloadable source project, or other distribution that lets recipients extract or reuse the asset may raise a different licensing question from shipping a finished game. Check the license’s redistribution language instead of assuming that permission to distribute a project covers every way of sharing its contents.

What must I disclose when publishing AI-generated assets on Unity?
Unity’s publisher guidance requires the publisher to identify the specific AI tools used and the content generated using AI in the “AI description” field, using plain language without marketing copy. It also calls for describing modifications that add value beyond the generation result. The guidance says not to use wording that implies human effort—such as “drawn,” “hand drawn,” or “painted”—for AI-generated or AI-assisted material when that wording would misrepresent how it was made.

Unity also reserves the ability to reject mass-produced AI submissions that do not provide sufficient differentiation or customer value. These are Unity Asset Store submission requirements, not a universal legal disclosure rule. A disclosure that satisfies a platform field does not by itself establish copyright ownership, clear third-party rights, or satisfy the terms of another store.
When preparing a listing, describe the workflow plainly: identify the tools and generated material, then state the meaningful modifications you made. Avoid implying that a person performed work that was generated by a tool. Check the current publisher guidance before submitting, since platform policies can change.
How should I screen an asset for third-party rights?
A permissive commercial license is not a warranty that an output contains no third-party material. Review the actual model, textures, labels, and other included content for recognizable characters, logos, brands, or designs. Epic’s marketplace guidelines state that products must not use copyrighted or trademark-protected names, branding, or content unless the seller owns or is adequately licensed to use them.

If an asset visibly incorporates another party’s character or branding, ask for documented permission or choose a different asset rather than relying only on the seller’s general assurances.
- Inspect the asset and its preview images for recognizable third-party characters, logos, brands, or copied designs.
- Ask who created or generated the asset and whether the seller has authority to license it.
- Request documentation when permission is needed for identifiable third-party material.
- Keep a record of your review and the seller’s representations.
A practical pre-release checklist
- Identify every governing term. Save the generation service terms, the asset listing, the selected license and tier, and any applicable marketplace EULA as they existed when you acquired the asset.
- Match the grant to your use. Confirm that the license covers your game’s distribution, collaborators, platforms, revenue model, modifications, and source-file needs.
- Check redistribution limits. Determine whether the asset may be embedded in a project but not resold, shared, or distributed as a standalone file.
- Record provenance and human changes. Keep prompts or workflow records where available, the original output, project versions, and a clear account of modifications. Do not treat documentation or editing as a guarantee of copyright.
- Review for third-party content. Screen for recognizable characters, logos, brands, and copied designs; seek documented permission when needed.
- Follow the destination store’s rules. For Unity Asset Store submissions, complete the AI description accurately and review the current acceptance requirements.
- Escalate higher-risk cases. Get qualified legal advice for a high-value release, disputed provenance, or material similarity to third-party content.
What is not settled by these examples?
The U.S. Copyright Office guidance does not resolve copyrightability or infringement under every country’s laws, and it does not decide the status of an individual AI workflow. The examples from Unity, Fab, and Epic apply to their own terms and publishing rules; they do not establish universal rules for other platforms or services. The facts described here also do not establish the training or generation provenance of a particular asset or settle any individual dispute.
For a release outside the United States, check the law and marketplace terms that apply in the relevant jurisdiction. For any release, use the live, product-level license and publishing rules in force when you make the relevant decision rather than relying on a general platform description.
