The strongest proof that you made an artwork is a dated, continuous record of how it came into existence: early sketches, written decisions, native working files, layered revisions, preserved metadata, independent time evidence, and records showing who supplied references or commissioned the work. Keep the originals in a controlled archive and use copyright registration when the value or risk justifies it.
This evidence supports authorship and chronology; it does not make an unprotectable idea copyrightable, guarantee a court will accept every file, or settle ownership when a contract assigns rights to someone else.

What your documentation can prove—and what it cannot
Copyright generally begins automatically when an original work of authorship is fixed in a tangible form. The U.S. Copyright Office describes a work as original when it is independently created and contains at least a minimal degree of creativity. Copyright protects the expression you created, not an idea, procedure, method, system, concept, principle, or discovery.

A process archive helps answer two practical questions in a dispute: did you create this particular expression, and when did your version exist? A sequence of thumbnails, rejected compositions, layered files, and dated exports can show development that would be difficult for a copier to recreate after the fact. It can also expose which parts came from a collaborator, a licensed reference, a client, or a pre-existing asset.

Evidence is persuasive when it is contemporaneous, internally consistent, and preserved in its original form. A single screenshot or editable timestamp can be altered, stripped, or misunderstood. Treat every item as one piece of a chain rather than as a magic certificate of authorship.
Build an evidence trail from the first idea
1. Capture the beginning
Before an artwork becomes polished, photograph or scan the material that shows the initial creative problem. For a game artist, that might include character thumbnails, environment silhouettes, sprite tests, UI wireframes, color scripts, or a page comparing visual references. Record enough context that another person can understand what was being explored.
- Date the entry using a consistent format such as YYYY-MM-DD.
- Write a working title, even if it later changes.
- Identify the medium and intended dimensions or resolution.
- Describe the creative question, such as “testing three silhouettes for a playable scout character.”
- List references you consulted and mark whether each is your own, licensed, supplied by a client, or used only for general ideas.
Photograph physical pages straight on, in good light, with the page number visible. Keep the unedited camera file as well as any crop or color correction. For digital beginnings, save the first native file instead of relying on a flattened preview.

2. Keep a chronological process journal
Use a bound, acid-free sketchbook for physical work, or a paginated digital journal for screen-based work. Number pages or entries before filling them, date every entry, and describe meaningful changes rather than writing only “worked on art.” Note why you changed a pose, discarded a palette, rebuilt a layer, or selected one composition for further development.
The U.S. Copyright Office’s visual-art guidance uses a creator’s daily diary with artwork as an example of potentially protectable authorship. That does not mean every diary entry is automatically protected or that a diary alone wins a dispute. Its value is that regular, specific notes connect your decisions to the resulting expression.
For a team, identify the author of each entry. If several people contribute, use initials or account names consistently and add a short description of each person’s contribution. Do not silently rewrite old entries; add a dated correction that explains what changed.
3. Preserve intermediate states
Save native working files at significant milestones: rough layout, refined drawing, line art, color block, lighting pass, final retouch, and delivery export. Preserve layered files, animation timelines, vector paths, 3D scene files, brushes or custom assets that materially show your work, and drafts that demonstrate rejected choices.
Use stable, sortable filenames such as 2026-10-19_title_stage-03. Add a short change note in a read-only log or project file. Never overwrite the only copy of an earlier stage. If your software has version history, export periodic snapshots because a cloud service may later change retention rules or account access.

Keep the original file format alongside viewable formats such as PNG, JPEG, PDF, or a video capture. A flattened export proves what was delivered; the native file can show layers, paths, masks, timing, and edits that establish how it was made.
4. Preserve digital metadata without trusting it alone
Embedded EXIF or other metadata may identify a work, camera or device, software, creation date, copyright notice, contact details, and licensing information. The World Intellectual Property Organization explains that metadata can identify a work and provide licensing information.
Metadata is fragile. Export settings, editing programs, social platforms, messaging apps, and content-management systems may strip or rewrite it. Keep the camera original or native project file, make a separate metadata report when practical, and record the software version, device, color profile, resolution, and export settings in your journal. Treat displayed “created” dates as supporting information, not an immutable clock.
5. Add independent time evidence for important work
For high-value commissions, unreleased game assets, or work likely to be copied, consider a reputable timestamp or deposit service. WIPO notes that “A specialized time stamping service may be involved to certify the time a document was created.” Such a service can add an independent record that a particular file or fingerprint existed at a stated time.
Evaluate the service before relying on it:
- What exactly is recorded—the full file, a cryptographic hash, a deposit, or only an account event?
- How are the provider’s clock, identity checks, and audit logs protected?
- How long are deposits retained, and can you export a readable certificate and the original submission?
- Where is the provider located, and what jurisdiction governs its terms?
- Can you prove that the file you later present is the same file that was timestamped?
A timestamp can establish that a file existed by a certain time. It does not, by itself, prove who created it, that every layer is authentic, or that the underlying idea is protected.
6. Maintain at least two separate backups
Keep two or more copies in physically or logically separate locations. A practical arrangement is a working drive, an automatically updated backup, and a second backup that is disconnected or stored elsewhere. Test restoration periodically; a backup that cannot be opened is not evidence.
Retain original files in read-only storage when possible. Use access controls and record who can modify the archive. If you migrate to new media, preserve the old copy until the new one has been checked. Keep a simple inventory listing filename, format, date range, storage location, and checksum or other integrity marker if your workflow supports it.

Written commissioning terms matter. The U.S. Copyright Office notes that a work-made-for-hire agreement can change who owns copyright. The legal effect depends on the jurisdiction, the type of work, and the contract language. Preserve signed agreements and amendments, not just a payment receipt or a chat message.
For collaborative game art, identify each contributor’s role, the date of each contribution, the files delivered, and the rights granted. If you combine your work with a client’s design document or another artist’s asset, document the boundary between pre-existing material and your original additions.
A repeatable documentation workflow
Use the following sequence for each substantial artwork or game-art asset. Adapt the level of detail to the project’s value and risk, but do not skip the first and last steps.
The Tool Desk
Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →- Open a project record. Assign a project ID, working title, creator names, medium, intended use, and start date. Store the record with the artwork.
- Save the first material. Scan or photograph sketches and tests, or save the first native digital file. Include the date and page or file number in the record.
- Log decisions as you work. After a meaningful session, write what changed, why it changed, and which file represents the new state.
- Save milestone versions. Use a filename such as
2026-10-19_title_stage-03, then make the version read-only or copy it to protected storage. - Export a viewable proof. Create a PNG, PDF, or video capture that can be opened without your specialist software, while retaining the native source.
- Record technical details. Note device, software and version, dimensions, resolution, color profile, layers, plug-ins, and export settings when they affect the result.
- Check metadata. Preserve embedded metadata in the original and save a separate report or screenshot if your software provides one.
- Add independent time evidence when justified. Submit a hash or deposit to a service you have evaluated, then export and archive the receipt or certificate.
- Inventory rights and contributors. Attach contracts, licenses, releases, invoices, and a contribution log before delivery.
- Back up and verify. Copy the complete package to separate locations, open sample files from each backup, and record the verification date.
- Register strategically. If the work is a U.S. work and its commercial value or infringement risk warrants it, review Copyright Office registration requirements and submit an accurate application.
Choosing the right evidence mix
| Method | Best use | Strength | Limit or maintenance need |
|---|---|---|---|
| Physical journal | Sketches, handwritten decisions, material tests | Tactile pages and visible sequence are easy to inspect | Can be lost or damaged by moisture; date and number pages consistently |
| Native digital archive | Layered illustrations, animation, 3D scenes, UI and sprite work | Preserves layers, paths, timelines and revision states | Requires disciplined naming, backups and access control |
| Metadata | Identification and licensing details | Efficient and searchable when retained | Software and platforms can strip or rewrite fields; preserve originals |
| Timestamp or deposit service | High-value or high-risk projects | Adds independent evidence that a file or fingerprint existed at a time | Provider reliability, jurisdiction, retention and exportability must be assessed |
| Copyright registration | Formal public record and enforcement preparation | May provide additional legal benefits in the registering jurisdiction | Requirements, fees and effects vary by jurisdiction; registration is not a finding that every disputed fact is true |
Combining methods is usually stronger than choosing one. For example, a concept artist might pair a numbered sketchbook with native layered files, preserved camera originals, a signed client brief, and a timestamped milestone export.
How metadata and file history support provenance
For each digital asset, preserve the fields that explain its origin and handling: creator or studio name, creation date, project ID, software and version, device, dimensions, color space, and licensing or credit information. If your application supports custom fields, use a consistent vocabulary rather than changing labels from project to project.
Keep a copy before uploading to a portfolio site, game repository, marketplace, or social platform. Those services may recompress an image, remove EXIF, convert color profiles, or generate a new file date. The online copy can demonstrate publication, but it should not replace your original archive.
Revision history is most useful when it is understandable. A folder containing dozens of files named “final,” “final2,” and “final-new” creates ambiguity. Use dates, stage numbers, and a short change log. If a file is corrected, preserve the earlier version and explain the correction in a new entry.

Originality is a modest legal threshold, not a requirement that an artwork be unprecedented. Independent creation and a minimal degree of creativity can be enough for copyright in the United States. Your process records can help show independent creation, but they cannot transform a bare game mechanic, visual idea, method, or concept into protected expression.

Registration rules are jurisdiction-specific. In the United States, registration creates a public record and provides additional legal benefits. For U.S. works, registration or refusal is generally required before filing an infringement lawsuit, and timely registration can affect the monetary remedies available in litigation. Confirm current requirements, fees, deposit rules and deadlines with the U.S. Copyright Office before relying on registration for a particular dispute.
Registration does not certify that you alone made every element, resolve a work-made-for-hire dispute, or decide whether a reference was licensed. Submit an accurate claim that distinguishes your contribution from pre-existing, third-party, or client-supplied material.
Outside the United States, the existence of automatic copyright, registration systems, litigation prerequisites and available remedies can differ. State the relevant country or territory whenever you discuss ownership, enforcement or registration.

Concept art and pre-production
Save the brief, mood boards, thumbnails, silhouette sheets, paintovers, and rejected directions. Mark which elements came from a client’s lore or design document and which visual choices you introduced. A dated sequence helps distinguish your expression from a general instruction such as “make a futuristic city.”
Sprites, UI and motion assets
Preserve grid plans, tile tests, frame-by-frame passes, timing charts, vector sources, font licenses, and export settings. Keep both the editable source and the exact atlas, sprite sheet, or package delivered to the game team. Note any engine-side transformations that occur after delivery.
3D models and textures
Archive blockouts, topology changes, sculpt layers, UV layouts, texture sources, bake settings, and procedural graphs when they materially contribute to the final asset. Record whether scans, kitbash parts, marketplace assets, or studio libraries were incorporated and under what license.
Team production
Use a contribution log tied to file versions and task assignments. Preserve review comments and approvals that identify who made a change. A task tracker can support chronology, but it should be backed by the actual files and exports rather than treated as a substitute for them.
Prepare an evidence package for a dispute
When someone questions authorship, avoid sending an unstructured dump of every file. Create a read-only package with a clear index:

Keep an untouched master archive and work from a copy when preparing material for review. Do not rename or edit the only original to make it easier to read. If a lawyer, platform, publisher, insurer or court requests production, ask what format and chain-of-custody information they require.
Common failure modes and fixes
Only the final export exists
A final JPEG or PNG can show what was delivered but little about how it developed. Start saving milestone files now, and reconstruct older chronology only from authentic backups, emails, version histories and dated exports; label reconstructed portions honestly.
Dates conflict
Different time zones, camera clocks and cloud systems can produce apparently inconsistent dates. Record the time zone used, preserve the original system metadata, and explain known clock corrections in the journal rather than silently changing timestamps.
Metadata disappears after upload
Keep the pre-upload original and document the upload date separately. Ask collaborators or platforms to return the original file when possible.
A timestamp is treated as authorship proof
Use timestamp evidence to establish existence by a time, then connect it to authorship through sketches, native files, account records, contracts and consistent access history.
Collaborators’ rights are unclear
Pause delivery of disputed material if possible, identify each contribution, and obtain a written assignment or license that matches the intended use. Payment alone may not answer ownership questions.
A client supplied the core design
Separate the client’s pre-existing material from your original expression in the project record. Keep the brief and permissions, and do not claim ownership of material you did not create.
The archive is inaccessible
Test restores, preserve required fonts or plug-ins where licensing permits, and keep viewable exports for situations in which the original application is unavailable. Document any migration or conversion.
Quick Recap
Retention checklist
- Every sketch, scan, native file and export has a date or a traceable place in the chronology.
- Filenames identify the project, date and stage.
- Earlier versions are preserved rather than overwritten.
- Original metadata is retained separately from platform copies.
- At least two independent backups can be opened and restored.
- Contributors, references, licenses, releases and commissioning terms are documented.
- High-value work has independently verified time evidence when appropriate.
- Registration decisions reflect the correct jurisdiction and ownership facts.
